07-05-38 v PEGULAR MEETING OF THE TOWN COUNCIL OF ATLANTIC BEACH , HELD TUESDAY JULY 5TH, 1938, AT EIGHT O'CLOCK, P.M. AT T0WN HALL. PRESENT: - J. C . Cutler, u. C . Howell , G. L. Rosborough. Mayor Geo. H. Smith also was present and likewise C . C. Howell , Jr. , Town Atty. The meeting eas called to order by Mr. J. C . Cutler, °resident. The minutes of the Regular Meeting of June 14th, were read and approved as read. The Clerk read a letter signer: by E. H. Thompson, Chairman of the Public 'Works Committee , addressed to J. I . Long, Duval County Engineer, in reference to the new proposed route through the Town to be used as a County Road connecting the Atlantic boulevard with Seminole beach Road on the North, and a reply thereto from Mr. Long. The correspondence was received as information and ordered filed. Mayor Geo. H. Smith, reported on behalf of the Committee composed of mr. White , and the Mayor to negotiate the transfer of the Saltair Electric SYatem from the bull interests to the Town. Mr. Smith gave his understanding of the arrangement as proposing to execute a note of the Town to the bull interest for the amount rep- resented by back bills, such note to be paid from collections on these back bills if possible. The matter was deferred to the Special meeting to be held on the 18th of July. mayor Geo. H. Smith reported that he had negotiated an ar- rangement with Jacksonville beach and the Life Savings Corps to have a Life Guard for all week days to be stationed at Atlantic beach, the Guards to look after the Safety Bathing barriers, at a salary of $15. per week. • C . C. Howell , Jr. , raised the question of action on the delinquent tax list of the Mandalay Corporation, and asked the Coun- cil instructions. Mr. Cutler explained that a representative of this corporation had endeavored to contact him on several occasions rela- tive to this matter and by consent of the Council directed the Town Attorney to contact the officers of this corporation and if no satis- factory arrangememt could be made to institute the necessary suit for collection. The Town Attorney explained the situation relative to delin- quent taxes on property of Chas. E. Pelot; that Mr. Pelot had prom- ised that if the suit would be held up until about this date , he would make settlement, but that Mr. Pelot had advised that he is not now able to make settlement. Mr. Howell asked for instructions and was directed to proceed with suit. The Town Atty. called attention to a bad cheque in his possession in the case of the Town vs Mayo, on a traffic charge; that he had duly notified Mayo and that Mayo had not yet made the cheque good. Mr. Howell was instructed to direct the marshal in the matter of attempting to collect without Court action and the method to be pursued in case results were not obtained in this manner. Mr. Howell introduced the following resolution, which , after a second by Mr. Rosborough, was passed : - R E S O L U T I O N - R'a SOLVED BY THE TONN COUNCIL of the Town of Atlantic beach, Florida, that every candidate for the office of mayor or for member- ship on the Town Council to be elected at an election to be held on the 9th day of August, t. D. 1938, desiring his name to be printed on the official ballot, shall notify the Town Clerk, in writing on or before the 1st day of August, A. D. 1938, at 6 o 'clock, P. M. and each candidate for mayor filing such notice shall be required to pay a fee of ten dollars ( $10.00) and each candidate for member of the Town Council , a fee of N'ive dollars ($5.00) at the time of fil- ing said notice . RESOLVED FURTHER, That the Town Clerk shall have prepared for said election, a printe, ballot with the names of the candi- dates complying with the terms of tris resolution, and there shall be printed under each office to be voted for in this election, blank lines equal in number to the names of the persons who may be elected to fill that office. The form of ballot to be used at said election shall be in substantially the following form: - OFFICIAL BALLOT ATLANTIC BEACH, FLORIDA. Election of August 9th, 1938. make Cross Mark (X) before the name of your choice. Vote for one For Mayor. Vote for five la'or Town Council. FESOLVED FURTH P , That the Mayor shall appoint three • Inspectors to hold said election , which shall be held and con- ducted as nearly as may be the same as State Elections and it shall be the duty of the inspectors to certify the result of said election to the Town Council , which shall meet at eight ( 8) o'clock, P. on the said _ ugust 9th, . D. 1938, to re- ceive the returns of said election and declare the results thereof. Tuly 5 , 1938 -age 3- RESOLVED FURTHER, That the person receiving the highest vote for Mayor shall be declared elected and the five (5) per- sons receiving the highest vote for Town Council , shall be de- clared elected for the ensuing term. The Chair explained that continued efforts had been made by members of the Council to sell these bonds at a low rate of interest without success. He advised the other members of the Council that as yet the Atlantic Beach Improvement League had failed to offer any co- operation and that the members of the Council feel that for the best interest of the Town, the bonds should not be sold at the high rate of interest thus far demanded by prospective purchasers; that every effort possible should be made to sell them at a low rate of inter- est. Mr Smith then explained that he had communicated with the Reconstruction Finance Corporation in reference to the possibility of the Town selling the bonds to that organization and had received a reply to the effect that the R. F. C. has purchased some municipal bonds to supply sponsor' s donation. for NPA project and advising that if the Town would file an application the matter would be con- sidered with a view to purchasing the bonds. Mr. Smith advised that the application had been secured from the R F C and that the main part of the report had been finished, with only the legal information to be filled in. Thereupon, Mr. Howell introduced the following resolu- tion, which was seconded by Mr. Rosborough, and passed: - - F E S O L U T I O N - A resolution authorizing the Town of Atlantic Beach, Florida , to file an application with the Resonstruction Finance Cor- poration for a loan in financing the construction of ( a) Construct a Municipal Building, (b) Straighten, widen, build and pave streets, (c ) Construct a Garbage Incinerator, designating J . C . Outler , President, and C . C . Howell , Jr. , Town Atty. to furnish such information as Reconstruction Finance Corporation may recuest. BE IT RESOLVED BY THE M_ YOR AND TONN COUNCIL Section 1 , That J. C . Outler, President of Town Council and C . C . Howell , Jr. , Town fttorney be and they are authorized to wxecute and file an application on behalf of Town of Atlantic Beach, Florida , with Reconstruction Finance Corporation for a loan to aid in financing the construction of - • (a ) Municipal Building and f.uditorium, (b) Straighten , widen, build and pave streets and (c ) Construct a Garbage Incinerator. Section 2. That J. C . Outler, President, Town Council and C . C Howell , Town Attorney be and they are hereby authorized to furnish such information as Reconstruction Finance Corporation may reasonably request in connection with the ennlicetion whit'' is herein authorized to be filed . Mr. Rosborough raised the question of additional speed signs and at the same time the matter of these signs as well as some sort of regulation of parking at street ends, were discussed. It was decided that the Mayor would cut stensils and the City Super- visor would make such signs to place at the proper Points. The Clerk read a memorandum submittea by the City Super- visor, conveying the request of the Town officials of Neptune that the Town Attorney for Atlantic Beach be authorized and directed to meet with the Town Attorney of Neptune to draw un uniform ordi- nances on the regulation of mechanical musical devices. Mr. Howell was directed to confer with Mr. Glickstein. Mr. Rosborough raised the question of sponsor' s donation for street work and suggested that the Town borrow sufficient funds to start this work at an early date. The matter was thoroughly dis- cussed and action was deferred to the special meeting of July 18th. A motion was made by Mr. Howell , seconde by Mr. Rosbor- ough, put and carried, that Mr. J. C . Madison, be Paid $15.00 for three days duty as assistant to Marshal Russell over Fourth of July Hollidays. motion There being no further business for consideration , upon / put, seconded and carried, the meeting adjourned.
