Palmer, Geo. B. Stallings, E. H. Thompson The meeting was called to order by Mr. Lawrence K. Tucker, Jr. , President. The Clerk read the minutes of the meeting of Aug. 5th and the Adjourned Meeting of Aug. 8th, which were approved as read. Adams, Jr. , tendered his resignation, which reads as follows:- Atlantic Beach, Fla. Sept. 9th, 1935 Town Council, Town of Atlantic Beach, Gentlemen:- I hereby resign my position as Building, Plumbing and Electrical Inspector. Yours truly, • (Signed) W. H. Adams, Jr., Upon motion of M, r.' Stallings, seconded by Mr. Thompson, put and carried, this resignation was accepted with appreciation of the services whichhad been rendered. Upon motion of Mr. Stallings, seconded by Mr. Thompson, put and carried, Mr. V. R. Rooney, was appointed temporarily, to the position of Building, plumbing and electrical inspector, left va- cant by Mr. AdaL.s. The Clerk read a cotnnunication from the FEC Ry. Receivers, wherein they cancelled the agreement made Jany. 17, 1927, covering grade crossing 161 in width at Second St., the reason being that they had sold their right of way between Atlantic Boulevard and 8th St. Mr. Fred Mullikin, being present at the meeting, assured the Council that the new owners would continue to keep this 2nd St. cross- ing open, whereupon the Chair requested the Clerk, to send Mr. Mullikin copy of the FEC Ry. Receivers letter in order to facilitate his work in arranging this matter. The Clerk read a letter addressed to Mr. Thompson, from J. W. Fox, Staff Assistant, Real Estate_ and Valuation of FEC Ry. , in which he stated that authority had been received from the Court to convey that part of the abandoned right of way between the north line of 7th St. and the North line of 8th St. to the Town of Atlantic Beach, for $1, 500. in cash. Thereupon the Clerk was instructed to write Mr. Fox ad- vising that this matter would be acted on at the next Regular Meeting of the Council, to be held October 7th a nd that unless word -Co the contrary was received, it would be assumed that this was agreeable. A communication from Mr. Geo. H. Smith, as Chairman of the Atlantic Beach Committee on City Planning was readby the Clerk, in which Hr. Smith statedthat the Committee had not as yet had sufficient time to draft a complete and comprehensive report, such as they desired, but that unless unforeseen difficulties arose, they would render a complete report and recommendations at the next regular meeting of the Council. Thereupon the Chair requested the Clerk to acknowledge the receipt of Mr. smith' s communication. _ A motion was made by Hr. Stallings, seconded by Mr. Thompson, put and carried, that, beginning Sept. 16th, Mr. V. R. Rooney be hired from month to month, as night watchman, at a salary of $87.50, until further. notice. A motion was made_ by Lir. Stallings, seconded by Mr. `Thompson, _ put ,and carried, that the sum of $400. be included in the budget in the General fund, for the cleaning up of vacant lots, work to be started after Christmas or in early spring, the amount required for cleaning each lot, being charged against such lot and Mayor Robert E. Sugg to supervise the work. Mr. Palmer, reported that he had obtained a Warranty Deed from W. H. Adams and wife to the property on which the Town Hall stands; that said deed had been properly recorded in the Public records of Duval County, Book No.315 - 953 - A, and that said deed was now on file in the records of the Town of Atlantic Beach. The description of the property as shown in" the deed is as follows:- A part of the Atlantic Beach Hotel Reservation in the Town of Atlantic Beach, as recorded in Plat Book 5, page 69, current public records, more particularly described as follows: Commencing at a point on the Northern Boundary line of 7th St. 166 feet East of the center of the Florida East Coast Railway Right of Way, thence run Westerly along the Northern boundary of said Sev- enth Street a distance of 91 feet to the intersection of the Eastern boundary line of the right-of-way of the Florida East Coast Railway with the Northern boundary line of said Seventh Street, thence Northerly along the Eastern boundary line of the said Florida East Coast Rail- way right-of-way a distance of 100 feet, thence Easterly and parallel with the Northern boundary line of Seventh Street, a distance of 47.5 feet, thence Southeasterly a distance of 109.4 feet, more or less, to the point of beginning. Said land being in the Southwest corner of said Atlantic Beach Hotel Reservation. A plat of Atlantic Beach Terrace consisting of 47 lots be- ing the property comprising the Former FEC Ry. Right of Way, ex- tending from Atlantic Boulevard to 7th St. and now owned by the TES Corporation was presented by Mr. Fred Mullikin and upon motion of Mr. Bradfield, seconded by Mr. Palmer, put and carried, was ap410 - proved and accepted. Mr. Palmer, Chairman of the Finance Committee, submitted the following Budget:- Police Fund $1200 . Public Works 1000. 2200. p v•v ✓.a Page # 3 Brot Fwd. t2200. Building & Improvement: 800. Books & Supplies 100. Truck- Gas & Oil 600. Salaries 600. General 1300. $5600. And recommended that the millage be set at 10 mills, which as the assessed property on the new tax roll, amounts to 5784,965.00, would produce a revenue of $7,°849.65, which would be needed , 8 mills for regular tax and 1 mills as special assessed seawall tax. A motion was made by Mr. Stallings, seconded by Mr. Thompson, put and carried, that the recommendation of Ur. Palmer, as to the Budget and � levy of 10 mills,. 8i mills for regular tax and 1- mills sess is special^sea tall tax, be approved and adopted. Upon motion of Yr. Palmer, seconded by Mr. Stallings, put and carried, the following resolution was ordered passed, accepting the preliminary Tax Assessment Hell for the year 1935; RESOLUTION APPROVING PRELIMINARY TAX ASSESSIri`ENT ROLL FOR THE YEAR 1935. WHER-EAS, The Town Tax Assessor has completed the prelimi- nary tax assessment Roll of the Town of atlantic Beach, Florida for the year 1935, and has submitted the same to the Town Council and, WHEREAS, It appears that all property, real and personal, in the Town of atlantic Beach subject to taxation has been assessed on said tax assessment roll, and the tax assessment Roll is in due form, THEREFORE BE IT RESOLVED, by the Town Council of the Town of Atlantic Beach, that the said preliminary tax assessment Roll be and the same is hereby approved. BE IT FURTHER RESOLVED, That the Town Clerk shall post at the Town Hall and at two other public places in the Town and shall also publish for four successive days, in a newspaper pub- lished in the City of Jacksonville, Duval County, Florida, notice that said assessment roll has been submitted to the Town Council and approved and also requiring all persons desiring to have corrections thereof made, whether in the listing, valuation of prop- erty or otherwise, to file with the Town Tax Assessor on or before the 7th day of October, A. D. 1935, at eight o' clock, P . M., their petition to the Town Council, setting forth their objection to said assessment and the correction that they desire made, and also that the Town Council will meet at the Town Hall in the Town of Atlantic Beach, on the 7th day of October A. D. 1935, at eight o' clock P . E. for the purpose of equalizing said asses_ments and making proper corrections therein. .Upon motion duly made, seconded and carried, it was or- dered that the Town Clerk publish the following notice four times in a Jackso4ville paper and post copies of same in ac- cordance with the Charter. NOTICE OF COMPLETION OF PRELIMINARY TAX AS:)ESSEENT ROLL OF THE TOWN OF ATLANTIC BEACH, FLORIDA, FOR THE YEAR 1935. TO ALL *HOE IT MAY CONCERN: You are herebi notified that the Preliminary Tax Assessment Roll of the Town of Atlantic Beach, Florida, for the year 1935, has been completed and submitted to and approved by the Town Council. All persons desiring to have corrections thereof made, whether in the listing, valuation of prop- , erty or otherwiseare required on or before the 7th day of October A. D. 1935, at eight o' clock, P . Report of cases to September 6, -1935. Fines and bonds forfeited 59.00 Less costs 20.00 Turned over to Town Clerk 39.00 Respectfully submitted, (Signed) J. A. Reid. A letter was received from Mrs. E. F. McCullough, in which she set forth damage done her walks, during the construction of the seawall, which had necessitated their being taken up on her homestead lot and on her adjoining property. She asked that this matter be given due consideration in order that she might re- ceive proper reparation. Thereupon, a motion was made by Mr. Bradfield, seconded by kr Palmer, put and carried that Mrs. McCulloughs walks be put back as they were, the expense to be -charged against the Contractor and that Col. Youngberg handle the natter. Mr. Harcourt Bull, having submitted a paper, wherein he proposed to relinquish his rights to all streets claimed by him in Atlantic Beach, a motion was made, seconded and carried that the Clerk mail each . Councilman a copy of this paper, for their careful consideration and that the matter be deferred until the next meeting. A motion was made by Mr. Bradfield, seconded by Mr. Palmer, rut and- carried, that the following resolution be adopted:- R E S 0 L U T I 0 WHEREAS, there will be due on October 1st, 1935, Seawall Bonds, in the sum of eight thousand ( 8,000.00) Dollars, and there will also be the interest payments on account of One hundred thousand ( 100,000.00) Dollars of bonds already delivered to the United States Government, in the sum of Two thousand ( 2,000.00) Dollars; Dollars; and, WHEREAS, although taxes have been-assessed, and also liens have been assessed against the abutting property, the same will not be past due until after October 1st, and the Town of atlantic Beach is powerless to enforce collection prior to October 1st ; and WHEREAS, the agreement with the United States Government dated June 14, 1934, provides for a grant of thirty per centum of the cost of labor and materials employed upon the project; and WHEREAS, iillEAS, under paragraph 11 of part 2 of the said agreement, it is provided that the Government will cancel bonds and all coupons in the aggregate amount equal to the amount, if any, by which thirty per centum of the cost of labor and materials exceeds the aggregate of all such grant payments, upon the furnishing of satisfactory proof to counsel for the Governmant that its govern- ing body has passed a resolution as therein provided for; Page No. 5 NOW, THEREFORE, be it resolved by the Town Council of the Town Council of the Town of Atlantic Beach, that the United States Government be and it is her by requested to cancel the Eight thousand ($8,000.00) Dollars of bonds due October 1st, 1935, and the Two thousand (,;;;2,000.00) Dollars of coupons due October 1st, i 1935, and charge the same against the grant provided for in the said agreement with the United States Government. BE IT FURTHER RESOLVED that the Town Council hereby declares and finds that the portion of the costs thereof chargeable to special assessments is not less than eighty-three (83) per cent of the principal amount of the bonds held by the Government, and there shall be no deduction of assessments, except for such assessments, if any, as may have been levied over and above said eighty-three (83) per cent of said bonds. BE IT RESOLVED that the President of the Town Council shall take up immediately with the proper officials, the request hereby made for the cancellation of said bonds and coupons, and that two certified copies of this resolution be forwarded to such officials. A letter was read by the Clerk from Mr. Fred Mullikin, in which he stated that the back sand fill on the ocean front lots North of Atlantic Beach Hotel, in the City limits of Atlantic Beach, appearsto have been completed with the exception of Lot 2, Lind South 10 ft. of Lot 1, Block 41, and that he understood from the various sand filling contractors that the owner, Adolph Roth- tan of Philadelphia, does not intend to complete his back fii 1, which creates a most hazardous and dangerous situation. Thereupon this matter was referred to Mr. Mabry the Town' s Atty. Upon motion of Mr. Palmer, seconded by Mr. Bradfield, put and carried, Mr. Thompson, Iir. Stallings and Mayor Sugg, were appointed a committee to look over the list of those claiming Homestead Exemption and report on same at next meeting. The question of the Liquor Ordinance, upon motion put, seconded and carried, was deferred until the next meeting. Mr. Osborne, Treas. submitted his usual financial state- . *lent, which was ordered filed together with a financial statement of Seawall funds, also ordered filed and a certified statement of bank balance which is in words and figures as follows.
