Peck, as follows:- C O M P L A I N T IN RE: SPECIAL ASSESSMENTS FOR SEAWALL BONDS. TO THE HONORABLE CITY COUNCIL OF THE TOWN OF ATLANTIC BEACH: SIRS: We, the undersigned, being residents of and owners of abutting property with reference to the proposed seawall, beg to file the following complaint: The amended contract with the United States Govern- ment, provides for the bonds to be paid in nineteen annual installments, beginning October 1, 1935. The preliminary assess- ment roll provides for twenty annual installments to be assessed against abutting property. The number of annual installments of the assessments should be made to correspond with the number of annual bond payments. We, therefore respectfully suggest and petition that your Honorable Body modify, change or alter the preliminary assessment roll so that as finally adopted, approved and confirmed, it will provide for nineteen annual installments instead of twenty annual installments. After a general discussion of the natter of special assesments against abutting property with reference to seawall bonds, the following resolution was offered by Couneilman J. M. Bradfield; WHEREAS, The Town Council has caused to be made an assessment roll showing the lots and parcels of land assessed and the amount of assessment against each lot or parcel of land and the number of annual inst allment s in which the assessment is divided with reference to seawall bonds in the sum of 4750,000., authorized to be issued pursuant to an election held on Thursday, August 31, 1933; and , WHEREAS, c complaint has been filed by Messrs Bull, Thompson and Peck, to the effect that the preliminary assocsnent roll calls for ouch assessment to be divided into twenty annual payments, while the contract with the United States Gcvern ent provides for the bonds to be payable over a period of nineteen years , and the number of assessments should be made to cor- respond with the number of annual payments on account of the bonds: and, I N0 illi WHERW.S, there were no other oomplaints of any kiss, or nature, Nov, therefore, be it resolved that the said prelim- inary assessment roll be and the sae is hereby amended, changed and modified so as to provide that the number of annual install- ments in which each assessment is divided shall be nineteen in- stead of twenty. It is hereby certified that the issue of bonds of which this is one, is made in strict conformity with the Constitution and statutes of he State of Florida, and the issuance thereof has been approved by the majority of the votes oast in an election held in said Town on the 31st day of August, 1933, in which election a majority of the free holders who were qualified electors residing in said Town participated; that the total indebtedness of the said Town, including this bond, does not exceed any Constitutional or statutory limitations; that provision has been made for the levy of an annual tax upon all of the property of the said Town sufficient to pay seventeen per centum (17%) of the interest and principal of the said bonds as the same shall become due, and special assessments have been made against abutting benefited property requiring annual payments sufficient to pay eighty-three per centum (83%) off" the interest and principal of the said bonds as the same become due, and that all acts, proceedings and things essential to the validity of this bond have happened and been performed, and all requirements of law have been fully complied with by the proper officers in the issuance of this bonds that the said Town of Atlantic Beach Florida, hereby pledges to the holder hereof it's full faith, credit and resources for the prompt payment of both principal and interest as the same become due and payable, from the sources hereinabove mentioned, to-wit, Seventeen per centum (17%) of principal and interest to be paid by general ad valorem taxes, and eighty-three per centum (83%) of principal and interest to be paid from special assessments against abutting and benefited property. Palmer, it was unanimously ordered that the President of the Town Council instruct John E. Mathews, Special Attorney for the Town, to proceed immediately to se- cure the validation of the seawall bonds proposed to be issued in the Circuit Court in and for Duval County, Florida, a nd there shall be appropriated sufficient money to defray the Court costs, advertising, and other eopenses in connection therewith. Mr. H. Warren Smithy in charge of mosquito control in Duval County, being present, described the work now being done by the FERA on this project. He pointed out that great relief could be obtained by having this work done in certain sections of Atlantic Beach. vie stated that nothing is provided except labor, no trans- portation, and that no local men could be taken on as he was compelled to use those already signed up under the FERA. He said that if the town would furnish transportation, 400 which would mean a truck for four hours a day, at 90cents an hour($3.50 per day) and a driver at 35 cents an hour being $1.40 per day, total $5.00 per day, he could have a crew start the following morning, (being June 19th) and that he felt sure that in a few days, he could furnish a driver from the FERA workers. Whereupon, a motion was made by Mr. Bradfield, seconded by Mr. Palmer, put and carried, that the Town furnish'transporta- tion until further notice and a driver for a few days.
