BACKGROUND: Applicant has requested a new driveway at 2346 Oceanforest Drive
West with a circular driveway. The lot frontage is 90 feet. All other
sections of the code appear to have been met by the application.
BUDGET:
City Code Section 19-7: Construction of driveways in rights-of way
contains the following requirement:
(f)" ... , and circular drives shall only be permitted on lots having at
least one hundred-foot frontage."
No budget consideration
RECOMMENDATION: To get Commission consensus to move the requested waiver of
City Code Section 19-7 forward to a public hearing, unless there is
neighborhood opposition to the request.

Section 24-46 (d) permits the City Commission to authorize limited Waivers , on a case-by-cas e ba s is, ft"Om a
specific provi sion(s) of these Land Development Regulations when it is demon stn1ted that compliance with
such provision(s) would be unreasonable, in conflict with the public intet·est, or .a practical impossibility. A
Wai ver from these Land Development Regulations may be approved only upon showing of good cause, and
upon evid ence that an alternative to a specific pmvision(s) of this Chapter shall be provided, which conforms to
the geneml intent and spirit of these Land Development Regulations. In con sidering any request for a \Vaiver
from these L and Development Regulations, the City Commission may require conditions as appi"Opriate to
en sure that the intent of these Land Development Regulations is enforced. A Waiver shall not modify any
requirement or term customarily considered a s a Variance or any requirement or term prohibited as a
Var·iance, and shall be considered only in cases where alternative adminish·ative procedures ar·e not set for the

The construction of a new driveway in the city's right-of-way, or the modification of an ex i sting
driveway in a right-of-way, shall require a construction permit within city rights-of-way and ea se ments.
Sa id permit shall be issued subject to the following requirements:
(a) The proposed driveway shall not create more than fifty (50) percent imperviou s area within
the right-of-way.
(b) Any permit issued shall be a revocable encroachment permit if any non standard driveway
materials (i.e., pavers) are installed in the right-of-way. If the city is required to do any utility or
other work or repairs in a right-of-way which damages such nonstandard material s, the
homeowner shall be responsible for repairs necessary to the material s.
(c) Any construction within the city's rights-of-way shall not adversely affect or r es trict publi c
parking in the rights-of-way.
(d) No parking aprons shall be allowed in the city's rights-of-way along arterial (throug h) streets
listed in city Code subsection 21-17(h).
(e) Any improvements in the city's rights-of-way that are not part of a driveway or sidewalk shall
be constructed of turf block or other pervious material.

(g) Maximum driveway width at the property line and through the right-of-way for duplexes on a
fifty-foot lot shall be a combined width for both driveways of twenty-four (24) fe et.
(h) Driveways that cross sidewalks. City sidewalks may not be replaced with other material s, but
must be replaced with smooth concrete left natural in color so that it matches the existing
and adjoining sidewalks.

WITNESSETH:
That the CITY does hereby grant the USER permission on a revocable basis as described herein the
right to enter upon the property of the City of Atlantic Beach for the purpose as described in the City of
Atlantic Beach Right-of-Way/Easement permit numbers noted above (copies attached).
Any facility maintained, repaired, erected, and/or installed in the exercise of the privilege granted
remains subject to relocation or removal on thirty (30) days notice by CITY to the USER, said notice to
USER shall be given by certified mail, return receipt requested, to the following address:

The depositing of said notice of cancellation in the United States mail shall constitute the notice of
cancellation and the burden is upon USER to keep the CITY informed of USER's proper address.
The USER shall promptly make any and all necessary repairs to any facility ercclcd or maintained in
the exercise of the privilege herein granted and shall at all times maintain said facility in good and safe
condition.
In the event it is necessary for the CITY or the City's approved representative or other franchised
utility to enter upon the above-described property of the CITY, the USER shall replace at the USER's
sole expense, any and all material necessarily displaced during the action of maintaining, repairing,
operating, replacing, or adding to of the utilities and facilities of the CITY or fl-anchise utility provider.
The facilities allowed by the permit shall meet the current requirements of the City Code, Building
Codes, Land Development Code, and all other land use and code requirements of the CITY, inclucl ing
City Code Section 19-7 (h) which states "Driveways that cross sidewalks: City sidewalks may not be
replaced with other materials, but must be replaced with smooth concrete left natural in color so that it
matches the existing and adjoining sidewalks."

The USER, prior to making any changes from the approved plans and/or method, must obtain
writlen approval from the City of Atlantic Beach, P ubli c Works Department, for sa id change. The
USER shall, at the discretion of the CITY, be requested to submit as-built drawings show in g the change
within thirty (30) days afte.r the day of completion.
This permit shall inure to the benefit of, ~nd be binding upon, the USER and their respective
successors and assigns.
USER shall meet the terms and conditions of this permit and to all' of the applicable State and CITY
laws and/or spec ific ations, to include utilities locate requirements and use limitationslrequirelnents of
public rights-of-way and other public land. USER further agrees that the CITY and its office rs and
employees shall be saved harmless by the USER from any of the work herein under the terms of this
permit and that all of said liabilities are hereby assumed by the USER.
