Ardella Place Plat CC PH- Derek Reeves 8-8-16Request for plat approval as required by Chapter 24, Article 4 of the Code of Ordinances at RE# 172147-0000 and 172150- 0000 (previously known as 115 and 125 Donner Road). 16-SFPA-125 Ardella Place Plat Site Context and Detail Site Context and Detail Site Context and Detail Proposed Plat Dividing 0.66 acres of land into 7 lots for existing and under construction townhouse buildings. Lots 1, 2 and 3 are for a 3 unit building under construction. Lots 4 and 5 are for a completed 2 unit building. Lots 6 and 7 are for another completed 2 unit building. Analysis and Concerns Land Development Regulations RG-M zoning allows multi-family development. Section 24-88(a) requires 2,175 square feet of lot area per unit in the RH Future Land Use area. Overall 7 units is 4100 square feet per lot. The smallest is in excess of 3450 square feet. Comprehensive Plan Residential High Future Land Use allows up to 20 units per acre. 0.66 acres is good for a total of 13 units, 7 to be plated. Staff Comments Minor text corrections made. Chapter 24, Article IV has changed since agenda packet was released. Public Works is requiring a deed restriction for stormwater retention. CDB Recommendation Unanimous vote to recommend approval with a condition. Condition: that the drainage and associated deed restriction be finalized to the satisfaction of staff prior to final approval. Action to be Taken To approve item 16-SFPA-125 with the following conditions: 1.The Plat be amended prior to recording to incorporate the correct recording information for Ardella Road road and sewer easement if a written instrument conveying same to the City can be located subject to the approval of the City's counsel; 2.If an Ardella Road recorded instrument cannot be located, then CDL, no later than 6 months from August 8, 2016, will convey and dedicate an easement for roadway and sewer purposes to the City in such form and pursuant to such survey as the City may reasonably require, but reserving its interest in the underlying fee simple real property and all rights of reverter AND without requirement that CDL provide any warranty of title relative to such conveyance or dedication, and within 30 days thereafter the plat will be revised to incorporate the recording information for such conveyance/dedication. 3.The Plat, page 1, note 3 will be amended to incorporate an express reference to the recording Book and Page of the Ardella Place CCRs as well as an additional restrictions which may be recorded, etc. Action to be Taken Action to be Taken
