Reeves&City Commissioners City of Atlantic Beach 800 Seminole Road Atlantic Beach, FL 32233 RE: City Manager's refusal to service Beachside HOA neighborhood requests for sewer maintenance Dear Honorable Mayor Reeves and City Commissioners: The Beachside at Seminole Beach Homeowner's Association (HOA)would like to inform you about a city denial of services situation that has been festeringfor thepastyear. Two membersof our Beachside neighborhood have called the City Public Works department(DPW)to have the drains in front of their homes cleaned out because the backed up high water made the road impassible to the rest of the subdivision during the November 8,2015 rainstorm.This drain is located at the east side of the intersection of Beachside Drive and Beachside Court.Calls were made again earlier this year and the person answering the DPW phone said these requests would be put on a list. After no action by the City HOA Board of Directors Member, David Bennett, made three further calls to Public Works concerning this issue. Mr. Bennett finally received a telephone response from Mr. Don Jacobovitz on October 28,2016. Mr.Jacobovitz informed Mr. Bennett that he could not find any records where Beachside streets and drains were considered part of the City of Atlantic Beach. Mr.Jacobovitz further stated that the City Manager had also informed him, Mr.Jacobozitz,that Beachside Court was considered a "private neighborhood"and ineligible for City services. Mr.Jacobovitz informed Mr. Bennett that the HOA could request the city to do this work for a fee. No specific cost was provided,but the HOA would be required to reimburse the City for the truck,trailer and two city employees to service the clogged drain. This position taken by the city manager,Mr. Nelson Van Liere,is patently incorrect. A review of City Commission minutes indicates that the City Commission voted unanimously on June 22, 1987 to accept Mr.Steve Morrow and Pete Dowling's(the developers of the Beachside subdivision) request to accept all improvements,to include the streets and drainage,into the City. I enclose a copy of that documentation. I also enclose a copy of Mr.Jacobovitz's list of city streets maintained by his department presented at the August 24,2016 city budget meeting. Mr.Jacobovitz's list of streets includes Beachside Drive and Beachside Court where the drains are located. We request that you direct the City Manager to allow the Director of Public Works to perform his job and render the services we are entitled to. This neighborhood endured Hurricane Matthew with the exposure of the drain not being maintained.The next such storm could cause extensive damage,for which the City would be liable.This type of situation reflects poorly on our city government and should be corrected immediately. Discussion by the City Commission on the advisability of authoriz- ing the drawing of an Ordinance to close and vacate a city right-of-wady across Lot 725 and a part of Lot 736, Saltair subdivision, reserving unto the city a perpetual easement for utilities over, under, and across said right-of-way. Mr. Fellows explained the property was located on Sturdivant Avenue at the western extreme of the Community Presbyterian Church property. • He furnished a brief background of the right-of-way of lots 725 and 736. He felt it would be in the best interest of the city to vacate the right-of-way as the city had no use for it and the maintenance would be back in the hands of the church. Following discussion, the City Manager will research in detail and report back at the next meeting. * * * * ,, * * * is * * * * * k * * * * * 6. Action by the City Commission to authorize extension of water services to eleven residences on Beach Avenue between Eighteenth and Nineteenth Streets, contingent upon the homeowners receiving the service paying for all costs involved. Mr. Fellows reported he had six written commitments on hand. Their wells ,were running dry and due to the emergency, DER had agreed to issue a permit before the plans were prepared by just furnishing them a sketch. The extension of water services would be done by city ""``.orces. Commissioner Edwards suggested fire hydrants should he in- stalled also. Commission agreed two should be placed on the line.
