Steve,
I've placed a substantial amount of documents related to both the 501
Atlantic address (Beach Diner) and 535 Atlantic (shopping center). There
were two zoning variances granted to Beach Diner (97 and 2002), related to
expansion of a non -conforming structure. There is also a lot of permitting
related documents, but very little discussing parking. One of the more
relevant things I found was a Pizza Hut site plan for the shopping center,
which showed the parking as being dedicated to the shopping center. There is
also a site plan from 1997 when the Beach Diner was expanded, which shows 90
spaces throughout the entire site. You can find the files in the folder
titled Gate/Beach Diner.

Does the plan set you gave me reflect the response from Prosser to the
City's initial review?
I am maybe 40-50% complete with my report. I will be working on it the next
two days and hope to finish it in draft for you to look over, maybe by
tomorrow late.
I did speak to Paul Eakin and this morning he sent me the attached email.

Here is a copy of the complaint and order. The judge's decision was a "no
call" based on the rule of law that, in the absence of a final decision by
COAB on the site plan, there is no cause of action for a declaratory
judgment.
