06-23-39 v MINUTES OF A SPECIAL MEETING OF THE ATLANTIC BEACH TONN
COUNCIL HELD AT THE TOWN HALL AT 8 P.M. JUNE 23, 1939.
Present:

The Mayor , Mr. George H. smith and Town Attorney,
Mr. C. C. Howell , Jr. were also °resent.
The meeting was called to order by Mr. Chiasson,
President , and thereupon, Mr. Rosborough moved and Mr. Trout
seconded, which motion was adopted that the reading of the
minutes of the last regular meeting be passed to the July
meeting.
Upon motion of Mr. Trout , seconded by Mr. Rosborough,
the following Resolution was unanimously adopted:
WHEREAS, Chapter 16311 , Laws of Florida, Snecial Acts
of 1933 set a mandatory rate of interest on the un-
assessed balances of the Seawall Construction Account
against Ocean Front Abutting Property Owners in the
Town of Atlantic Beach, such interest being six (6j)
per annum when the bond requirement was only 4 ', and
NHEREAS, the Atlantic 9each Town Council was without
authority to change the rate of interest, en amend-
ment to the said Chanter 16311 , beim necessary before
such an adjustment could be made, and
NHEREA.S, such en amendment to the said 'Legislative
Act has now been obtained, and accounts of abutting
property owners have been accordingly adjusted, and
JHEREAS, by virtue of this situation some of the
Ocean Front Pronerty Owners were more or less confus-
ed and uncertain as to the legal status of the
installments and interest assessed prior to the reduc-
tion of the interest rate on the unassessed balance ,
and
NHEFEAS, it is the desire of this Council to make ad-
justments in the said Seawall Construction Account as
such adjustments seem to be warranted and legally
permitted,
NO1, THEREFOPE, BE IT RESOLVED BY THE MAYOR AND TOWN
COUNCIL OF THE TONN OF ATLANTIC BEACH, FLORIDA,
That due to the fact thrt interest has heretofore
been charged in excess of the bond requirements on
account of the Construction of a Seawall in the said
Town, and that there may have been some confusion by
virtue thereof, that this Council do , and it hereby
does , .Naive ell penalties assessed against the accounts
now delipouent until the next and following delinaauent
date , to wit: September 1 , 1939,
BE IT FURTHER RESOLVED, That in the event of failure
on the part of any delinquent to nay within the time
named above all assessments and interest on unnaid
balances, that it shall be construed that such
failure to nay is indicative of unwillingness to pay,
and any and all penalties now due shall stand
iassessed against each and every account remaining un-
paid on September 1 , 1939,
BE IT FURTHER RESOLVED, That the Town Clerk be
instructed to furnish copies of this resolution to
all Ocean Front Property Owners, together with a state-
ment to all concerned showing the adjusted statement.

The President read a letter from the Town Clerk
and Tax Collector in reference to the Seawall Construction
account in which attention was called to the fact that the
Town would lose interest by virtue of the full payment of
some of the accounts. The matter was discussed and the
Town Attorney end Town Clerk were directed to look into the
matter of retiring bonds before due date and to renort their
findings back to the Council .
A Resolution Prepared by the Clerk in reference to
the refund of excess interest on the Seawall accounts
which has been paid was thoroughly discussed and upon
advice of the Town h,ttorney action looking to the refund
of this money was deferred to a later date.
The Chair raised the question of a traffic hazard
caused by shrubbery on the premises of Lawrence Haynes et the
corner of Fifth Street and East Coast Drive. This matter was
thoroughly discussed and thereupon, the Chair designated him-
self , the Bayor, C. L. Rosborough and the City Supervisor to
make a study of such hazards throughout the Town and to seek
a remedy therefor in all instances.
t,f ter amendments, ?_'r. Rosborough moved the passage
on third and final reading of an Ordinance entitled , "An
Ordinance fixing the License Fees for Persons , Firms and
corporations Conducting a Business or Profession in the
Town" . Br. Trout seconded the motion end the Ordinance was
passed on Final reading.
The _`ayor raised the question of the collection of
license fees from R. E. Sugg for various types of business
for the year that is nearing a close , that Mr. Sugg had
refused to nay these licenses and that he had called on
Sugg personally and that rr. Sugg prom' sed three weeks ago
to nay the fees promptly. However, payment has not been
received end it was the opinion of the Council that the
:ayor should proceed under his authority to collect the fees
or else bring Yr. Sugg to Court.
Mr. S. F. :'illiams made a complaint regarding the
electrical current and the electrical service he is
receiving. The City ._supervisor explained the trouble now
being experienced by the City of Jacksonville with an
overload. The City Supervisor was instructed to keep be-
hind the matter and to make an effort to remedy the
condition.
Mr. :Jilliams also spoke of the mosquito situation.
It was explained that the recent rains had filled a lot of
holes in the town with water and that some effort
should be made to have these stagnant pools covered with
oil.
Harcourt Bull also talked relative to the mosquito
control .
Harcourt Bull also called attention to the poles of
the City of Jacksonville on East Coast Drive and suggested
that it might be possible to get the City of Jacksonville
to use Sherry Drive or Saltair Boulevard for the high lines
through the Towns. Jfter a discussion , the Town Clerk wasIlk
directed to address a letter to Ernest A. Andrews, City
Commissioner of Jacksonville having supervision over the
light distribution, and request that the poles be moved
back to either Sherry Drive or Saltair Boulevard.

".r. Posborough ra sed the question of an extra man during
the summer months on week ends and holidays to assist the Town
Marshall in policing the Town.
Mr. Rosborough made the following motion, which was
seconded by mr. Trout and passed:
RESOLVED that the Town Council appropriate a sum not in
excess of rive Dollars per day for the employment of a
special police officer for week ends and holidays for
the period from June 24th to September 4th inclusive,
BE IT FURTHER RESOLVED that a police officer from the
City of Jacksonville, if possible, be employed
temporarily on this basis.
Mr. Fosborough explained that he had already made
arrangements satisfactory to the Police Department of the
City of Jacksonville whereby some police officer could under-
take the work temporarily. So ordered.
J. A. Reid, Judge of the municipal Court asked the
uouncil ' s pleasure in reference to jail sentences in view of
the fact that the Town has no place to keep prisoners and
would have to pay jail fees to Neptune should a jail sentence
be imposed. By unanimous consent of the Council , Mr. Reid
was authorized to impose jail sentences, the prisoners to be
used in Town Nork under the supervision of the City
Supervisor.
The Town Attorney advised the Council that Thompson,
good and Hoffman, New York Bond Attorneys , had agreed to
handle bond matters for the three proposed N.P.A. Projects at
a retainer' s fee of $125 and 0125 to be paid by the Town upon
the favorable passage by the said firm of the bonds.
Thereupon, Mr. Rosborough moved that Thompson, Wood and
Hoffman be retained as bond attorneys for the Town on the
proposed bond issue , to be finally advised if and when the
projects are approved by W. P.A. and prior to the calling of a
bond election. The motion was seconded by Mr. Trout end
unanimously adopted.
The Chair explained the difficulty he is having in
arranging a meeting with the Duval Engineering and Construc-
tion Company officials in reference to the street improvement
program. He asked the Town Attorney to explain his decision
in reference to assessments against abutting property owners
on account of the already completed street project. Mr. Howell
explained that he was at this time doubtful as to the method to
be pursued in this connection and he would have a decision to
render at the regular meeting in July.
There being no further bust : . for cons deration, the
