Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, NOVEMBER 10, 1975 AT 8: 00 P. M. PRESENT: William S. Howell, Mayor-Commissioner James E. Mhoon Alan C. Jensen Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: L. W. Minton, Jr. The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Cook followed by the pledge to the flag. Commissioner Mhoon corrected the minutes of November 4, 1975 wherein the Property Fund Account is to be administered by the City Clerk. The minutes of the meeting of November 4, 1975 were approved as written upon a motion by Commissioner Mhoon, seconded by Commissioner Cook and carried. Fletcher Junior High School Band The Fletcher Junior High School Band requested an ad in the amount of $35.00 for the band program book. It was moved by Commissioner Mhoon, seconded by Commissioner Cook and carried that an ad be placed in the Fletcher Junior High School Band Program in the amount of $35.00 to be taken from Account 209 Advertising . Sal de Martini - Realtor Mayor Howell stated that the city has a request from Sal de Martini to rezone Lot 20 Club Manor Subdivision to multi-family. As no one appeared to speak for Mr. de Martini, Mayor Howell suggested that this item be passed over until the next meeting. There were no ob- jections from the City Commission. Oscar Rawls - Drainage Outfalls Mr. Vogel stated that this pertains to a letter from the Department of Natural Resources concerning drainage outlets now passing through the existing seawalls. The City Commission needs to pass a resolution authorizing the work and holding the State harmless from any future litigation which might arise as a result of the work undertaken. MINUTES NOVEMBER 10, 1975 PAGE TWO He suggested that the commission go ahead and pass the resolution even though it may never be effective. The city will probably find another method cf getting rid of drainage water. Resolution Noo 75-22 authorizing the work to commence on the drainage outlets passing through the existing seawalls in Atlantic Beach and holding the State harmless from any future litigation which might arise as a result of the work was presented by Mayor Howell . Commissioner Mhoon moved that Resolution Noo 75-22 be adopted, seconded by Commissioner Cook and carried. Copy of said resolution is attached hereto and made a part hereof. Higley Publishing Corporation - Ordinance No. 65-75-6 Final Reading Mayor Howell read Ordinance No. 65-75-6 closing, vacating, and abandoning those certain streets known as Circle Street and Palm Avenue between Plaza and Seminole Road cn third and final reading. Said ordinance was posted in line with charter requirements. Mayor Howell then declared the meeting in session for a Public Hearing. As no one wishto speak either for or against said ordinance, Mayor Howell then declared the Public Hearing closed. It was moved by Commission Cook, seconded by Commissioner Mhoon and carried that Ordinance No. 65-75-6 be passed on third and final reading . During discussion, Oliver Ball stated that perhaps the ordinance should be amended to include, under Section II, that the property be conveyed by a warranty deed. Mr. Pete Johnson, attorney for Higley Publish- ing Company, stated that they would be happy to warrant the property that they now own but on the street closure, a quick claim deed is all that is necessary. A substitute motion was made by Commissioner Cook, seconded by Commissioner Mhoon and carried that Ordinance No. 65-75-6 read as follows under Section II . . . "subject to the conditions that Higley Publishing Company convey by War ,,.nty Dee=lto the City of Atlantic Beach; in paragraph 4, Section II add . e " ie claim deed." Daisy Grant - Child care - Royal Palms � v The commission has a request from Mrs . Daisy Grant for a permit to operate a day nursery at 826 Amberjack Lane. Mayor Howell stated that in the past, the City Commission requires a petition signed by the neighborhood within a 200 foot radius. Mrs. Grant has not pro- vided the commission with this petition. It was moved by Commissioner Mhoon, seconded by Commissioner Jensen and carried that this request be returned to Mrs. Grant advising her thatthe request is incom- plete. Chandler - 511 Levy Road, Addition to Commercial Property Mr. Vogel submitted plans to the commission for an addition tc a building located at 511 Levy Road. The plans meet the Southern Standard Building Code and all zoning for the City of Atlantic Beach. It was moved by Commissioner Cook, seconded by Commissioner Mhocn and carried that this request for an addition to 511 Levy Read be approved. Scientific Engineering Company, Inc. Re Incinerator Mr. Perry Penland, representing Scientific Engineering Company, pre- sented to the City Commission drawings and specifications for a Volume Reduction Plant , He stated that this particular Volume Re- duction Plant, or incinerator, has been tested by various ecological agencies. Mr. Penland explained how the incinerator will function and dispose of the garbage. Commissioner Mhoon asked if this in- cinerator was approved by the Federal Pollution Board? Mr. Penland stated that the federal agencies ran test on the incinerator and it burned below the federal standards. Several other questions were asked by Commissioner Mhoon. A question and answer period followed between Mr. Parks, City Engineer, and Mr. Penland concerning the volume of water that would circulate through the incinerator. Mayor Howell stated that he had briefly glanced over the plans and finds that the plans call for a trailer-office. He stated that no trailers were allowed in Atlantic Beach except in trailer parks . Also, the plans show a septic tank. Sewer is available to this particular location. Mr. Howell stated that he did not think Levy Road could handle heavy trucks . He personally did not like the thought of the storage area not being enclosed. After lengthly discussion, Mayor Howell stated that the city commission could not take any action on these plans tonight as they were incomplete. There were no objections that this item be passed over until a later date. There being no further business, Mayor Howell ed the meeting adjourned. Gloria June Knight, City Clerk RESOLUTION NO . 75-22 WHEREAS, the City of Atlantic Beach recognizes the need for modifying the three drainage outlets now passing through the existing seawalls in Atlantic Beach, Florida, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA That, when work commences the City of Atlantic Beach, Florida will hold the State of Florida harmless from any liability which might arise as a result of the work under- taken. * * * * * * * * * * * * * * * Adopted by the City Commission of the City of Atlantic Beach, Florida, this 10th day of November, 1975. (Seal) ATTEST: Gloria June Knight `� City Clerk ORDINANCE NO. 65-75-6 CLOSING, VACATING, AND ABANDONING THOSE CERTAIN STREETS KNOWN AS CIRCLE STREET AND PALM AVENUE BETWEEN THE PLAZA AND SEMINOLE ROAD (ALSO KNOWN , AS SALTAIR BOULEVARD) , AND THE SOUTHERLY 150 FEET OF CYPRESS STREET, ATLANTIC BEACH, FLORIDA. WHEREAS, the City Commission of the City of Atlantic Beach, Florida, sitting in regular public session has deter- mined that the following portions of Circle Street, Palm Avenue, and Cypress Street within the bounds of the City of Atlantic Beach, Florida are of no benefit to the City of Atlantic Beach, Florida for any public purpose present or future, and WllER.EAS, the closing, vacating , and abandoning of said streets, on the conditions set forth in this Ordinance, is in the best interest of the City of Atlantic Beach, Florida, WHEREAS, the City of Atlantic Beach owns all of the property abutting Circle Street and Palm Avenue on the North and East, and WHEREAS, all other property owners abutting said streets have consented to the closing, vacating, and abandoning of same . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: Section 1. The portions of the streets to be closed, vacated and abandoned are more particularly described as that piece, section, or tract of land. lying, and being in the City of Atlantic Beach, County of Duval, State of Florida, to-wit: Circle Street and Palrn Avenue between the Plaza and Sa.ltair. Boulevard (now Seminole Road) as shown on the Plat of Section Vo. 2 , `'altair, as recorded in Plat Book 10, Page 15, public records of Duval County, Florida, and the Southerly 150 feet of Cypress Street, abutting lots 577 , 578 and 579 as shown on the Plat of Section No. 1 , Saltair, as recorded in Flat Book 10 , Page 8 , public rec- ords of Duval County, Florida.
