TONN COUNCIL HELD AT THE TONN HALL AT 8 P.M. DECEMBER 6, 1938.

The meeting was called to order by E. L. Chiasson ,
President.
The Clerk read the minutes of the i-egular Monthly
Meeting on November 1 , 1938, which mere approved as read.
The Clerk read the minutes of the Special Meeting
held November 8, 1938, which were approved as read.
The Clerk read the minutes of the Special meeting
of November 11 , 1938 , which were approved as read.
The Clerk read the minutes of a special meeting
held November 21 , 1938, which were approved as read.
The Clerk read the minutes of a °peciel Meeting
held November 29 , 1938, which were approved as read.
Mr. Osborne , Town Treasurer, submitted his usual
monthly financial reports which were read , and upon motion
by Mr . Trout , seconded by mr. Rosborough, were approved and
ordered filed.
IV!r. Ball , pttorney , appearing in the stead of Mr.
Murchison, attorney for Hayden urosby, read an affidavit
setting forth facts and figures to substantiate w+r. Crosby ' s
plea for abatement in the assessment against his ucean Front
property. The affidavit was received and ordered filed. It
appearing that the actual cost of tre improvements on Mr.
Crosby ' s property had been grossly exaggerated, thereby con-
fusing the Tax Assessor and causing him to place an assess-
ment against the property which was out of proportion to
other improvements in Atlantic Beach. mr. Rosborough moved
and mr. Trout seconded, that the assessment for 1938 be ad-
justed to conform to other assessments according to the
actual cost , namely 418,309.00. The motion was put and
unanimously adopted.
the Clerk was directed to prepare and sent to Mr.
Murchison a new tax statement on the above property.
upon motion of mr. Rosborough, seconded by Mr.
Cutler, the following bills were approved and ordered paid
as funds are available :

the matter of the Towns application to ft. F. C.
for the sale of the Towns 1938 bonds was raised and the
r.ayor stated that he would get a copy of the telegram
telephoned to him on or about November 15 , 1938, from the
r . P . u. , and would send a proper telegram to P. r'. C .
making inluiry regarding the further contingencies to be
complied with by the Town.
rhe matter of the printing and sale of the
Incinerator and btreet Improvement bonds was raised. Mr.
Howell called attention to the work being done by miles
ratterson, Bond Attorney, relative thereto and explained
that all matters called for by Jnr. ratterson would soon
be in his hands. The Chair by unanimous consent, direct-
ed that along with all of the necessary papers to be sent
Nir. Patterson, that a letter be addressed to him by the
Clerk stating that the Town would bear its portion of the
expense in connection with mr. Patterson . s work, provided
such portion of expense does not exceed 4100.
mr. Outler moved, and Mr. Nosborough seconded,
which motion was put and carried that the Town proceed with
the sale of the otreet Improvement bonds to Duval Engineer-
ing and Construction Company and that an ordinance fixing
the rate of interest to be borne by both the Incinerator
bonds and Dtreet improvement bonds be called up for third
and final reading.
The Clerk read ordinance No. 36 , which after read-
ing was unanimously passed on third and final reading.
ter. Trout moved the passage of ordinance No. 37 ,
providing for the closing of streets, ways and public
places , etc . , in the proposed site for the public school
in the baltair Cub-Division placed on third and final read-
ing. mr. Trout seconded the motion and the clerk read the
Ordinance which was then unanimously passed on third and
final reading.
Kr. Outler moved the passage of ordinance No. 38
governing the establishment of Erterial Highways through-
out the Town of Atlantic =3each. mr. Trout seconded the
motion and the Clerk read the ordinance , which after read-
ing, was passed on the third and final reading by a
unanimous vote.
mr. cutler moved the Passage of Ordinance No. 39,
prohibiting, subject to exception, the digging into , and
the tearing up, etc . of streets , Avenues and 'lays through-
out the Town. mr. Sugg seconded the motion. The Clerk
read the Ordinance which was then unanimously passed on
third and final reading.
pt this point, the ordinance granting to the City
of Jacksonville a r'ranchise to furnish electrical current
in the `Town of Atlantic Beach, same being ordinance No. 40,
was brought up and each and every section was carefully
considered, together with all the amendments and changes
thereto as recommended by the council sitting as a
committee of the whole on November 29, 1938. Pfter care- •
ful consideration of each item, the Ordinance was then
placed on third and final reading. Mr. Outler moved its
passage , mr. Trout seconded the motion and it was then
unanimously passed on third and final reading.

rhe uhair brought up the question of the water works.
He stated that pursuant to a call from Yr. N. H. Adams , Sr. ,
he had conferred with Mr. Adams, at which conference , Mr.
Adams set the basis for a deal on the water works as follows:
Value of the plant outside the Hotel Reservation X10,000.
Value of water and sewage rights in streets 15 ,000.
value of land between Town Hall and Roadway 4 ,000.
Value of road through Reservation, 20x1200 ft. 10,000.
To be laid for by the Town waiving all interest and
penalty interest accrued to date on the seawall Construction
account and the Town forever waiving all taxes on the Hotel
Reservation.
The matter was discussed at length after which the
chair designated Geo. H . smith and K. E. Sugg to accompany
him on a further conference with rr.r. Adams relative to the
matter. The 'Town Attorney was directed to look into the
legality of Mr. Adams ' proposal and to report his findings
back to the Council .
The matter of .)uval engineering and Construction
company ' s final bill for the furnishing of material on the
N.P.A. Project to make street improvements , which bill is in
excess of the amount of the 47000. bond issue was gone into
thoroughly. it annearing that there had been some lack of
proper action on the part of some one , it was decided to
make further investigation. rr. Sugg, Chairmen of the
rublic ;works Committee , Mr. Rosborough and u. P. Frazier,
City supervisor , were designated as a committee to confer
with cant. J. Y. Nilson to secure more definite information
concerning the liability of N.P.A . and others concerned in
reference to this matter.
Mr. Outler introduced and ordinance entitled, "An
Ordinance declaring that the "Town of Atlantic Beach
Municipal Building bonds, Issue of 1938" , the "Town of
Atlantic beach streets Improvement Bonds , Issue of 1938" ,
and the "Town of Atlantic Beach incinerator and (Iarbage
bonds , issue of 1938" , shall bear thereon the usual valida-
tion certificate. " end moved its passage on first reading.
The motion was seconded by Lr. Trout , put and unanimously
carried. same on second reading.
Mr. Outler introduced an ordinance entitled, "An
Ordinance authorizing the Lithographing of certain signa-
tures on the 'Town of Atlantic beach municipal Building
Bonds , Issue of 1938" , the "Town of Atlantic Beach
Streets Improvement Bonds , Issue of 1938" , and the "Town
of I. tlantic beach incinerator and Garbage Bonds , issue of
1938" , and moved its passage on first reading. The motion
was seconded by war. Trout , put and unanimously carried.

it was decided to keep R. E. Hill in the employ of
the 'Town as 'town `sngineer to December 15 , 1938.
upon request of u . P. ?razier, City Supervisor,Mr.
R. E. Sugg , Chairman of the ='ublic ,works Committee was ask-
ed to carefully supervise the purchase of material for the
erection of the incinerator.
