11-07-39 v MINUTES OF THE REGULAR MONTHLY 'MEETING OF THE ATLANTIC BEACH TONN COUNCIL HELD AT THE TONN HALL AT 8 P. M. NOVEMBER 7 , 1939. Present: E. L. Chiasson J. C . Outler G. L. Rosborough Thomas N. Trout. The Mayor , Mr. George H. Smith and Town Attorney, Mr. C . C. Howell , Jr. , were also present. The Vice-President , Mr. G. L. Rosborough, called the meeting to order end nresided throughout. Upon motion of Mr. Chiasson, seconded by Mr. Cutler, the minutes of the regular meeting of October 3rd , continued through October 10th, were approved as read. Upon motion of Mr. Chiasson, seconded by Mr. Cutler, the minutes of the Equalization Board Meeting of October 3rd, continued through October 10th, were approved as read. Upon motion of Yr. Chiasson, seconded by Mr. Cutler, the minutes of the Special Meeting of October 19th were approved as read. Upon motion of Mr. Outler, seconded by Mr. Chiasson, the minutes of the Special Meeting of October 27th were approved as read. Mr. Osborne , Town Treasurer, submitted his usual monthly financial report, which, upon motion of Mr. Trout, seconded by Mr. Cutler , was approved and ordered filed. Upon motion of Mr. Trout , seconded by Mr. Outler , the following bills were approved and ordered paid if end when funds are available : Arnold Printing and Label Co. Outler, seconded by Mr. Trout, the President of the Council and the Town Clerk were authorized and directed to extend the $1000. note , which will become due on November 13th at the Florida National Bank, such extension to be made for a period of sixty days. Payment on the item of $252. due the Florida Times-Union, end the item of 162.15 due Mr. C . C. Howell , Jr. , Town Attorney have been deferred to the December Meeting. Upon motion of Mr. Chiasson, seconded by Mr. Cutler, and unanimously adopted, the following proposition submitted by the Mm. A. Estaver Company by J. G. Hurst , Sales Manager. , was accepted and the President of the Council and the Town Clerk were authorized and directed to execute a note for and in the name of the Town of Atlantic Beech in the sum of 5520. 44, payable in sixty days from date with the privilege of renewal or extension. Hurst Sales Manager" At this point Mr. Chiasson explained in detail his efforts in connection with the proposed ':.P.I:. project to construct a waterworks system in the Town of Atlantic Beach end then called upon the City Supervisor to explain the results of a conference , on November 6th , between ',V.P.A. Officials and himself. The City Supervisor explained that some parts of the project would evidently have to be omitted but that for the most part , the necessary and essential lay- out would be retained if the recommendation of the State Office of rV.P.A . is followed by the Engineer ' s Office in :ashington. Thereupon Mr. Cutler moved, and Mr. Chiasson seconded the motion, which motion was unanimously adopted that the City Supervisor proceed at once with compilation of such additional information as is required by the ;v. P.A. Officials and that the Town proceed on the idea that with as little delay as possible to secure the assistance obtainable from the Norks Progress Administration on this project. Mr. Chiasson moved and Mr. Trout seconded the motion that the City Supervisor be authorized and directed to make arrangements with 0. J. Oosterhoudt with reference to the audit and other work in connection with the accounting system for the town, such fees to be charged by Mr. Oosterhoudt not to exceed yl50. This motion was put and the following vote was recorded: For adoption: E. L. Chiasson Thomas N. Trout G. L. Posborough Present and not voting: J. C. Cutler. A committee representing the Parent-Teaches Association of the Elementary School at the Beach appeared before the Council and ask for an appropriation to assist in welfare work at the School. It was explained that the city of Jacksonville Beach has heretofore appropriated some money for this purpose and that inasmuch as some of the children affected reside in the Town of µtlantic Beach, that the Town should carry its 4411 pert. _ _Zz524-1 Thereupon Mr. Chiasson moved, seconded by Mr. , that the Town appropriate x'10 per month for a period of five months. The motion was put and the following vote was record- ed: For: E. L. Chiasson G. L. Rosborough Thomas N. Trout Present and not voting : J. C. Cutler. Mr. George t`.. Pritchard appeared before the Council in reference to the matter of establishing a Post Office in Neptune. Mr. Pritchard explained that en effort is being made which would result in the establishment of two fourth class Post Offices, thereby diminishing the efficiency of the Atlantic Beach Post Office . This matter was thoroughly discussed by all members of the Town Council and the Town Officials present. It was the unanimous opinion of all that there could be no objection to the desire on the part of Neptune to secure Postal recognition of some type, but to lower the class of the present Post Office would only tend to lower the Postal service in this area. By unanimous consent, the President of the Council was requested to communicate the sentiments of the Town Officials of Atlantic Beach to Assistant Postmaster-General N. N. Howes and to other postal authorities having jurisdiction in the matter; that such a letter should suggest the unselfish attitude of the Town in reference to Neptune obtaining recognition, but should strenuously oppose the lowering of the Postal service we are noa receiving, which would he a natural result of the division of the present Post Office. By unanimous consent , the Chair appointed Mr. L. Chiasson and Fr. C . R. Frazier as a committee to meet with the Volunteer Fire Department to discuss the matter of fire protection in the Town of Atlantic Beach. The following motion was made by Mr. Outler and seconded b`j tu Mr. Trout, and unanimously adopted: NHEREAS, the Act of the .tate Legislature of 1933 providing for th c struction of a ,seawall in the Town of Atlantic Beach, the rate of interest to be charged against unassessed balances on seawall abutting property liens at 6%, and NHEREAS, the bonds held by the Reconstruction Finance Corporation of the United States Government only draw interest at the rate of 4%, and NHEREAS, by virtue of this mandatory interest rate , excess interest was charged against abutting property owners on their third and fourth installments and in most instances collected and deposited in the _$eawall account at the t'lorida National Bank, and NHEREAS, the Legislative Act passed at the 1939 session of the State Legislature amended the act of 1933 so that such Seawall assessments would bear interest at the rate of 4`' instead of 6% and that such legislative act was ratified by a vote of the freeholders of the Town of Atlantic Beach on October 27th, BE IT RESOLVED by the Mayor and Town Council of the Town of Atlantic Beach that the rate of interest on the third and fourth installments be fixed at 4% and that the Town Treasurer be directed to return to the property owners who have paid 410 in excess, the difference between 4 and 6%, BE IT FURTHER FESOLVED that the Toaan Clerk is hereby directed to certify to the Town Treasurer, for such refunding, a list of such excess payments.
