Item 6A- Resolution 17-04Agenda Item 6A March 27, 2017 AGENDA ITEM: SUBMITTED BY : DATE: BACKGROUND: STAFF REPORT City of Atlantic Beach Commission Meeting March 8, 2017 The proposed FIND Grant Project is for the Marsh Preserves ADA Viewing/Fishing Pier at Dutton Island . Construction Estimate : $200,000 City Match: $100,000 The Preserve Parks, encompassing more than 400 acres of wetlands and marshes located on or adjacent to the Intracoastal Waterway {ICW), currently have observation platforms, a fishing pier, kayak launches, floating docks, pedestrian paths, restrooms, and education kiosks and pavilions. These parks are part of a paddling trail system for canoes and kayaks, and also have foot trails for nature observation and studies. The purpose of this project is to expand public access to recreational and educational areas. The proposed viewing/fishing pier at Dutton Island will provide additional ADA access directly to the ICW and its adjoining waterways north of Dutton Island . The viewing/fishing pier provides the opportunity to view and access the associated ICW marshes for environmental education , nature observation and fishing for residents and users that have not had access in the past . The Florida Inland Navigation District requires a resolution (see attachment) to be submitted with the application for funding, and the application is required to be submitted by March 31, 2017. BUDGET: This resolution states that the City is committed to providing $100,000 to match a FIND Grant to construct a Viewing/Fishing Pier located near the Dutton Island Bridge that is ADA accessible to park visitors. Funds will be requested in the 2017-2018 budget to be approved later this year. RECOMMENDATIONS : Approve the attached resolution and authorize the City Manager to sign the application for the Florida Inland Navigation Districts Waterways Assistance Program Grant . ATTACHMENTS: Resolution 17-04 Agenda Item 6A March 27, 2017 ATTACHMENT E-7 RESOLUTION 17-04 FOR ASSISTANCE 2017 UNDER THE FLORIDA INLAND NAVIGATION DISTRICT WATERWAYS ASSISTANCE PROGRAM WHEREAS, THE City of Atlantic Beach is interested in can·ying out the following described project for the enjoyment of the citizenry of Atlantic Beach and the State of Florida: Project Title Marsh Preserves ADA Viewing/Fishing Pier at Dutton Island Total Estimated Cost $200,000 Brief Description of Project: This project includes a new viewing/fishing pier located near the Dutton Island Bridge that is ADA accessible to the park visitors. Previously, FIND approved design, engineering and pennitting of this project concurrent with a Kayak/Canoe Launch and Viewing/Fishing Pier at Dutton Island and theW. 6111 Street Overlook (constmcted 2015-16). AND, Florida Inland Navigation District financial assistance is required for the program mentioned above, NOW THEREFORE, be it resolved by the City of Atlantic Beach that the project described above be authorized, AND, be it further resolved that said City of Atlantic Beach make application to the Florida Inland Navigation District in the amount of 50% ofthe actual cost of the project in behalf of said City of Atlantic Beach, AND, be it further resolved by the City of Atlantic Beach that it certifies to the following: 1. That it will accept the tenns and conditions set forth in FIND Rule 66B F.A.C. and which will be a part of the Project Agreement for any assistance awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any change has been received from the District. That it has the ability and intention to finance its share of the cost ofthe project and that the project will be operated and maintained at the expense of said City of Atlantic Beach for public use. 4. That it will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P. L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by persons with disabilities as well as other federal, state and local laws, rules and requirements. 5. That it will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. 6. That it will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 1 0% of the funding agreed to by FIND. This is to certify that the foregoing is a true and correct copy of a resolution duly and legally adopted by the Atlantic Beach City Commission at a legal meeting held on this 27 111 day of March, 2011.
