McArthur, Jr. Office of General Counsel 117 West Duval Street, Suite 480 Jacksonville, Florida 32202 INTERLOCAL AGREEMENT AMONG THE CITY OF JACKSONVILLE, FLORIDA AND THE CITY OF ATLANTIC BEACH, FLORIDA AND THE CITY OF JACKSONVILLE BEACH, FLORIDA AND THE CITY OF NEPTUNE BEACH, FLORIDA FOR DISTRIBUTION OF THE PROCEEDS FROM THE BETTER JACKSONVILLE 1 /2 CENT SALES SURTAX THIS INTERLOCAL AGREEMENT ( "Agreement "), made and entered into this / 'day of A 14 rok , 2000, among THE CITY OF JACKSONVILLE, FLORIDA, a consolidated municipal/county government acting as a county ( "Jacksonville "), and THE CITY OF ATLANTIC BEACH, FLORIDA, a municipal corporation in the General Services District of Jacksonville ( "Atlantic Beach "), and THE CITY OF JACKSONVILLE BEACH, FLORIDA, a municipal corporation in the General Services District of Jacksonville ( "Jacksonville Beach "), and THE CITY OF NEPTUNE BEACH, FLORIDA, a municipal corporation in the General Services District of Jacksonville ( "Neptune Beach "). IN CONSIDERATION of the mutual covenants contained herein and for other good and valuable consideration, the legal sufficiency of which is admitted to and agreed upon by the parties, the parties agree that: 1. In the event of electorate approval, Jacksonville shall levy and collect The Better Jacksonville 1 /2 Cent Sales Surtax, a one -half cent sales surtax on all transactions, in the General Services District, that are subject to the state sales tax imposed in Chapter 212, Florida Statutes, and subject to limitations contained therein. Proceeds from The Better Jacksonville 1/2 Cent Sales Surtax will be used to fund The Better Jacksonville Plan that includes projects specified in Jacksonville -1- Ordinance Code, Section 761.102. Those projects will benefit all residents in the General Services District, including Atlantic Beach, Jacksonville Beach and Neptune Beach, with respect to growth management, road improvements and construction, environmental protection and preservation, and public facilities. 2. The cities of Atlantic Beach, Jacksonville Beach and Neptune Beach, pursuant to Section 212.055(2)(c), Florida Statutes, are entitled to a distribution of The Better Jacksonville 1 /2 Cent Sales Surtax proceeds, during the existence of said surtax, either by interlocal agreement or by statutory formula. Because The Better Jacksonville Plan will at least partially benefit the residents of Atlantic Beach, Jacksonville Beach and Neptune Beach, the cities of Atlantic Beach, Jacksonville Beach and Neptune Beach hereby agree that the distribution of The Better Jacksonville 1 /2 Cent Sales Surtax proceeds, to each of those respective municipalities, shall be equal to the following distribution formula: City of Jacksonville 96.88% City of Jacksonville Beach 1.50% City of Atlantic Beach .97% City of Neptune Beach 0.54% Town of Baldwin 0.11% This distribution to Atlantic Beach, Jacksonville Beach and Neptune Beach shall be used for like purposes as are more particularly described in Sections 761.102 and 761.106(b), Jacksonville Ordinance Code, as enacted by Jacksonville Ordinance 2000 - 572 -E, or as allowed by law. 3. This Agreement is contingent upon both of the following events: (i) Jacksonville Ordinance 2000 -572 becoming effective; and (ii) the electorate in the General Services District, of Jacksonville, approving the levy of The Better Jacksonville 1 /2 Cent Sales Surtax. Upon the -2- happening of both such events, this Agreement shall become effective on January 1, 2001, and shall remain in effect until December 31, 2030, or until The Better Jacksonville i Cent Sales Surtax is otherwise terminated, pursuant to Jacksonville Ordinance Code, Section 761.106(d), whichever occurs first. Furthermore, as to Jacksonville, the Mayor's authority to execute this Agreement is contingent upon City Council approval ofJacksonville Ordinance 2000 -572. 4. Upon execution of this Agreement and a referendum approving The Better Jacksonville Z Cent Sales Surtax, Jacksonville shall notify the Florida Department of Revenue of this Agreement, pursuant to statutory timelines when Jacksonville must notify said Department of such referendum approval. 5. Prior to its effectiveness, this Agreement shall be filed with the Clerk of the Circuit Court, in and for Duval County, Florida, by the Office of General Counsel of the City ofJacksonville, as required by Section 163.01(11), Florida Statutes. 6. This Agreement represents the entire agreement among the parties hereto for the distribution of funds under Section 212.055(2)(c), Florida Statutes. No statement, representation, writing, or agreement made by any party or any party's representative, which are not expressed herein shall be binding. Any changes, amendments or revisions to this Agreement shall be binding only if made in writing and signed by the parties by their respective authorized representatives.
