It was very helpful to review the variance files. On the chance the you see your office e-mails 24-7, am I correct that theonly CL zon in the City is along the east side of Mayport Road basicallywhere the Habitat project is going up? Therewere two zoning variances granted to Beach Diner (97 and 2002), related toexpansion of a non-conforming structure. There is also a lot of permittingrelated documents, but very little discussing parking. One of the morerelevant things I found was a Pizza Hut site plan for the shopping center, which showed the parking as being dedicated to the shopping center. There isalso a site plan from 1997 when the Beach Diner was expanded, which shows 90spaces throughout the entire site. You can find the files in the foldertitled Gate/Beach Diner. http://weblink.coab.us/WebLink8/Browse.aspx?startid=541204 Please let me know if you need help sifting through the files. I am maybe 40-50% complete with my report. I will be working on it the nexttwo days and hope to finish it in draft for you to look over, maybe bytomorrow late. I did speak to Paul Eakin and this morning he sent me the attached email. I had heard that was the judge's ruling, but it'shelpful to read. Things have been a bit hectic post New Years and I forgot to send you Gate'sresponse to our first round of comments. They are in the PDF here. Where areyou at with your review of the project? The judge's decision was a "nocall" based on the rule of law that, in the absence of a final decision byCOAB on the site plan, there is no cause of action for a declaratoryjudgment.
