11-11-38 v MINUTES OF A SPECIAL MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD NOVEMBER 11 . 1938. Present: E. L. Chiassen J. C. Cutler R. E. Sugg E. L. Chiaason held proxy of G. L. Rexbereugh and R . E. Sugg held proxy efThemss W. Trout. Pursuant to previous notice the meeting wfs called to order by E. L. Chiasson, President. Mr. Cutler presented a bid from Henry Isaac & Co. , to purchase the ;4,000. Incinerator and garbage disposal bonds and the bid of uuval engineering so. , to nurchase the otreet improvement bonds, both issues of 1938. The bid of uuval Engineering & Construction Co. was es follows: bonds at par with 5% interest. The bid of Henry 0. Isaac & Co. was in words and figures as follows: "November 10th, 1938. laity Council , Atlantic beach, Florida. Gentlemen: ror your proposed issue of the following described bonds , to be the direct end general obligation of the Town of Atlantic peach, rlorida, payable by unlimited ad valorem taxes, ;4,000 par value , incinerator Honda, maturing $1,000 each year on February 1 , 1958, through and including 1961 , All bonds to be dated rebruary 1 , 1938, and to bear interest at 5% per annum, payable semi-annually, we will pay you the sum of NINE HUNDRED AND EIGHTY DOLLARS (;980.00) , and accrued interest fbom August 1 , 1938, until the date of delivery of the said bonds. • This bid is made subject to the tdity furnishing us with an unqualified opinion of Mr. Giles J . Patterson, Attorney, Florida National bank building, Jacksonville , Florida, as to - 2 - the legality of these bonds. This opinion must also state that these bonds are payable by unlimited ad valorem taxes assessed against the property of the Town of Atlantic Desch, rlorida. respectfully submitted, HENRY O. The motion is as follows: A RESOLUTION io be rsntitled A RESOLUTION Determining the best aid submitted for • the gown of Atlantic aeach streets Improvement 'onds, issue of 1938, and for the Town of Atlantic peach Incinerator and Uarbage ponds, issue of ,v38; and Accepting said Rid and Appointing Signers for said Bonds. - 3 - WHEREAS, the Town Council of the Town of Atlantic Beach, Florida, has heretbfor_s received bids for the purchase of those certain bonds authorized in and by the provisions of Ordinance No. A-30 of the said Town entitled: "AN ORDINANCE Authorizing and Providing for the Issuance, by the Town of Atlantic Beach, Duval County, Florida , of Municipal Building, of Streets Improve- ment, end of Incinerator and Garbage Bonds, all under the Pro- visions of Section 39, Chapter 1390? , of the Laws of Florida , Bpecial Acts of 1929, Vol . 2, Part One , Approved by the Governor of Florida June 8, A. D. 1929, Under the Provisions of Sections 1 , et seq. , of Chapter 14715, of the Laws of Florida , Acts of 1931 , Approved by the Governor of Florida May 21 , 1931; and in Compliance with Section 6 , Article 9, of the Constitution of the State of Florida , as Amended et the General Election, A. D. 1930"; end WHEREAS, the said bids so received were as follows, to-wit: 1. Henry G. Isaacs Company (for the Town of Atlantic Beach Street Improvement Bonds, and for theJTown of Atlantic beach Incinerator and Garbage Bonds) , and 2. The Duval Engineering and Contracting Company (for the Town of Atlantic Beech Streets Improve- ment Bonds) ; and WHEREAS, the said Town Council has carefully considered the said submitted bids , and is of the opinion that, with respect to the Town of Atlantic Beach Streets Improvement Bonds , the bid of Duval Engineering & Construction Co. is the best bid; and that, with respect to the Town of Atlantic Beach Incinerator end Garbage Bonds, the bid of the Said Henry B. Isaac Co. Is the only , end a fair and reasonable bid: NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA , THAT: 1. This Council does hereby determine and find that the bid of Duval Engineering & Construction Co. wherein it bid Seven Thousand ( 7,000) Dollars, with interest at five (5%) percent per annum, is the best bid submitted to the said Council for the sale of the said Town of Atlantic Beach Streets Improve- ment Bonds, Issue of 1938; and this Council likewise does hereby determine end find that the bid of the Henry G. Isaac Co. , where- in it bid ( ) Dollars, with interest et five (55%) percent per annum, is the best bid submitted to the said Council for the sale of the said Town of Atlantic Beach Incinerator and Garbage Bonds , Issue of 1938. 2. The said bid of Duval Engineering & Construction Co. , for the said Town of Atlantic Beach Streets Improvement Bonds be and the same is hereby accepted , and that said bonds be , and they are hereby awarded and sold to the said Duval Engineering and Construction Company at together with a premium of ( $ • Dollars , plus accrued interest et the rate of five (5%) percent per annum to date of delivery of said bonds, said bonds to bear interest et the rate of five (5%) percent per annum; and the said bid of the Nenry G. Isaacs Company for the said Town of - 4 - Atlantic Beach Incinerator and Garbage Bonds, be end the same is hereby eccppted, and that said bonds be , end they are hereby awarded and sold to the said Henry G. Isaac Company at 98 , together with a premium of ( $ )I}ollars, plus accrued interest et the rate of five (5%) percent per annum to date of delivery of said bonds, said bonds to bear interest at the rate of five (596) percent per annum. BE IT FURTHER RESOLVED that Town Councilmen J. C. Outler be , and he is hereby, designated as that member of the Council to sign and execute all of the aforesaid bonds with the Town Clerk, the President of this Council , and the Town Treasurer. Mr. Outler moved the passage on first reading an Ordinance entitled "An Ordinance Declaring and Determining the Rate of Interest Seven Thousand ( 17,000) Dollars, Town of At- lantic Beach Improvement Bonds , issue of 1938, and Four Thousand ($4,000) Dollars Town of ptlantic Beach Incinerator and Garbage Bonds, issue of 1938, shall respectively bear." Mr. Sugg seconded the motion which was unanimously adopted. Same on Second Reading. The Clerk was directed to furnish a copy of the resolution above to the Duval Engineering & Construction Co. , and Henry G. Isaac and Company. There being no further • ness the meeting adjourned.
