BEACH TOWN COUNCIL HELD AT THE TOWN HALL AT 5:00 P. M. ,
DECEMBER 5, 1939.

The Mayor, Mr. George H. Smith and the Town
Attorney, Mr. C. C . Howell , Jr. , were also present.
Upon motion of Mr. Cutler, seconded by Mr. Trout ,
the minutes of the regular monthly meeting of November
7th were approved as read.
Mr. Osborne , Town Treasurer, submitted his usual
monthly financial report, including disbursements on
account of refund of excess interest paid by Seawall
Abutting property accounts , which was approved and order-
ed filed. Mr. Osborne called attention to the check
issued to the Estate of William T. Stockton covering one
of these refunds , which the attorneys for the Estate ask
that any check drawn be in favor of the present owners of
the property. It was found and determined that the Town
is without authority to make refund to any persons except
to those who over-paid and it was suggested that the
Estate of ';William T. Stockton endorse the check over to
the new owners.
Upon motion of Mr. Cutler, seconded by Mr. Trout ,
the following bills were approved and ordered Haid:

Mr. Fred L. Mullikin was a visitor and expressed
himself in a complimentary manner in reference to the up-
keep of the parkways in the Town.
The question of a fire plug at the corner of 12th
Street and Beach Avenue was raised and discussed and the
matter passed to the next regular meeting.
The Mayor made the recommendation that the Town
proceed in the paving of additional Streets on private
411 contract. This matter was thoroughly discussed, and at
this point, Mr. Outler moved that en Ordinance entitled:
"AN ORDINANCE Appointing a Board of Appraisers to (1 )
Determine the Amount of Special Benefit Which has Accrued
to Certain Lots, Tracts, or Parcels of Lend in end at the
Town of Atlantic Beach , Duval County, Florida, by Virtue
of Those Certain Street Improvements Undertaken in said
Town on, tg-wit, - 03-. qand completed
on - 4--A ,Sq , ; (2) to Make a Finding as to
the'Benefit Estimated to have Resulted to the Public at
Large because of said Improvements; and (3) to File a
Report of Such Determination and Finding, "
be placed on Third and Final Reading. Mr. Trout second-
ed Mr. Outler' s motion and the Ordinance was placed on
Third and Final Reading and put to a vote . P11 members
present voted for its passage . This Ordinance has to
do with abutting property assessments against the Street
Project already completed and the Mayor again raised the .
question of new projects. The matter was thoroughly
discussed and the following motion was made by Mr. Trout -
that the City Supervisor be , and he is instructed, to
secure preliminary estimates from private contractors
covering the work proposed under the pending N.P.A.
application, which preliminary information to include
cost, or approximate cost , the manner in which abutting
property liens may be handled for financing the work,
the rate of interest, etc. ; it being specifically under-
stood that the Town is not to be obligated at this time
and that the bids submitted at this time are not to be
binding on either the bidder or the Town. The
Resolution was unanimously adopted.

Mr. Chiasson advised that he has secured the
assistance of the National Board of Fire Underwriters
in the preparation of a suitable Ordinance covering
Building Code ,that the Zoning Commission had found it
advisable that a new Building Code should be passed to
become operative at the same time the new Zoning
Ordinance goes into effect.
Mr. Chiasson explained in detail in reference
to the movement on foot to establish a separate Post
Office in Neptune . The Council reiterated their previous
stand in reference to this matter - that no one connect-
ed with the Town objects to Neptune ' s effort to secure
recognition, but that any effort to lower the postal
service at the Beaches hes been, and will further be met
with strenuous opposition.
There being no further business for considera-
tion, the meetind was adjourned.
