TOSN COUNCIL HELD AT THE TOWN HALL, SEPTEMbmii
1939 at 7:30 P.M.

The Mayor, Mr. George H. Smith was also present.
This meeting was called pursuant to e notice duly
executeu by t.0 President of the Town Council under date
of September 15, 1939 for the specific purposes listed
below:
(a) Receiving and adopting a preliminary tax roll for
the year 1939 and fixing a date when an equalization meet-
ing will be held.
(b) Considering, adopting and passing all resolutions,
ordinances and taking such other necessary action in connec-
tion with the following matters as is required:
1. _7ssing on Third and Final Reading all Ordinances
necessary to call an election for bond issues to cover
sponsor' s donation for projects covering Street Improvement,
construction of a Garbage incinerator , Remodeling the Town
Hall and Construction of a water works system in the Town.
2. Providing for an election to ratify legislative
acts passed at the last session of the Mate Legislature
(a) Amending the law on the interest for Seawall Construc-
tion Bonds, (b) Amending the Zoning Ordinance , and (c)
Amending the Charter to provide for Tax Collection.
The Meeting was called to order by the President.
Upon motion of Mr. Outler, seconded by Mr. Rosborough,
the reading of the minutes of the previous meetings was
dispensed with and deferred to the regular monthly meeting
in October.
The Clerk read an Ordinance entitled, "AN ORDINANCE
Affecting the Government of the Town of Atlantic Beach,
Duval County, Florida; Providing for an Increase in the
limit of its Bonded Indebtedness; and Calling a Special
p Election for the Approval thereof" .
Thereupon Mr. Outler moved the passage of this
Ordinance on Third and Final Feeding, Mr. Rosborough
seconded the motion and the Clerk called the roll , the vote
being:

The Clerk read an Ordinance entitled, "AN ORDINANCE
Calling a Referendum Election for the Ratification and
Approval by the Qualified Electors of the Town of Atlantic
Beach, Florida, of (a) Chapter 19686, Laws of Florida,
Special Acts of 1939, Entitled "An Act to Amend Chapter
16311 , Laws of Florida, Special Acts of 1933 , Entitled,
'An Act Relating to the Town of Atlantic Beach, in Duval
County, Florida, Providing for the Construction of Sea-
walls, Authorizing the Issuance of Bonds for that
purpose; Authorizing and Providing for Special Assessments
Against Abutting Property to pay a Portion of the Cost of
Seawalls, or the Bonds Issued for that Purpose , and
other Matters in Connection Therewith or Relating There-
to" ; of (b) Chapter 19687, Laws of Florida, Special
Acts of 1939, Entitled "A Bill to be Entitled, 'An Act
to Amend Sections 28, 31 and 33 of Chapter 13907, Laws
of Florida, Acts of 1929, the same being 'An Act to fix
the Territorial Limits of the Town of Atlantic Beach,
to Provide for its Government, and Prescribe its Juris-
diction and Powers" ; and of (c) Chapter 19688, Laws of
Florida , Special Acts of 1939, Entitled "An Act
Authorizing the Town of Atlantic Beach, Duval County,
Florida to Provide for and Prescribe Zoning Regulations;
and Repealing Chapter 16313 , Laws of Florida, Special
Acts of 1933, entitled 'An Act to Provide and Authorize
the Town of Atlantic Beach, Duval County, Florida, to
Provide and Prescribe Zoning Regulations ".
Thereupon, Mr. Outler moved the passage of this
Ordinance on Third and Final Reading. Mr. Rosborough
seconded the motion and the Clerk called the roll , which
showed the following Vote :

Mr. Brooke G. White , Jr. , Town Tax Assessor appeared
before the Council in reference to the Preliminary Tax
Roll for the year 1939. Some discussion was had in
reference to some of the assessments , after which rr. White
formally tendered the preliminary roll for adoption.
Mr. Outler moved and Mr. Rosborough seconded the
motion that the following Resolution be adopted. It was
unanimously adopted.
RESOLUTION APPROVING PRELIMINARY TAX ASSESSMENT
ROLL FOR THE YEAR 1939.
NHERTEAS, the Town Tax Assessor has completed the
preliminary assessment roll of the Town of
Atlantic Beach, Florida, for the year 1939, and
has submitted the same to the Town Council , and
WHEREAS, It appears that all property, real and
personal, in the Town of Atlantic Beach subject
to taxation has been assessed on said tax assess-
ment roll, and the Tax Assessment Poll is in due
form,
THEREFORE BE IT RESOLVED by the Town Council of
the Town of Atlantic Beach, Florida, that the' said
preliminary tax assessment roll be and the same is
hereby approved,
BE IT FURTHER RESOLVED that the Town Clerk shell
post at the Town Hall and at two other public
places in the Town and shall also cause to be
published daily for four consecutive days in a
newspaper published in the City of Jacksonville,
Duval County, Florida, notice that said assess-
ment roll has been submitted to the Town Council
and approved and also requiring all oersons desir-
ing to have corrections thereof made, whether in 410
the listing, valuation of property or otherwise,
to file with the Town Tax Assessor on or before
the Third Day of October, A. D. 1939, at 8 O 'clock
P.M. , their petition to the Town Council , setting
forth their objection to said assessment roll and
the correction they desire made , and also that the
Town Council will meet at the Town Hall in Atlantic
Beach, on the 3rd Day of October, A. D. 1939 at 8
O'clock P.M. for the purpose of equalizing said
assessments and making proper corrections therein
Upon motion of Mr. Outler, seconded by Mr. Fosborough,
the Town Clerk was directed to post the following notice at
the Town Hall and at two other public places in the Town,
• and to cause the said notice to be published four consecutive
times in a Jacksonville , Duval County, Florida , newspaper:
"NOTICE OF COMPLETION OF DFELII,'INARY TAX ASSESSMENT
ROLL OF THE TO'R'N OF ATLANTIC BEACH, FLORIDA, FOR THE
YEAR 1939.
TO ALL 'WHOM IT MAY CONCERN: You are hereby notified
that the preliminary tax assessment roll for the Town of
Atlantic Beach, Florida , for the year 1939 , has been
completed and submitted to and anproved by the Town Council.
All persons desiring to have corrections made thereof,
whether in listing, valuation of property or otherwise , are
required on or before the 3rd day of October, A. D. 1939,
at 8 P.M. to file with the Town Tax Assessor of the Town of
Atlantic Beech, their petitions to the Town Council , setting
forth their objections to the said assessment and the
corrections that they desire made.
The Town Council will meet at the Town Hall in the
Town of Atlantic Beach, Florida, on the Third day of October,
A. D. 1939 for the purpose of equalizing said assessments
and making proper corrections therein. All persons who shall
file petitions as aforesaid will be given the opnorttnity to
be heard at said meeting.

A Committee from the Atlantic Beach Garden Circle
composed of Mrs. McGeehee , acting as Chairman, Mrs. Brooke
G. White, Jr. , Miss Mary J. Montague , Mrs. P. M. Burroughs
and Mrs. Harvey, appeared before the Council and rra de .
complaint in reference to the manner in which the Town Park
has been kept and stated that with an appropriation of
per week from the Council , if the Perk is turned over to the
Garden Circle as their annual project, the park could be
■ kept in good shape. It was proposed that a man be hired for
four hours per week in lieu of work by the Town' s crew.
This matter was thoroughly discussed. The City Supervisor
advised that time consumed on the Park had amounted to more
than eight hours per week during the past summer. However,
the Committee assured the Council that the Park could be
cared for on the basis of $50 per year.
Thereupon, Mr. Outler moved that the Town Park be turn-
ed over to the Atlantic Beach Garden Circle for the coming
year and that a sum not in excess of 50 be appropriated and
included in the budget for the coming year to be used by the
Garden Circle under their direct supervision, if and when
needed. The motion was seconded by Mr. Rosborough and
unanimously adopted, and the Clerk directed to so advise the
Garden Circle . The Town Clerk was further directed to go
further by furnishing muck if and when needed for the park
upon the Ladies advising where the much is to be unloaded and
provided the hauling of the muck does ,00. low_ ere th the
