The Order is dated March 15, 1994, and becomes effective thirty
days thereafter. Payment of the civil penalty must be paid within
thirty days of the effective date of the Order. I would suggest
that payment be nailed no later than May 10, 1994. They have
requested a certified check or cashier's check, payable to
"Treasurer, United States of America." Assuming the Coaission
approves payment of this penalty, please have the check made out
accordingly and delivered to me so that i can forward it to the EPA
in Atlanta as required.

Dear Kim:
Today i received a copy of the signed Decision and Order of the
Regional Administrator regarding the above case and a copy is
enclosed herewith. The bottom line is that a civil penalty in the
amount of $17,000.00 has been assessed for failure to continuously
monitor pH at the Atlantic Beach Fiastevater Treatment Plant.
You will recall that more than a year ago we travelled to Atlanta
and met with certain individuals at EPA and shortly thereafter they
wanted to proceed with a $20,000 fine. The matter was submitted to
a hearing officer and, after he considered all of the relevant
factors, including all of the arguments and information I presented
on behalf of the City, it was determined that a $17,000 fine vas in
order. The two main reasons, as I read the Order, for the fine are
first as a deterrent and second, on a couple of occasions when the
pH monitoring system was damaged by lightning, the City waited
nearly thirty days before sending the equipment off to be repaired.
They also indicated that we should not be involved in proprietary
equipment because of the requirements of our permit and the
possibility of EPA sanctions.
You will further note from reading the Order that the attorneys for
EPA in Atlanta wanted a fine of at least $45,000. Based upon all
the circumstances and the potential the City faced for substantial
fines, I do not believe the $17,000 is excessive. I had hoped it
would be less than that or, as we had proposed, that they would let
us put any fine money into repairs or improvements to the system,
but they have chosen not to do so.
we can file an appeal to the federal district court here in
Jacksonville, which would probably take a couple of years and which
would probably not, in my opinion, result in any benefit to the
City. There would also be the cost to the City for such an appeal,
including my time.

BACKGROUND: In August 1992, the United States
Environmental Protection Agency (US EPA1
Region IV in Atlanta, Georgia notified the
City that ve rare in violation of
continuous monitoring requirements for the
plant. Initially, TSm Torneend responded
and advised the EPA that the problem vas
due to lightning strikes. On December 10,
1992 the EPA issued an Administrative
Order 93-030 and the City Attorney
requested a meeting rith the EPA.
On lanuery 19, 1993 the City Manager, City
Attorney and Tim Torneend traveled to
Atlanta to meet rith the EPA. The EPA
requested additional documentation to
verify the City's eEEorte at making the
necessary repairs and the City forrarded
these document e. In April 1993 the City
Attorney roe advised by the EPA that ve
could 6e fined 520,000.00. The City
Attorney rrote tc object to this and on
June e, 1993 re received correspondence
from the EPA that the Administrative Order
issued on December 10, 1992 had been
placed in an inactive status and re

BACKGROUND:
The Police Department is experiencing problems with the computer terminal for
the FCIC/NCIC systems. This compute[ terminal at the Police Uepaztment allows
officers to communicate with other departments, receive critical information
from State and/or Federal authorities, determine whether or not property is
stolen, check on warrants and criminal histories for suspects, conduct drivers
license checks, and provide missing person intormation for other agenr_ies to
utilize. This information link is vital to law enforcement operations.
The existing terminal and printer are approximately 14 years old, and they are
not compatible with [he software trtat has Rreen upgraded in Tallahassee. T'he
buffer on the printer will not accomodate the information flow, and the monitor
scrolls too quickly Co read the information provided by the ^ai of rame. As a
result of these two problems, our communications operators and police officers
are not receiving or capturing important information sent from the mainframe.
Several years ago, terminals were basically given to the departments where they
were housed, and the departments had to absorb any main tenance and upkeep. The
equipment was getting old, and F.D.L.E. did not have the funding to maintain
them. Although upgrades have been made on the software in Tallahassee, the
terminal is obsolete and in need of replacement.
Tne information that we are losing critically important for the safety of our
officers and for the community at large, and it would not be practical to wait
until next fiscal year to purcl,a se replacement equipment. Ne had no way to
anticipate that the existing problems were about to surface or that the
equipment would have to be replaced this year.
Account 1630 in the police department is where contraband forfeiture and
training funds are located. I suggest that we transfer sufficient soney from
•610-3500 linvestigations) to 1610-6400 to purchase the terminal, printer, and
maintenance agreements including installation. This recommendation reyuires
commission approval to assure compliance with state law regarding the
expenditure of this funding.
The replacement equipment will be a PC Morkstation that will serve our needs and
accomodate the F.C.I.C. upgrades fur years into the future. if we simply
replaced the terminal, it would be obsolete in 1995 when PCs will be required.
The anticipated costs for purchase, installation, printer, and maintenance
contract are expected to be less Chan 52,764 Ithe state contract pricey would be
52,764, but I believe that we can beat that pricer

RE: Land Acquisition and usage in Section "H".
The City currently owns two parcels of property in Lhe
south end of Section "H". One of these parcels (A) is made up
of Blocks 5 through 9 and extends between Atlantic Boulevard and
West 1st Street. The second parcel (B) is made up of Blocks 90,
97 and 9B and occupies an area north of Nest 1st Street between
Begonia Street and Jasmine Street.
Parcel (A) measures 320 feet by 317.5 feet, or 2.33 acres.
This parcel is more amenable to development and use by Lhe city
than the second parcel because of its location and shape. The
parcel is uplantl except for a small portion of the south west
corner. The parcel has a considerable tree cover, but, if
partially cleared, would otherwise be usable for a soccer or
multipurpose playing field. An example layout sketch is
attached. Because of the size of this parcel and the dense
vegetation, clearing will be expensive.
Parcel (B) is approximately "P" shaped in that the northern
one half is 204 feet wide, while the southern half is 102 feet
witle. The total parcel is 2.25 acres, but approximately one
half is occupied by a retention pond. This parcel is bounded on
the south east side by privately owned lots which may be
available for purchase. Acquisition of those lots would give
the city a 204 foot by 370 foot rectangular parcel, occupying
1.7 acres, bounded by paved streets on the east and south sides,
an unpaved right-of-way on the west side, and the retention pond
on the north.
West of both city owned parcels are several blocks of
privately owned land, some of which is upland and some wetland.
A71 of this land is owned by two persons. One person owns one
block, 102 feet by 320 feet, or .75 acres, and the other person
owns the remaining land which amounts to approximately B.3
acres, out to Lhe city limit line (ownership may extend into the
Intracoastal waterway and may include additional upland in Lhe
form of island). Approximately 1/3 of Lhe 8.3 acres is
wetlands, approximately 1/3 may or may not be wetlands, and the
remain 1/3 is upland.

The engineering fee for Options No. 3 or 4 would be approximately $5,000.00, which
includes additional work in preparing a wetlands permit package, and special design
considerations. This does not include additional soils investigations which may be
required.
When we obtain data such as earlier design Plans, structural and drainage
calculations and soils information for the retaining wall -end the retentior. basin, we
can determine the construction option will be the most cost-effective and durable.
This will be fully explored in a Preliminary Design Report in the form of a letter to
be submitted within 3 days following receipt of the required information. If this
information can not be provided, then add~ional engineering fees will be required
to supplement the data with new investigations, such as soil borings, hydrology and
hydraulic calculations, and further examination of the existing retaining wall.
We do not anticipate obtaining a new SJRWMD permit with Option 1 or 2, but the
existing permit may need to be modified. We will conduct a meeting with SJRWMD
personnel to determine their requirements. We will keep your staff fully informed
of the progress, and provide preliminary plans and specifications for review.
In evaluating the design required for this project, we feel that Professional Liability
Insurance may not be needed since this is basically a maintenance project. As
individuals, this type of insurance is difficult and expensive to obtain, and we are
currently exploring our options. We hope this will not be an insurmountable
problem. If you have any questions concerning our proposal, or wish additional
information, please call either team member at any time.

placed along the outlet channel to protect the earth embankments from future
erosion. The flap-gate needs to be replaced with a new aluminum frame, aluminum
sheet, stainless steel hardware, and oil skimmer.
Based on preliminary analysis, the approximate construction cost could be between
$20,000 and $25,000. At this time we do not recommend this option due to
infringement onto possible wetlands. This will be better determined with the
additional information requested.
OPTION 4 -REPLACEMENT WITH STEEL SHEET PILING
As in Option 3 above, a possible solution is to abandon the existing concrete wall and
rebuild a new outfall structure. This could be accomplished with steel sheet pilings,
driven to a depth as required for stability, and a notch cut and weir structure
wnstructed to approximate the existing 8 foot wide broad-crested weir in the
concrete wall.
Some of the problems with this solution are that the site has difficult access for the
large equipment required to drive the piles, and existing soils data possibly does not
contain sufficient information for the design of the piles. At this time we do not
recommend this option as potentially being too mostly to construct. This will be
better determined with the additional information requested.
ENGINEERING SERVICES
Based on our Preliminary investigations and analysis, the design fee for Options 1
or 2 above should be approximately the same. Fnr preparation of a Preliminary
Design Report, final design, analysis, site survey, plan and specification
preparation and submission of construction plans and specifications, the engineering
fee will be $3,500.00. The complete plans and specifications will be submitted within
three weeks from the date of authorization, and receipt of the additional information
required-

OPTION 2 -EXTEND THE CONCRETE RETAINING WALL
Due to the swirling action of the tidal water on the downstream face of the retaining
wall resulting from a heavy discharge from the pond, more substantial erasion
control is needed. This can be achieved by extending the concrete retaining wall
with wing-walls into the side earth embankments. As shown on the attached
drawing, the design would consist of approximately 35 foot extension on the south
side and a 20 foot extension on the north side. These would be structurally
connected to the existing wall, reinforcing-the strength of the wall, and providing
more solid material against which the swirly~g actions of the tide and discharge can
act.
As noted in Option t, stone rip-rap should be placed along the outlet channel to
protect the earth embankments from future erosion. The hardware on the flap-gate
needs to be replaced with stainless steel, and the wooden portions of the outfall
structure should be replaced.
The approximate construction cost for option 2 could be between E12, 000 and
$15,000. This will be better determined with the additional information requested.
OPTION 3 -COMPLETE REPLACEMENT WITH NEW CONCRETE RETAINING WALL
The existing retaining wall is at a location on the outfall channel which causes
swirling of the tidal waters due to discharge from the pond. A solution would be to
move the outfall structure more to the west, toward the Intro-Coastal Waterway.
However, there could be apparent wetlands infringement, which will require
preparation of wetlands permit application. This may also require mitigation of
wetlands, and development of special construction wnsiderations to be met.
A total of 65 to 75 feet of concrete retaining wall would be required to extend erosion
protection into the side banks. The weir configuration would be duplicated from the
existing watt. Again, as recommended in Options 1 and 2, stone rip-rap should be

RECOMMENDATIONS FOR ENGINEERING DESIGN
Several options can be explored to provide a more stable outfall structure for the
retention pond. These will be more fully explored with additional information which
we requested, such as data from earlier design Flans, hydraulic and structural
calculations and soils information. The object of the proposed improvements is to
restore the retaining function of the retention pond. Therefore, no examination will
be made of the contributing drainage flows, other than its effect on the retaining
wall.
OPTION 1 -REBUILD THE CONCRETE-BAG RIP-RAP SIDEWALLS
An inexpensive solution would be to rebuild the sidewalls on each side of the
concrete retaining wall. Since the wall is less than 6 years old, there should be little
deterioration of the concrete or reinforcing steel. Therefore, by reconstructing the
sidewalls with new concrete filled bags, properly doweled together with reinforcing
pinnino between bags, the intergrity of the retention pond could be restored. This
method does not reinforce the existing concrete wall itself, and additional measures
may be required to stabilize the wall, such as provision of stone rip-rap on both
sides of the wall.

embankments from future erosion. The hardware on the flap-gate needs to be
replaced with stainless steel, and the wooden portions of the outfall structure should
be replaced.
The approximate construction cost could be between $8,000 and 575,000, depending
on the measures required to stabilize the concrete wall. This will be better
determined with the additional information requested.

Services to design improvements to the Retaining Wall and Outtall Structure at the
Jasmine Street Retention Basin. We have examined the site and have observed the
damage. The recent storm and tidal surge which caused awash-out of the side
banks to the original structure may occur again, and we agree as to the urgency to
effect repairs to this retaining wall and outfall structure as soon as possible.
This proposal is made by two individuals with over 26 years each of engineering
experience - Prudencio G. Tuazon, P.E., Civil-Structural Engineer, and James G.
Jacques, Senior Designer -who will provide competent and qualified engineering
design services. The combined experience of the project team gives unique abilities
to assess the situation, and apply sound engineering design and judgment to deliver
a cost-effective and lasting solution to this problem. We believe the attached
Statement of Qualifications will indicate our experience in similar projects.

telephone calls, printing and reprodumion coats, and spacial supplies and materials.
SCHIDULE FDR PAYMENT
Invoices will be submitted monthly based upon the work wmpkte at that time. Payment will be due
upon receipt of invoices. If payment is not reuived within 30 days from tbe date of the
invoice,interest will be charged at the a tale of 1-12 percent per month on the unpaid balance
retroactive to the inwiu date, and ConneOy & Wicker Inc may, without waiving arty claim or right
against Client and without liability whatsoever to Client, terminate the performance o[ the service.
Retainers shall be credited on the final imroice. In the event arty portion or all of an account remains
unpaid 90 days after billing, giont shall pay all vests of wllection, including reasonable attorney's

Ve have been requested by your staff to provide a priced proposal for Engineering
Services associated with the repair of a detention facility. Ve must decline,
as [his appears to put us in the pos i~ion of competitively bidding for an
authorization. r
Ve feel strongly an Engineering Firm should be selected primarily on its
qualifications, not price. As you are aware, the Consultant's Competitive
Negotiation Act (CCNA) states you may request, accept and consider proposals for
the compensation to be paid for consultant services only during competitive
negotiations after a ranking of qualified firms has been deternined. A copy of
CCNA is enclosed for your easy reference. The CCNA process best serves the
interests of the City of Atlantic Beach by allowing you to select the most
qualified firm for your projects, while also assuring you of a reasonable fee for
the work.
Another option you could consider is the possibility of utilizing a continuing
contract for Engineering Services. This is alloyed by GGNA, provided the
contract vas executed prior to the existence of CCNA or negotiated under the
tetras of CCNA. Our continuing contract with the City, negotiated under the terms
of CCNA, is da*_ed June 1, 1985. You nay assign us any task you desire under this
contract in complete commlianee with CCNA.

"easier" routes to their destinations, which could be through
the Donner neighborhood for south or eastbound traffic. The
atltlitional traffic will not only effect Donner Road. The left
turn situation on Mayport Road at Donner Roatl is nearly
identical to that at Plaza. Drivers could turn left onto the
newly paved Church Road antl Lhen travel south on Francis Avenue
Lo Donner Road. This is encouraged by the intersections on
Mayport Road. Southbound drivers can make a left turn across
two lanes of northbound traffic at Church Roatl, but must cross
tnree lanes of northbound traffic at both Donner Road and
Plaza.
The structural conditions of the roads involved, or those
incidentally impacted, should also be considered. The pavement
on Donner Road is narrow from Mayport Lo its current terminus,
especially near the intersection with Mayport Road. Placing
additional traffic on Donner Road will most likely require
re-paving antl widening in the near future. likewise Sandpiper
Lane has a narrow pavement width which barely accommotlates its
current traffic load, much of which is truck traffic to and from
the Public Works/Waste water Treatment Facility. Widening and
re-paving will also be very likely needed for this road in the
immediate future. Francis Avenue may require some widening and
repaving to safely accommodate an increase in traffic.
Sandpiper Lane East and Linkside Drive have relatively wide
pavement, but neither are designed to be used for through
traffic. This cou ltl be discouraged by various means, with or
without eliminating the second access providetl by SantlDiper Lane
East (which was required by the original PUD ortlinance ).
Costs vary considerably between the routes, with the Church
Roatl route estimatetl at E725,000, the Jackson Roatl route at
EB5,000, antl the Oonner Road route aL E57,000. Potential
funding sources include CDBG funds (up Lo 539,000 in this years
budget), gas tax monies, additional HUD funding and general funtl
monies.
Staff has endeavored to present the Commission with as much
technical and background data as possible to assist you in
rendering a decision in this matter. We will be available to
answer any questions er provide any additional information that
you may need in reaching and implementing your decision.

BACKGROUND
At the direction of the City Commission, Staff has
suggested the possible routes for an east-west connecting road
to Donner Subdivision. Following is +nformation for your
consideration regarding the costs involved to construct each
route, the positive antl negative trfaffic impacts on the
neighborhoods involved, and the effects on city services and
traffic circulation. This report is not intended to deal with
the over-all concept of a connecting road, but, rather with Lhe
practical consequences of such a road and the cumulative impacts
involved.
7Y~ree routes were discussed at the last Commission Meeting.
First, extending Donner Road to tYie east and connecting to
Sandpiper Lane. Secontl, extending Jackson Road along the south
boundary of Jordan Park and through the Public Work Facility.
Third, extend in9 Church Road east to the boundary of Selva
Linkside and then south to Sandpiper Lane. Of these options,
the extension of Donner Road is consitleretl the most practical
due to the shorter distances to be paved, as well as the fact
that there is an existing Right-of-Way which runs through Lo
Sandpiper Lane. Th1s route has the added benefit of simply
connecting two existing roadways with the least tlisruption of
the adjoining City Public Works/Wastewater Treatment Facility.
The proposetl connection is lnte nded to facilitate traffic
from the Donner area in accessing the eastern portion of Lhe
city without the necessity of entering Mayport Road. This may
allow through traffic as well as neighborhood traffic on Donner
Road and on SandDiPer Lane, with drivers usiny Conner Road Lo
avoid the often backed up traffic in the left turn lane on
Mayport Road at Plaza. SandD~Per Lane glues direct access to
Sandpiper Lane East which connects through Selva Linkside to
11th Street and then to Seminole Road. This could encourage
additional traffic flow through Selva Linkside as well as Donner
Subtliv ision. This impact will not likely be great because of
Lhe circuitous route through the neighborhood Lo Seminole Road.
This arrangement wily, however, allow easier Fire antl Police
access to the Donner area either through Selva Linkside or
straight up Sandpiper pane.
The impact on the Donner area will be compounded by the
heavy traffic congestion on Mayport Road. Drivers will seek

WHEREAS, the use of parliamentary procedure in the meetings of
private and public organizations in this country promotes orderly
deliberation and protects both individual rights and majority rule;
and
WHEREAS, the position of Jefferson's Manual remains
unchallenged as the earliest to dd~fine and interpret parliamentary
principals for our democratic republic and to offer a basic pattern
of rules and a measure of uniformity for legislative processes of
the United States; and
WHEREAS, April is the birth month of Thomas Jefferson whose
manual has served as a practical reference for leading authorities
today;
NOW, THEREFORE, I, Lyman T. Fletcher, by virtue of the
authority vested in me as Mayor of the City of Atlantic Beach, do

and urge the people cf the City of Atlantic Beach to observe the

Minutes of Joint Meeting with Solid Waste Committee
March 16, 1999
somewhat constant, there were tremendous increases in the volume of
yard trash and garbage in March. Mr. Igou suggested the city
encourage residents to leave grass clippings on their lawns. This
would cut down on the volume and the lawns would also benefit. Mr.
Igou explained the process used by the City of Jacksonville for
turning yard trash Snto compost and mulch and the Mayor inquired
whether it would be feasible for Atlantic Beach to have its own
composting system for yard trash and sludge. Mr. Igou felt that
while the city was not required to pay tipping fees there would be
little financial benefit in building a composting plant. However,
in the event the city was required to pay tipping fees, and
considering the cost of transportation, this may be an option the
city may wish to consider in the future. Mr. Igou agreed to get
materials on combining yard trash and sludge so the city may
consider this on a long range basis.
There being no further discussion, the Mayor declared the meeting
adjourned at 8:55 PM.

The meeting was called to order by Mayor Fletcher and a discussion
ensued relative to the city's recycling. The Mayor indicated he
would like the program to be expanded to include commercial. He
felt that it may be possible to collect a few items such as
corrugated cardboard or glass from commercial. DeWayne Igou agreed
to work with Bob Kosoy on this. However, he pointed out that if
commercial recycling would enable businesses to reduce the size of
their dumpsters, this would result in reduced revenue for the city.
The Mayor also asked about expanding residential recycling to
include paper board such as cereal boxes. Mr. Igou indicated that
the equipment used to sort the recyclable materials had become more
sophisticated and he felt additional items could be added but he
said they could only collect what Jacksonville would accept.
Discussion ensued regarding contracting out solid waste collection.
It was pointed out that both Jacksonville Beach and Neptune Beach
contract out their solid waste collection and Commissioner
Shaughnessy felt if other cities could provide a comparable level
of service at a lower cost, Atlantic Beach should seriously
consider privatizing solid waste collection. Jim Jarboe indicated
Bob Kosoy would shortly have a report on the cost of providing the
current level of Service and the City Commission may be asked to
make a decision regarding privatizing the sanitation service.
Bob Kosoy provided a breakdown of the amounts and types of solid
waste collected for the period 1990 to the present. He indicated
that while the volume of sludge and recyclable materials was

purchase that property. Mayor Fletcher agreed to look into the
possibility of acquiring Dutton Island and Commissioner Waters
agreed to check into the feasibility of acquiring property owned by
Alice Richardson.

The meeting was called to order by Mayor Fletcher and a brief
discussion ensued regarding problems with yard trash collection.
The City Manager explained he had challenged the Public Works
Director to provide a level of service and at a cost comparable to
private contractors or the city would be forced to contract out
solid waste collection.
Mayor Fletcher reported that Finance Director Ann Meuse hadfound,
and the annual audit would confirm, that certain problems existed
with the city's financial record keeping. Many of these problems
were due to the change from quarterly to monthly billing for
utility services and the change from the old computer system to the
AS-900. Ann Meuse was working hard to correct the situation and
Joe Welsh of Purvis, Gray 5 Company would be in City Hall working
with Ms. Meuse to help resolve the problems. Discussions at the
next meeting will concentrate on how the budget could be restruc-
tured to make it simpler and more user-friendly.
Discussion ensued regarding the proposed Commission policy manual
and the City Manager and City Clerk agreed to get together and come
up with a list of matters on which it would be beneficial to have
written Commission policies.
Mayor Fletcher felt the City Commission should concentrate on a few
areas at a time and suggested as priorities, fiscal responsibili-
ties (budget, and the cost of providing basic services), parks
(including tree planting, beautification, and a gardener), and
solid waste. Commissioner Shaughnessy felt code enforcement should
also be considered as a priority matter.
Discussion ensued relative to land acquisition and Commissioner
Weiss reported he had talked with Mr. Tresca regarding his property
in Section H and he felt it may be possible for the city to

Rose Blanchard referred to a new building at
Wingate Park in Jacksonville Beach, and she passed
out a sketch of the b•~i ~i ding to the Commission.
She explained it included a concession stand,
restroom, storage facilities and a press box, and
the structure reportedly cost only 578,000. She
indicated she had invited the architect of the
Wingate facility to come to Russell Park Tuesday,
March 28, 1894, at 2:00 p. m., and she invited
commissioners to join the meeting'.
Whereas Commissioner Waters felt the building at
Russell Park should match the design and
appearance of City Mall and Commission Chamber
buildings, other Commissioners felt that it might
not De financially feasible to match the design
and appearance of the City Nall and Commission
Chamber buildings. Cynthia Corey explained the
Board felt the building should be constructed on a
scale that would ensure there would be enough

money to build the Donner building.
The question was called and the vote resulted in
3-2 with Commissioner Rosenbloom and Commissioner

Blanchard, Garks and Recreation Director,
explainetl the Little League indicated they would

to Sandpiper Lane at an estimated cost of 557,000,
(2) extending Jackson Road 1,000 feet along the
south end of Jordan park and through the middle of
the public works property for an estimated cost of
585,000, and (3) extending Sandpiper Lane north
and west for 1,500 feet to connect Keetens Street
and Jordan Street for an estimated 5125,000.
Following discussion, it was felt alternate (1)
extending Donner Road approximately 800 feet
through the south end of the public works property
to Sandpiper Lane at an estimated cost of 557,000
would be the least expensive and best alternative,
and it was suggested that the road be limited to
residential traffic, only.
It was decided to defer action and set a public
hearing for March 29, 1994 to set on extending
Donner Road eastward, at which time funding would
be discussed.

Commissioner Rosenbloom asked if Community
Development Block Grant funds could be used, to
which the Nayor indicated it might be possible to
use Community Development Block Grant funds. It
was decided dedication of the road and funding

way might not be the best way for future years.

oral presentations would be made for engineering
design services for rehabilitation and expansion

use. It was explained Mrs. Jackson was entitled
to us<_ the property in the future as she had in
the past, although approval was given for not more
than ten children at one time. Additionally, Ms.
Jackson must operate continually without a break
in operation ~f six months or more in order to

It was explained the course of action was
unanimously agreed upon because it preserved Ms.
Jackson's legal right to continue to provide a
valued and needed service for the community. It
was explained the current ordinance remained
unchanged in any way, thereby preserving the
zoning integrity and residential character of the
Royal palms neighborhood. It wad explained this
applied only to Ms. Jackson and snot to others who
may wish to apply for Use-By Exception for non
conforming uses, unless they may qualify in the
same manner as Ms. Jackson.
The Commission accepted Commissioner Shaughnessy's
report and recommendations.

Ba. Discussion relative to access to the Donner
neighborhood
William Gvlliford spoke on behalf of the Donner
Community Development Corporation and asked the
Commission to consider extending Donner Road
eastward to provide additional ingress and egress
to the Donner neighborhood. He explained at
present the only route from downtown Atlantic
Beach into the Donner Community was via Mayport
Road.
It was explained Dostie Builders intended to
rebuild this area with attractive single fanily
detached housing, but it was felt that another
access was imperative for the project to become a
reality, It was explained it would De necessary
for the city to reach a decision within 30 days or
Dostie would cancel its plans.
Sketches which indicated three alternatives were
provided, and different access routes which would
connect the residential area west of Jordan Park
to Sandpiper Lane and by Sa r~dpiper to Plaza, were
discussed. The proposed routes were as follows:

Lou Collins, 134 Pine Street, complained of a
problem regarding yard trash being picked up by
the city. She indicated this had been on-going
for some time. Bob Kosoy, Public Works Director,
indicated the problem was partly due to equipment
breakdown and the fact that March was the busiest
month of the year. Ne suggested that trash be
placed in front of homes by 6:OC a. m.

Commissioner Shaughnessy reported Sara Jackson had
withdrawn her application for Use-Dy-Exception
effective March 14, 1994, as it was no longer
necessary for her to obtain one. It had been
determined by Commissioner Shaughnessy, City
Attorney Alan Jensen, City Mand9er Kim Lei nbach,
and Community Development Director George Worley
that Ms. Jackson's legal use of her property to
care for children in her home pre-dated the
current code. Mer property had been in continuous
use for this Purpose since 1972, and her use of

WHERP.AS, Atlantic Belch has organized numerous annual
community events, specifically Christmas Tree lighting,
Thanksgiving baskets and back-to-school assistance to needy
families, and most recently, Atlantic Beach Under the Stars camp-
out; and
WHEREAS, fer six years Publia Supermarkets has supported the
city's endeavors with donations such as refreshments for Christmas
Tree lighting, and gift certificates for Thanksgiving baskets; and
WHEREAS, the Atlantic Reach City Commission recognizes the
importance of intercommunity involvement and participation in
successful government.
NOW, THEREFORE, BE IT RESOLVED, the Atlantic Beach City
Commission recognizes the good-neighbor policies of Publia
Supermarkets, and does hereby express deep appreciation to Donald

9. METER READItlG - Narry McNally presented a sumwary of the
total number of meters in Atlantic Beach, Buccaneer and
Oak Harbor and the total number of touchread meters
installed in each utility. He then presented an analysis
of installing the remaining 6512 touchread seters by
hiring a contractor versus using City personnel. It
appears that using City personnel on overtime could save
approxiwately 627,000.00. Zf it appears that overtime
hours rill be too excessive, a meter installation crer
using personnel from the other Beaches rill De
investigated.

discharge. The preferred solution ie to construct

necessary to build additional storage for the Atlantic Beach Parks
Department equipment and it was suggested this structure be located

The workshop meeting, which was held for the purpose of reviewing
plans for the concession building in Jack Russell Park, was ca J.led
to order.
Discussion ensued regarding the master plan for Jack Russell Park
wl~i ch had been prepared by the Department of Natural Resources in
1990, following which it was consensus that Russell Park had been
developed and was being used to capacity and additional playing
fields, if desired, should be located in other parks. It was felt
it would be useful to have an aerial view and/or a survey of
Russell Park to get a better idea of the exact location of the
current fields and structures.
Commissioner Waters felt because of the central location of Jordan
Park that adjacent land should be purchased and developed as soccer
fields. Ne felt a portion of the park could be maintained as a
passive park.
Further discussion ensued and it was felt Donner Park would be an
excellent location for adult games such as softball.
The City Manager reported that the city had retained an independent
environmental engineer to inspect the undeveloped property at
Mayport Road and Atlantic Boulevard and provide an opinion
regarding the potential of this land for development, or whether
any of the property would be classified as wetlands.

feasible and they would be glad to include Atlantic Beach in their
projects. There would be some cost sharing involved for the city
but it was felt if this project could be undertaken as a joint
venture with Neptune Beach the cost would be minimal. Commissioner
Rosenbloom agreed to pursue this matter further with Greenscape.
Jack Robbins reported the committee was working on the second
median on Atlantic Boulevard. Vegetation had been sprayed with
Roundup and planting should begin shortly. He felt the matter of
maintenance needed to be resolved and Commissioner Rosenbloom felt
maintenance should be contracted out. Jim Jarboe reported that
the budget for lawn maintenance had been cut in the current fiscal
year's budget and city crews were doing the best job they could
with the equipment they had. He said the old fire truck was being
used to water landscaping. It was suggested that specifications
for water and sewer projects include landscaping to make sure that
project sites are left in a condition and acceptable to the city.
It was suggested that the Beautification Committee be informed of
water and sewer projects and Carl Walker offered to attend pre-
construction conferences to make sure contractors are made aware of
the importance of aesthetics.
In further discussion, Beautification Committee members expressed
frustrations they had experienced with past projects, due in part
to inadequate budget. Mayor Fletcher suggested the committee
concentrate on a few projects and work with Carl Walker to include
them in this budget for next year. He suggested they attend the
budget workshops to support the budget request.
Jack Robbins suggested the possibility of changing traffic on East
Coast Drive and Ocean Boulevard to one-way to provide space for
bike/jogging paths. Mayor Fletcher indicated a meeting would be
held on March 23 to discuss traffic and parking and this would be
the appropriate time to discuss that matter.
Commissioner Haters requested that the specifications for the work
on the concession building in Jack Russell Park include landscaping
and also requested that the Beautification Committee be involved in
that project.
There being no further discussion, the Mayor declared the meeting

The meeting was called to order by Mayor Fletcher who explained the
City Commission was trying to meet with each board and committee of
the city to better understand the goals and objectives of the
various groups and to work with those groups as far as possible to
accomplish their goals.
Carl Walker reviewed a five-year community improvement plan which
had Caen prepared five years ago and pointed out those projects
which had been completed.
Discussion ensued regarding signs and it was agreed the City
Commission should adopt a policy regarding the appearance and
number of signs to be used throughout the city. This information
should then be communicated to department heads and the entire city
should then work within that policy. It was pointed out the City
Commission was hoping to develop a policy manual and the
beautification committee could present suggested policy statements
for approval of the City Commission. Jim Jarboe pointed out that
funds would need to be budgeted if the city adopted a policy of
requiring Signs which were more expensive than those Currently
used.
Commissioner Rosenbloom reported he had talked to Greenscape
regarding planting trees in the medians on Atlantic Boulevard.
Greenscape had indicated that the Atlantic Boulevard project was
Mulch and beautify Park wi[6 trees, plants, etc.
Study present fenced area and 'determine if i[ can be made more secure while
appearing more "open".

At this time we are awaiting a report from Che St. John's River Management District,
Wetlands Division, regarding the statue of the property and its classification as a
Wetland, Marsh or whatever. A report to Che Covoisaion will follow as soon as we are
in receipt of such information. The Board Recommends, leave £t like it ie until the
report is in.
Concerns of [he citizens vho live near our Parka, will be addressed by':members of the
Board who frequent the Parka, seeking input from users, "on the spot". The Recreation
Advisory Board will also net up a table at the Spring Peatival, May 7, 1994, soliciting
citizen input regarding all parks.

BACKGROUND:
AC [he direction of the City Commission and the Fecreation Advisory Board, [he following
recommendations are presented to [he City Commission for consideration. This report
is the result of a great deal of work done by the Board Members [o facilitate projects
and ideas regarding our Parks S Recreational needs.
A short term (1-2 years)~and a Long term (3 years) list of recommendations follow.
JACK RUSSELL PARK: SHORT TERN:
1. PRIORITY PROJECT:
Build new Concession stand without the proposed additional apace for YMCA.
Add restrooms and a single, simple, small press box, with access from inside
the concession stand, as in previous years.
Renovate, refurbish and re-design the present building, using [he area nox
utilized by the Parks b Recreation Maintenance Crew for storage, to house the
same types of materials (movers, pitching machines, etc.) belonging to Little
League. This will be cause to remove the rented storage boz the League is now
using. Little League vii begin the grassing of the infield this Summer and the
Pields will be ready for Pall Season. The reference to "fields° includes both
Russell Park aad Donner Park ball fields.
TBE CORSTROCTION AT JACK BUSSELT. PABK WILL BEGIN AT TBE ERD OF T~ 1994 SPBIRG
SEASON. Little League hoe been notified that they MOST_ move. all of their equip-
ment, concession gear, etc. from the Park, v1t61n 24 hours of the closing day
which 16 not firm, but fa estimated to be the end of June, 1994.
The Board recoaotends [ha[ the Little League Coaches should scbedule their meetings
in the Adele Grage Co®unity Center, thus having no need for additional apace in
the Concession area. The use of [6e Concession stand is swathing the Board felt
should be viewed by the Parka 6 Recreation Depc. as a possible revenue source.
2. While the study is on going in the City, the drainage problems la the Parka need
[o be corrected.
3. Ask the YMCA [o "dress up" the modular they use, perhaps with shaker shinglee
and definitely with shrubs and plants.
LONG TERN:
1. Refurbish and add aew playground equipment
2. Mulch and add trees and plants.
3. Continue diligent ma?ntenance of the graunda, equipment and structures.
DONNER PARK:
1. PRIORITY PROJECT: SNORT TERM:
Build new Coucession stand with resttooms, small press box, very much the same
as the plan for Jack Russell Park, perhaps a little smaller. This to be done
at the same time as ve dv Russell Park. All conditions would be the same. they
use the field until the end of the season, to play and practice.
2. Build a more permanent building for the Community Center. Use [he present 5700
monthly payment for the modular, co secure a loan for a more permanent bulding.
Some thoughts are to build a pre-fob or metal building.
3. Erect an outfield fence, dugouts of chain link. and bleachers end iefurbieh
playing lights.
4. Develop programs far youth through planned activities. This 16 very important
at all active Parks and will necessitate hiring additional personnel.

Kim Leinbach, City Manager, reported the city
intended to enter the 1994 City Innovations
Showcase sponsored by the Florida League of Cities.
Commissioner Maters announced the American Legion
would hold its annual dinner honoring city
employees on May 13, 1994.
Commissioner Weiss suggested staff put together
hard and fast rules to be applied to the bidding
procedure.
Commissioner Shaughnessy requested that a
resolution be drafted to recognize Publiz for
their support relative to city functions. She
indicated that Publix agreed to donate food for
the Atlantic Beach Camp out, and that through the
years they had continued to support the city.
Mayor Fletcher asked each commissioner to suggest
one name for appointment to the Occupational
License Equity Board for the meeting of March 14,
1994.
Mayor Fletcher announced there would be a joint
meeting between the Beautification Committee and
the Commission on March 7, 1994, a Solid Waste
Committee meeting on March 16, 1994, and a Traffic
and Parking workshop on March 23, 1994 at which
time the subject of speed bumps would be addressed.
Ruth Gregg suggested the commission contact HRS in
an effort to receive guidelines relative to daY
care operations. She asked the commission not tc
rezone property in the Royal Palms neighborhood,
and she indicated she felt such rezoning woulc
ruin the neighborhood.
Ruth Gregg reported residents in Royal Pale
neighborhood were not using recycling bins. She
suggested when residents request water service
that the city furnish them with a recycling bin,
The City Manager advised this matter would b~
taken care of.
Since there was no further business the Mayoi

t-3, with Commissioner Shaughnessy, Commissioner
Weiss, and Mayor Fletcher voting nay. The motion
failed.
It was decided to study the matter of the building
in Jack kussell Park, and staff was instructed to
come back on March 14, 1944 with plans and
specific recommendations to implement the report
of the Recreational Advisory Board, including
plans.

Sharette Simpkins, Donner Community Development
Corporation, requested the Commission to allow
Mrs. Lillie Allen, who resided at 1880 Francis
Avenue, to reside in one of the city owned houses
on Francis Avenue white the CDC was working with
Jacksonville HUD to build her new home. She
explained Mrs. Allen would be responsible for all
the necessities to move into one of the homes, end
that the CDC would work closely with her to see
that the necessary item were in place.
A discussion ensued and the commission agreed to
allow Ns. Allen to reside in a city owned house on

had been made by the previous commission to go
forward with plans to build the (250,000 structure
in Jack Russell Park if funding was available, and
he suggested in order to resolve the matter that
the idea be voted upon.

Mayor Fletcher opposed spending the amount of
f270,000 which he indicated was the final figure
for full scale construction, to build in Jack
Russell park. Ne felt the building was too large
for the park, and building it would neglect all
other recreational needs. He felt it would take
all the city's money to build one building, only,
and there would be no money. left to do other
things that were needed.
Commissioner waters felt the building was in the
center of the city, it was the park that every
one used, and thus it was the right place to build
such a building.
Commissioner Shaughnessy agreed that Russell Park
would be the site for such a facility, but felt
this was not the time for such a large, single
undertaking.

Mr. Parker felt the city made a mistake in
estimating the job, and that Her-way was not out
of line. He asked the commission to consider
awarding the job, and he offered to work with the
City by using the pipe the city would like to use
and thus save money. Kr. Kosoy felt it would be
in the city's best interest to rebid the job.
The question was called and the motion carried
unanimously.
5 Reoor Hof Committees:
a. Report and recommendations from Recreation
Advisory Board
Don Fagan, Chairman of the Recreation Advisory
Board, presented a reported to the commission
detailing tong and short term goals for the city's
four parks and a piece of vacant land on Atlantic
Boulevard (report dated February 18, 1994 is
attached herewith and made a part hereto).
According to the report, it was recommended the
city construct two comparable concession
facilities at Russell and Donner parks. the
buildings would house a concession stand,
restrooms, and an upstairs press box for calling
sports activities. Plans to incorporate a
building for the YMCA program into the concession
stand at Russell Park were recommended to be
cancelled, and it was recommended the YMCA improve
the modular building they utilized.
The Mayor suggested the decision on Russell anc
Donner buildings needed to be made so that bide
could be invited and construction commenced bi
August 1, 1894. Commissioner Waters felt e
professional should evaluate parks. He felt Jacl
Russell Rark was running out of room, and he fell
young people needed more room for games. He urge<
the commission to direct staff to seek more land,
Mayor Fletcher agreed and indicated if staff foun,
that there was land available, avenues would b,
explored to fund the purchase of the land.
The commissior, expressed concern that land the
city owned on Atlantic Boulevard, west of Maypor~
koad, nay be declared wetlands by the St. Joh n.
