Reeves 3-13-17Request for a use-by-exception as permitted by Section 24-63, to allow a limited wholesale operation, not involving industrial products or processes or the manufacturing of products of any kind as listed in Section 24-111(c)(5) in the Commercial General zoning district at 1475 Main Street. 17-UBEX-333 Site Context and Detail Commercial General (CG) Zoning District. Site Context and Detail Commercial (CM) Future Land Use. Site Context and Detail Proposed Business Build a 12,000 sq. ft. building to house the wholesale distribution aspect of the larger business as an electric vehicle dealer. Would be bringing electric vehicles to the site and fitting them to customer specs with accessories and shipping them out together. Clients would be larger entities ordering multiple vehicles at a time. *Site plan has not been reviewed or approved by staff and may change. Need for a Use-By -Exception Section 24-111(c)(5) lists the following as requiring a use-by- exception, “limited wholesale operation, not involving industrial products or processes or the manufacturing of products of any kind”. Relevant Code Sections All new construction means a lot is to be considered before permitting. Section 24-154(c) requires all activities to be conducted inside. Analysis and Concerns Comprehensive Plan Policy A.1.11.1 “These areas shall include those businesses that provide retail goods and services, which serve the routine and daily needs of residents, including banks and professional services, grocery and convenience stores, restaurants, accredited public and private schools and child care, but not including manufacturing, warehousing, storage or high intensity commercial activates of a regional nature, or uses that have the potential for negative impact to surrounding properties due to excessive noise, light or extremely late hours of operation.” Analysis and Concerns Single-family and two-family residential uses located 170 feet to the south. This strip of CG zoning acts as a buffer between the residential zoning district to the south and the light industrial district to the north. This area should not be an extension of industrial uses. In the past, other elements of this business have been considered automotive in nature. 2 UBEXs for auto sales at other locations “Limited wholesale operation” should consider electric vehicles as products and not as vehicles that would require a UBEX for auto sales. Community Development Board February 21st 2017-unanimous vote to recommend approval with the following conditions: 1. That there be no driveway access on Levy Road, 2. That the wholesale operation be limited to electric vehicles and associated parts and/or accessories, and 3. That all product, including electric vehicles, be stored inside a fully enclosed building at all times, except while actively loading or unloading trucks. Access and Traffic Concerns Levy Road is stripped meaning that trucks have to cross into oncoming traffic. Limit of 20 foot driveway width restricts turn radius of large trucks. Lot is 204 feet wide. A turn radius of 50 feet would a ¼ of site to be dedicated to movement. Improvements to Levy Raod. Action to be Taken To approve 17-UBEX-333 with the following conditions; 1.) That there be no driveway access on Levy Road, 2.) That the wholesale operation be limited to electric vehicles and associated parts and/or accessories, and 3.) That all product, including electric vehicles, be stored inside a fully enclosed building at all times, except while actively loading or unloading trucks. Or To deny 17-UBEX-333.
