12-03-35 v MINUTES OF MEETING OF TOWN COUNCIL OF ATLANTIC BEACH, FLORIDA. December 3, 1235 Pursuant to due notice heretofore issued by the Town Clerk of Atlantic Beach, a meeting was called for the purpose of discussing and taking such action as may become necessary in the interest of the Town of Atlantic Beach for transportation facilities between Jackson- ville and the Beaches. The Town Attorney explained the situation of su`t being filed by the Florida Motor Lines to revoke the privilege of the Beach Bus Line now serving the Beaches with busses for pas- senger service . 11110 Upon motion duly mane and seconded it was unanimously voted by the Town Council that the Town Attorney do forthwith interplead in such suit and express the wishes of the Town as oppossed to an in- junction of the Beach Bus Line from operation. A copy of the minutes of this meeting to be duly attested and transmitted to the Town Attorney for such action as he may see fit to intercede in a legal way �o maintain the Beach Bus Line as a transportation company. Thereupon the following resolution was presented and unanimously carried. There being no further business the meeting adjourned. Town Clerk Approved Chairman. 1111 Wh AS, during the 1935 session of the Florida Legislature, the beach road, technically known as State Road No. 78 in Duval County, Florida, was opened to use by transportation companies seeking to serve our beaches, including the Town of /111 Atlantic Beach, Florida, by the adoption of Senate Bill No. 943 and house Bill No. 648; and WHEREAS, enough time has elapsed to realize the benefits which result to our beach communities when adequate transportation at reasonable rates is furnished our beaches; and WhEi AS, the passage of said laws was acconplished only Ala after strenuous efforts exercised by the officials and citizens of our various beach communities with the co-operation of our Repre- sentatives in the Legislature and our Board of County Commission- ers ; and Wh.LRLAS, our beach committee and officials and citi- zens have been very active in endeavoring to insure the growth and development of our beaches by assisting in obtaining reduced tolls on the St . Johns River Bridge for the benefit of transporta- tion companies serving our beaches ; and Whi=,RLAS, it is generally recognized that the life and growth of our beaches, as well as the convenience and welfare of • csual and permanent residents, depends primarily upon adequate transportation facilities at reasonable rates ; and WHEREAS , each of the three beach communities , includ- ing the Town of Atlantic Beech, Florida, in order to provide and secure to beach residents safe, convenient, dependable and econom- ical transportation facilities , have adopted laws and ordinances seeking to accomplish such purpose; and WHEREAS, Beach Bus Line, Inc . has posted with the City Clerk of Jacksonville Beach, Florida, its surety bond in the sum of Five Thousand (0,000.00) Dollars , guaranteeing beach residents adequate winter transportation facilities and the maintenance of an adequate schedule; and 4114 iNLEREi S, Florida Motor Lines , Inc ., a corporation, has filed suit in the Circuit Court in and for Duval County, rlorida, against Beach Bus Line, Inc . , seeking to have declared invalid and unconstitutional the said Senate Bill No. 943 and the said House Bill No. 648; and WHEREAS, the Town of Atlantic Beach, Florida, is vital- ly interested in upholding the validity and constitutionality of the said laws and has a direct and immediate interest in the said subject of said pending suit and will either gain or lose by the operation and effect of any judgment rendered therein; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN CJuNCIL OF 4001/4 ATLANTIC BEACH, FLORIDA, That the Town of Atlantic Beach, Florida, do intervene in said pending suit for the purpose of defending the validity of said laws and the Mayor and Town Clerk are hereby authorized and directed, with the advice and assistance of the Attorney for the Town of Atlantic Beach, Florida, to file such petition or other pleadings in said pending suit as in their Judgment are necessary or advisable in order• to enable the Town of Atlantic Beach, Florida, to intervene in said cause and to de- fend the validity of said laws.
