I have been contacted by both Mr. Lambertson and by Mr. Andrews. The
email thread I am forwarding is follow up documentation of their
complete dissatisfaction with how they feel they have been treated
recently in a meeting with you and Mr. DeCandis.
As you are well aware, my expectation is every resident interaction
with City staff should conclude with the resident feeling like they
experienced exemplary customer service. I have commented on numerous
occasions that "the residents are not a distraction to your work, they
are the reason for your (and my) work". Without that experience, they
have no need for a Mayor and Commission, a City Manager or City staff.
On occasion, you have often responded to this comment somewhat offended
because you believe your career choice of public service indicates your
commitment to the tax payer.
Since both gentlemen have conveyed to me the same story separately, I
have to believe that their statements are indeed factual. I can not
begin to see how any reasonable person could believe that it is
acceptable for a City employee to get up and walk out on citizens who
disagree with City staff actions, while the resident that pays their
salary is still there wishing to get questions answered. Further, I can
find no reason that you did not intervene on behalf of the residents. I
do understand from the residents that the Mayor intervened the first
time Mr. DeCandis arose to leave, which would have been a great example
for you to have followed the second time Mr. DeCandis chose to end his
participation in the meeting.
In my opinion, Mr. DeCandis has, in a very short time with the City,
made choices having very little knowledge of Atlantic Beach, its
residents, the rules that govern our City and frankly, common courtesy,
that I believe you as the City Manager should give thought to exercising
the option to discontinue his employment before matters worsen. I have
been directly involved with Mr. DeCandis once and contacted by citizens
about two other separate matters whereby Mr. DeCandis, it seems, has
demonstrated a lack of respect to the citizens of Atlantic Beach.
I personally believe this should be a discussion topic for the
Commission meeting agenda for the 9th of January 2017.
What I find completely irrational about this conflict is that you and
your staff have chosen to take such a firm stand on an issue that is
simply resolved with no downside for you or your staff. A simple
referral to the Community Development Board as I suggested in my last
email about this address and development, would have taken the spotlight
off of you and the building department, which has had its fair share of
scrutiny recently for many reasons, and placed the responsibility with
the CDB. Quite possibly, the CDB might have come to the same resolution
as have you. And, it would have been completely within the CDB
authority, whereas based on my understanding and review of surveys,
Section 24-48 and other information, Mr. DeCandis's decision exceeds his
authority, albeit very slightly.
I gather this is an issue more about questionable actions by a
developer than about a few inches for Mr. Lambertson and Mr. Andrews.

Drew,

our meeting were rude, disrespectful and frankly
unacceptable for any
employee of Atlantic Beach to its citizens and

citizens of Atlantic Beach, which we believe that you

do and then dismissed our concerns and interpreted the
reading of the
code when it suits your interest.
Based upon your response you evidently did not pay
attention at our
meeting. Your restatement of our meeting did not even
remotely
represent actual events.
· To clarify, you stated in the meeting that we
thought the
setback variance should go the Community Development
Board and should
not be under the purview of the Development Director
regardless of how
small the variance might be in terms of inches or
regardless of the
authority granted to me in the code. - We said that
section 28-48 of
the municipal code did not give you authority to grant
an
administrative variance in this case and that the
setback variance
should go to the CDB. Additionally the actions of the
developer create
a cause of concern. We said that the code needs to be
rewritten to
allow for minor adjustments as needed but not the
current 5% and the
way you are interpreting it, which is different than it
has ever
previously been interpreted.
· It is also my understanding from the meeting
that you plan to
exercise that right to appeal, even if I move the matter
to the CD
Board and they approve the variances. We never said
this. We would
abide by the decision of the CDB, however, we would
appeal any
administrative decision to the City Commission.
· Once I have fully reviewed and fully considered
your
concerns, reviewed my positon on the matter, I will make
a final
decision on the variance request and how it should be
handled - This
was not what we discussed in the meeting. We are going
to reconvene
the same group with the Brenna Durden, City Attorney and
she is going
to give us an opinion which all parties agreed to at
that time. We do
not want your opinion.
· Keep in mind, as I stated in the meeting, that I
am concerned
for the neighbors and would like to insure that whatever
the outcome
of this issue that we disrupt their peaceful enjoyment
of their
properties as little as possible - We are friends with
the direct
neighbors and they do not want the house encroaching on
the setbacks
as it is already overwhelming there house.
We look forward to reconvening our meeting with the City
Attorney. Due
to vacation and travel plans it will need to be in the
new year.
