Subject: Motion to Defer 2nd Reading of Ordinance 90- 13-216 pertaining to Selva Marina Country Club
Alan -
As per our discussion, I am concerned that the City of Atlantic Beach does not have the legal verbiage written into
Ordinance 90- 13216 securing the conservation easement required by COAB. Without the conservation easement over the
golf course and remaining green space, COAB is exposing its citizenry to a possible increase in the number of
untaxable homes, vehicles and people. But, even if the Atlantic Beach Country Club is successful in the selling of the 180
lots in Ordinance 90 -13 -216 and the additional 20 lots noted in the recent addendum, without the conservation easement,
the long term exposure is still a concern due to the fact that the Atlantic Beach Country Club would no longer have
enough acerage to repeat the present business opportunity.
To protect COAB you offered a number of options including: deferring the 2nd reading and vote until such time that we
have the appropriate documents in hand; a clause that contains verbiage that would allow the ordinance to take
effect after the Selva Marina Stock Holders affirm the plans of the Selva Board, including the conservation easement; as

well as having a written document reviewed and agreed upon by all parties involved. I defer to your expertise as to what
will be best to protect the cities interests.
I appreciated your reference to Marc Hudson, The North Florida Land Trust - Land Protection Director. I will request an
agenda item pertaining to using The North Florida Land Trust as our consulting entity and utilizing their Land Protection
Director, Marc Hudson as the point man.
