The Regular Monthly Meeting for July was postponed
from July 4, 1939, the date duly set therefor, to this date
and this meeting was called by the President of the Council
in the following words and figures, which notice was deliver-
ed to the Mayor, Town Clerk and each of the Members of the
Council , and each signed acknowledgement of the service of the
notice:

You, and each of you will please take notice that the date of
the regular July, 1939, monthly meeting of the Town Council of
the Town of Atlantic Beach, Florida, having fallen on the 4th
day of said month, a national holiday, and it having been deem-
ed inexpedient to hold the said meeting at such time , the said
meeting will instead be held at the Town Ht-11 in said Town on
Friday, July 7th, 1939, at 8 o'clock P.M.
Kindly govern yourselves accordingly.

In accordance with this notice , the meeting was called to
order by E. L. Chiasson, President.
The Clerk read the minutes of the Regular Monthly meeting
of June 6 , 1939, which with Proper amendments and corrections were
approved as read, upon motion of Mr. Outler, seconded by Mr.
Rosborough.
The Clerk read the minutes of the Special !'eeting of June
we, 1939, which with amendments and corrections were , upon motion
of Yr. Outler, seconded by Mr . Rosborough, approved.
Mr. Osborne , Town Treasurer , made his usual monthly
financial report, which upon motion of Mr. Trout , seconded by Mr.
Outler, was approved and ordered filed.
Mr. Outler moved and Mr. Posborough seconded the

Yr. Trout, Chairman of the Finance and Taxation
Committee , reported that he would be ready to submit a Tax
Roll and proposed budget set up by the next regular monthly
meeting.
There were no other committee reports.
The Chair reported that he had been advised by Mr.
L4rest of the Duval Engineering and Construction Company that
that company would extend five years to abutting property
owners for street improvements, past and future at an interest
rate not to exceed 6? per annum.
The matter was discussed thoroughly and thereupon the
Mayor was requested to forward to the tax-payers and property
owners of the Town the letter he is preparing explaining the
purpose of a new bond election, new improvements, etc .
The matter of assessments Was thoroughly discussed as
well es the tax levy.
The Chair read a letter report on the Incinerator by
the City Supervisor, further explanation was made , and the
matter was discussed.
Mr. Outler raised the question of the taxing powers
of the Town granted by the Charter to make improvements. This
matter was thoroughly discussed, he , Mr. Cutler, nointing out
that in his opinion a tax levy of ten mills could be set for
general purposes and that any and all assessments for general
purposes and that any and all assessments for improvements
could be made in addition to the ten mills.

The matter of Seawall accounts was gone into, the
discussion being raised by the Chair. in reference to this
matter , the following were disposed of:
( a) A letter from the Town Clerk in reference to
the use of penalties collected under the Seawall accounts and
on the Town' s Share for that purpose was read. It was the
opinion of the attorney, concurred in by members of the
Council , that penalty interest could not be converted to general
fund purposes .
(b) That no further concessions could be legally made
on the seawall accounts and that the Town Attorney should
proceed •with his suit against the Hotel Company; that if Mr.
Adams desired to make a settlement on the basis of the adjust-
ments already made , that he do so through the Court Channels.
(c ) The Clerk reported satisfactory response to the
adjustments made and that some of the accounts have already
been brought to date.
(d) in reference to the Meyerson case, the Clerk
advised that Mr. Meyerson had paid in accordance with the
letter addressed to him and first furnished the Town Attorney
who mailed the letter to Mr. Meyerson. No settlement was made
for court costs and attorney ' s fees. The Town Attorney is to
look into this.
(e) The Chair explained the purpose of a proposed un-
official meeting with Yr. V. R. McQuaid on July 5th, at which
meeting all those called were present except Mr. McQuaid; that
Mr. McQuaid proposed to intercede in behalf of Mr. W. H. Adams
end that the meeting was called for the purpose of hearing Mr.
Mc^uaid' s arguments and making recommendation to an official
meeting of the Council .
The City Supervisor reported regarding the low voltage
and stated that he would keen right after the Electrical De-
partment of Jacksonville to get improvements in the service.
The City Supervisor reported regarding the Musquito
situation and was directed to proceed with the work.
The request of Myron Cronwalt to have Homestead Expemp-
tion changed from his Beach venue house to the Ocean Boulevard
house was denied for the reason that the law would not permit
such a change .
Lillie Mae simmons, spokesman for a committee of color-
ed residents of Atlantic Beach, addressed a communication to
the Council asking assistance in several matters. The City
Supervisor was directed to look into all the matters and to take
whatever action seems warranted in all of the instances cited.
The City Supervisor was directed to communicate with the
Town Attorney and advise him in reference to the lack of
Ordinances and the Town Attorney directed to prepare such as are
necessary to give jurisdiction over various offenses.
The Town Attorney explained the necessity for passing
Ordinances and Resolutions setting up a Board of Appraisals in
reference to the street improvement projects , the one completed
and the one to be undertaken.
The Town - ttorney presented two Ordinances in this
connection.
Thereupon , Mr. Rosborough moved and Mr. Trout seconded
the motion, that an ordinance entitled:
"AN ORDINANCE Appointing a Board of Anpr®asiers to ll) Deter-
mine the Amount of Special Benefit Nhich has Accrued to Certain
Lots, Tracts, or Parcels of Land in and at the Town of Atlantic
Beach, Duval Councy, Florida , by Virtue of Those Certain Street
Improvements undertaken in said Town on, to-wit :
19 , and Completed on
19. ; (20 to Make a Finding as to the Benefit Estimated to
have Resulted to the Public at Large -ecause of said Improve-
ments; and (3) to File a Report of Such Determination and
Finding."
be passed on first reading. This Ordinance was unanimously nese-
on first reading.
Upon Motion of Mr. Posborough, seconded by Mr. Trout,
this Ordinance was passed on second reading.
Upon motion by Mr. Posborough, seconded by Mr. Trout,
an Ordinance entitled:
"AN ORDINANCE Appointing a Board of Appraisers to (1) deter-
mine the Amount of Special Benefit Calculated to accrue to
Certain Lots, Tracts or Parcels of Land in and at the Town of
Atlantic Beach, Duval County, Florida, by Virtue of Certain
Contemplated Street Improvements; ( 2) to Make a Finding as to
the Benefit Estimated to result to the Public at Large Because
of said Improvements; and (3 ) to File a Report of such Deter-
mination and Finding." ,
was passed on t'irst reading.
Upon motion by Mr. Rosborough, seconded by Mr. Trout,
this Ordinance was passed on second reading.
There being no Curtner busin- : Irons' -ration, the
meeting adjourned.
