At that time the decision was to re-address the matter after six months to determine if a permanent road should be constructed. During the interval it has been determined that CDBG funds can be used to construct a permanent road, but the funds allocated for that purpose must be expended prior to September 30th. A design has been completed and contractors have been contacted to provide prices for the work as well as timeframea for completion. Completion oY this road should be accomplished and can be paid for using CDBG funds if authorization ie granted no inter than August 22nd. RECOMMENDATION: If it is the desire of the City Commission to open this road permanently, it is still possible to do ao using CDBG funds. If this project ie authorized we also request that the bid process be waived due to the emergency time situation. IY authorized we will contract with the contractor who provides the lowest quote within our time constraints. The coat of this work was not available at the Lime of this writing, but will be provided to you at the meeting of the 22nd ur before if possible. Resident: I was told by the Building Department todsy that we would have to pay the fees - the tap in fees and the impact fees; whether or not you wanted to use it; they couldn't force you to use the system, but you would still have to pay the fees. Mayor: You are not going to have to pay impact fees, monthly rates or anything if you are not hooked to the water or sewer system. You will have to pay the assessment if all of this goes through. Resident: So as the law stands right now I will not be forced to tie into the system. Mayor: As far as we're concerned you will not; that is one of the reasons we have not pledged revenues from water and sewer to fund the bond issue. That is why we have taken other sources so that we're trying to keep total local control of this without dragging in Tallahassee and Washington. Now, Z will tell you this, when the City of Atlantic Beach put in the sewer system in the main area of the town which xas done in 1959, everybody here had septic tanks. We did not force anyone to hook up to it. 98$ of the people hooked up because they know that septic tanks are just not healthy, but we did not force anyone to hook up. The costs of the City sewage system, and the under utilized capacity are presemly borne alone by those residems who are connected to the City system. Over the years since the original sewage system was installed this has represented a sigrrificarrt revenue loss to the City of Atlamic Beach. At an average momhly sewer bill of 535.00 this removes ova S t 10,000.00 annually from City mrnue. That pa annum, realistically, dates back to 1988 or 1989. There is the further diminishment of initially projected cost recovery for the Coy system in the uncollected impact fees assoriared with the remaining OSDS. A o~-time recovery of well ova 5325,000.00 exists if all statutory connections are accomplished. In summary, there are adequate reasons to require use of the available City sewn systan in Atlantic Beach. These are Florida S[annes and Florida Code that require it. These are compelling health and water resource reasons to hook up to a well maimained, regulated and sani[ary municipal sewn system. Atkunic Beach code, that dates back well ova a decade, is wmpletly unambiguous about the requirement for thou who can to hook up, and the penalties for [hou who will not connect, to the Ciry system. The advantages of a toilet and sink that work ands the heaviest loads, wet weather or no, and with minimal chance of becoming a diseau vector should be readily apparem. Weiss Date: August 17, 1994 There are approximately 270 Onsite Sewage Disposal Systems (OSDS), or "septic tanks" in the City of Atlantic Beach that could be connected to the City sewage system. The majority of these are clustered in two areas, Ocean Grove and Section H. There are another approximately 70 OSDS, mainly along Seminole Road and Beach Avenue above Sixteemh Street that are not along City sewer lines. These will not be considered umil the City provides the necessary sewer lines. The State of Florida coumed about 1.6 million OSDS in the 1990 cenws. About 40.000 new systems are added each year. Approximately 25% of Florida's population is served by OSDS. Consider this with State drinking water sources. Groundwater provides about 87% of public wazer, and about 94% of privaze wazer_ If an OSDS is constructed properly and maimainal wdl it does not invade this shallow source of potable water. Five considerations for any OSDS which will help preserve water resources: Clear and specific performance standards for an OSDS, Techrtical guidelines for site evaluation, desig4 construction and operation, Perpetual perfonrwtce monitoring, Licensing of all service providers, ElTective enforcement mechanisms. An OSDS has two basic components: The tank itself, properly sized, A Subsurface Wariewater Infiltration Syriem (SWIS), or "drainfidd". The tank provides primary treatment by allowing solids to settle, geese to float, and anaerobic digeriion to occur. The City shall set aside f500 in the above designated account as an emergency fund to be used at the discretion of the City Commission should there be a shortfall during the contract period. 5. The City shall maintain the Community Theater facilities in good condition. No modifications to the building structure or the Grounds shall be permitted without the specific authorization of the City Commission. Any authorised modifications shall become and remain the exclusive propert7 of the City. right to exercise its authority to maintain and preserve the public health, peace and welfare, and Lo prevent and abate nuisances, as provided by its Charter, if the need arises. The Parks and Recreation Staff shall coordinate the scheduling of all events. Funding for the initial renovation shall be provided by the Atlantic Beach Experimental Theater production group. All proposed renovations to the building shall maintain the character and appearance of the original building. All renovations and improvements to the building or grounds shall become and remain the exclusive property of the City of Atlantic Beach. SECTION 2. The City of Atlantic Beach may, through contractual arrangement, permit the production and presentation of theatrical entertainment in the Atlantic Beach Community Theater. Such contractual arrangement shall specify the time period covered by the contract, the number of events to be scheduled, improvements proposed to be made to the building, and monetary reimbursement to the production company or companies. Tl,e City shall set the cost of, and collect and retain all proceeds of, ticket sales. Funds collected shall be placed in a designated account. The City may designate a portion of the funds collected to defray Lhe costs of cleaning, maintenance and improvements to the Adele Grage Community Center. Reimbursement of production companies shall be from this account. SECTION 3. Annually, or at such other interval as deemed appropriate by the City Commission, the City may solicit bids from production companies to produce theatrical events at the Community Theater. Companies desiring to bid may be either for-profit or not-for-profit corporations. Companies desiring to bid may be required to pre-qualify in a manner established by the City Commission. The production company shall be responsible for the selection of plays or theatrical events, recruiting actors, musicians, etc., construction of props, and advertising of events. Any and all advertisement shall bear the words "Atlantic Beach Community Theater" prominently upon its face. Section 4. Authorize solicitation of bids for solid waste service Bob Rosoy, Public W'o rks Director, reported that a Committee had been appointed comprised of Commissioners Steve Rosenbloom and Bob Weiss and Bob Rosoy to study the matter of privatization of solid waste. The Committee decided that staff should look at options and, if necessary, draft specifications so that the City could advertise for bids. It was agreed that the current level of service would be required for residential and commercial pickups. Mr. Xosoy reported the Committee emphasized that the specifications include provisions for the purchase of existing equipment and hiring of current full time personnel at their current rates of pay. It was estimated that 5100,000 per year could be saved by privatization, largely due to savings In equipment Uurchases. Mr. hosoy indicated Che purchase of equipment made it difficult for the City to compete with private enterprise. He felt the proposed lanquage substantially changed [he ordinance, however, and thus it would be necessary for the ordinance to come back on the floor for first and second readings. He explained tl~e Commission could place further controls on special events, if it desired, through the permitting procedure. Commissioner Weiss agreed with Commissioner Rosenbloom that the powe[' to grant permits should be given to the City Manager, and taken away from the Commission. Notion: Adopt ordinance No. 10-99-18 Kim Leinbach, City- Manager, was asked to comment concerning the matter, and he explained while he would do tis best to carry out the wishes of the Commission in granting permits, it was difficult for him to know exactly what the Commission wished to allow. He reminded the Commission there were many permits he already granted, but without alcoholic beverages. He indicated he would like to have guidance, such as hours, etc. A discussion ensued relative to what constituted a "special event" under the terms of the ordinance, to which Alan Jensen explained a "special event" could be determined by the Commission. He added the Commission would have to use discretion to determine whether an event would be determined a "special event" on a case by case basis, and he advised the Commission not to list specific events because the Commission would lose their discretion. Mayor Pro-Tem Waters suggested deferring the Ordinance until the next meeting. After discussion, it was decided to vote on the ordinance, as amended. A further amendment was suggested that would provide that the ordinance expire at sunset on December 31, 1999, with the intent that the ordinance would be rewritten at a later time if needed. Reconsider Ordinance No. 10-99-18 AN ORDINANCE OP THE CITY OF ATLANTIC BEACH, FLORIDA AMENDING SEC. 3-11 OF THE CODE OF ORDINANCES TO ALLOW CONSUMPTION OP ALCOHOLIC BEVERAGES ON PDBLZC PROPERTY WITH PERMISSION FROM THE CITY COMMISSION, AND PROVIDING AN EFFECTIVE DATE_ Commissioner Rosenbloom explained that originally he voted against Ordinance i0-94-18. He indicated he vas opposed to the Commission having [o Pass judgement on whether or not a special event should be granted the opportunity to serve beer and vine on public property. He felt this should be the decision of the City Manager, only, and should not be brought before the Commission. He indicated the City of Jacksonville Beach alloyed consumption of beer and vine for special events in a contained section, only, and consumption vas not alloyed outside of the contained section. He referred to the Community Center and indicated he had received several telephone calls that sere in favor of consumption of alcoholic beverages in the Community Center, and he felt the Police Department needed direction yh ich yould be indicated in the proposed ordinance. SERVICES TO HE PERFORMED DY THE CONTRACTOR - RECYCLING The Contractor shall collect all nerepaper, magazines, glass, aluminum and metal cane, plastic, corrugated cardboard, etc.... set out for the purpose of recycling from all single family homes, multi-family unlte of three (3) or less units under common ownership rithin the City limits of Atlantic Beach. The collection of recyclables shall be conductetl through a co-mingled system. As it becomee epproprlete or beneficial, other items may 6e added to the list at the directf on of the City Manager or his designee. Frequency of collection - The Contractor shall collect recyclables from aforesaid customers within the service area at least on (1) time per week. The day of collection shell be on the same day as one of the collection days for solid waste. Receptacles - The Contractor shall pick up all recyclables rhich have been properly prepared for collection entl placed in recycling containers furnished by the City and set at curbside. Monitoring records - The Contractor shall 6e responsible for maintaining information and records adequate to determine participation rates and weekly setout rates by refight. The Contractor may be requested to provide other inf ormetion as required by City or the State of Florida necessary to meet the requirements of the Florida Department of Environmental Protection or to obtain grant funds Erom the State of Florida. The Contractor shall iurnish monthly reports to the City by the 10th of the iolloring month containing the requested information. The Contractor shall transport the collected recyclable material to the Duval County processing center. The Contractor shall take possession of the recyclable materials upon pick up from ell customers and shall be responsible for the delivery of such recyclable materials to the designated recycling facility. Equipment - The Contractor shall have on hand at all times and in good corking order such equipment as shall permit the Contractor to adequately end efficiently perform ire contractual dutlee for recycling. Promotion of the recycling prograe - Promotion and education of Atlantic Beach citizens about recycling is critical to the success of the recycling program. The successful bidder shall assist the City rith advertising oS the recycled program. RECYCLING AND YARD TRASH COLLECTION EQUIPMENT CITY EQUIPMENT - The Contractor shell purchase title from the City of Atlantic Neach for the various rolling stock and other items detailed on Attachment A of the Instructions to Bidders. The total purchase price shall be shorn in Item_of the Bid Forms. The Contractor shall have on hand et all times and in good corking order such equipment as shall permit the Contractor to adequately and efficiently perform its contractual duties. If additional equipment is necessary, equipment shall be obtained from nationally known and recognized manufacturers of garbage collection and disposal equipment. All replacement and additional vehicles shall be ner equipment unless otherrise agreed to by the City. All equipment shell be kept in good repair, appearance, and in a sanitary and clean condition at all times. The Contractor shall have available reserve equipment used by the Contractor to perform the contractual duties. A list of equipment proposed to De used to meet the requirements of this bid shall 6e attached to the bid. Equipment is to 6e painted uniformly rith the name of the Contractor, business telephone number and the number of vehicles in letters not less than four (41 inches high on each side of the vehicle. All vehicles shall be numbered and a record kept of the vehicle to which each number is assigned. No advertising shall be permitted on vehicles, except events sponsored by the City. COMMERCIAL CONTAINERS The Contractor rill be required to furnish the proper size container for collection by the Contractor. The Contractor rill be responsible for repair, maintenance or replacement of the container. Containers shall he sprayed and disinfected periodically. The successful Contractor shall oifer to buy the existing privately orned dumpster at a fair and reasonable price. Page 1: July 25, 1994 Kim Leinbach, City Manager, reported he had received a letter from the Beaches Soccer Association promoting the First Coast Labor Day Shootout Tournament, and asking for support from the City (letter attached hereto and made a part herewith). Kim Leinbach reported the City's Employee Assistance Program had been rebid and it was felt money would be saved. Kim Leinbach reported Carl Walker had secured a grant to plant trees, and Mr. Walker was congratulated by the Commission. Kim Leinbach suggested having a goal setting session as soon as convenient, and he suggested prioritizing goals so that this could be incorporated into the budget. Commissioner Weiss complained that some city ordinances and laws were being ignored. Commissioner Shaughnessy congratulated Carl Walker regarding the tree grant. She agreed that a goal setting session should be held as soon as possible, and she asked the City Manager to set a meeting. Commissioner Rosenbloom asked the Commission to consider having cne meeting, only, during the months of .7uly and P.ugust_ He explained this was the time that most people took vacations and it was a problem having everyone attend two meetings during peak vacation months. Commissioner Rosenbloom felt it would be beneficial if he attended workshops on subjects such as revitsiizaticn of downtown, zoning, etc., instead of attending the Florida League of Cities Conference in Orlando. After discussion, the Commission concurred and Commissioner Rosenbloom was asked to coordinate arrangements through City Clprrk Maureen King. Maureen King, City Clerk, reported voter registration books would close August 9, 1994 as there would be a First Primaty Election September 8, 1994. Mayor Pro-Tem Maters inquired regarding the status of the Russell Park building. Kim Leinbach reported staff had met with Actech Architects, final specifications were being prepared, and bids would be sent out soon. Authorize entering into negotiations for the purchase of Tresca property Commissioner Weiss reported the Tresca property matter will be on the agenda at the August 22, 1994, and he asked that funding be identified. Authorize funding to purchase property located at Donner Road and Francis Avenue Kim Leinbach, City Manager, reported a lien of S2, 500 existed against the property located at 1598 Francis Avenue. If the lien was satisfied, Mr. Leinbach added, the city would be able to buy the property which could then be sold to the Donner Community Development Corporation who proposed to develop the property into four single family homes. The Donner Community Development Corporation was supportive of this. Mr. Leinbach recommended authorizing the expenditure of S2, 500 out of the Commission Contingency Fund, to be reimbursed from Community Development Block Grant funds in the next fiscal year. Motion: Authorize expenditure of $2,500 from Commission Contingency Fund for the purchase of property located at 1598 Francis Avenue No discussion before the vote. The motion carried unanimously. 7. City Manacer Reports and/or Correspondence: a. Report relative to Park Street drainage project Bob Kosoy reported work was two weeks ahead of schedule and less than 513,000 had been expended. He indicated it was expected work would finish ahead of schedule and within budget. Mr. Kosoy commended the Public Works Staff for their excellent work. b. Mayor Pro-Tem Waters deferred the matter to the City Manager and the City Attorney and suggested a meeting be arranged between the City Commission and the Tree Board. Discussion and related action relative to construction of handicap ramp at 12th Street Ccmmissioner Weiss indicated the Departmental of Natural Resource (DNR) permit would expire on August 2, 1999, but he felt the DNR would be willing to extend the permit. Re indicated material to build the handicapped ramp would cost approximately 52,000 and he suggested that the city buy the material and that the ramp be constructed by volunteer labor, under the supervision of the city. Commissioner Rosenbloom felt that other municipalities who have successfully built ramps that have endured weather conditions should be contacted for their input, prior to the city building a ramp. He did not want to build a ramp that would not be adequate. Mayor Pro-Tem Waters felt that since there was a ramp on 11th Street a new ramp should not be built one block away, on 12th Street. He suggested a new ramp could be placed off Atlantic Boulevard, at 15th Street, or 19th Street. It was decided that the City Manager would research the matter and report back to the Commission. c_ Accept sewer lines on Ahern Street, 9th Street, Seminole Road and Ocean Grove Drive for city ownership and maintenance Bob Kosoy reported the final inspection of the Sanitary Sewer Rehab Project for the Ocean Grove Drive portion was conducted on May 25, 1993 and the final documentation had been completed by Smith fi Gillespie and was in order. Discussion relative to possible amendment of tree protection ordinance Commissioner Weiss read a letter from Mae Thompson Jones, a member of the Tree Conservation Board, concerning an appeal by N. Hugh Mathews of a decision of the Tree Board (letter dated July 20, 1994 attached herewith and made a part hereof )_ Commissioner Weiss suggested having a workshop session between the Tree Board, property rights activists, and members of the Commission. He suggested discussing the existing ordinance and whether or not the city needs a tree ordinance. Hope Van Nortwick referred to the appeal process of N_ Hugh Mathews on July 13, 1999. She indicated Mr. Mathews appeared before the Commission under the "recognition of visitors" portion of the meeting, and members of the Tree Board were not notified. She indicated the Tree Board would have liked to have had the same opportunity as Mr. Mathews to present their case to the commission. She explained with reference to trees that were removed, the intent of the Tree Board was to give back to the Community that which was taken away. She indicated there had been three meetings scheduled with the Commission but all had been canceled and she indiCat~d the Board would like to revisit the tree ordinance. A discussion ensued relative to the legality of mitigation and Alan Jensen advised recently the Supreme Court held that it was unconstitutional to require the applicant of a permit to make a certain donation to a city. He felt the Board should continue to operate as it had under the existing ordinance. He indicated if an appeal came before the commission, the members of the Tree Board could answer and respond to questions, but he felt in considering an appeal of a decision of any board, NAME OP COMhtH.+. Commissioner Weiss indicated he had recently attended a function in the downtown area and beer and wine were served without any problems. Kim i.einbach reported he had contacted the city's insurance carrier and was advised premiums would not be affected by having beer and wine served at functions. David Thompson, Chief of Police, indicated the passage of the ordinance would allow the Police Department to permit certain functions to operate. Mayor Pro-Tem Waters explained under the proposed ordinance permission to hold functions would appear on the agenda for Commission action. During discussion, it was felt the true intent of the ordinance was to bring "Dancing in the Streets" into compliance with city ordinances. He expressed concern that the city would have to assist with renovations, but that the renovations would benefit ABET, only, and not other groups, should ABET move from the facility. It was felt that the matter should be deferred until the meeting of August 22, 1994 when the full commission would be in attendance. H i e ndicated he would like it understood the facility was operated by the city of Atlantic Beach who contracted with theatrical groups. He felt the commission and staff were involved in other city matters and should not be involved in running the Community C enter by having to collect money, count money, make judgements on who would use the facility and other , matters. He felt another bureaucracy would b e created if the city became involved in the operation of the facility. Commissioner Weiss explained the idea of the resolution was not to create another bureaucracy and not to pass judgement on who utilized the facility ~ but to , standardize the use of the facility, He indicated he would like to have terms spelled out more clearly than in the current agreement. He felt tennis courts and baseball parks should b t e reated in a similar manner. Commiasioner Rosenbloom proposed that a comprehensive , contractual arrangement be adopted for everyone who used city facilities. He felt, however, that sane time should be allowed~so that ABET could complete renovatio ns. He felt that it was not a good time to make a change in policy. William~Gulliford felt ABET was of benefit to the entire Community, and he suggested giving the agreement that was current in place an opportunity to work.
