It was very helpful to review the variance files. On the chance the you see your office e-mails 24-7, am I correct that the only CL zon in the City is along the east side of Mayport Road basically where the Habitat project is going up? There were two zoning variances granted to Beach Diner (97 and 2002), related to expansion of a non -conforming structure. There is also a lot of permitting related documents, but very little discussing parking. One of the more relevant things I found was a Pizza Hut site plan for the shopping center, which showed the parking as being dedicated to the shopping center. There is also a site plan from 1997 when the Beach Diner was expanded, which shows 90 spaces throughout the entire site. You can find the files in the folder titled Gate/Beach Diner. http://weblink.coab.us/WebLink8/Browse.aspx?startid=541204 Please let me know if you need help sifting through the files. I am maybe 40-50% complete with my report. I will be working on it the next two days and hope to finish it in draft for you to look over, maybe by tomorrow late. I did speak to Paul Eakin and this morning he sent me the attached email. I had heard that was the judge's ruling, but it's helpful to read. Things have been a bit hectic post New Years and I forgot to send you Gate's response to our first round of comments. They are in the PDF here. Where are you at with your review of the project? The judge's decision was a "no call" based on the rule of law that, in the absence of a final decision by COAB on the site plan, there is no cause of action for a declaratory judgment.
