The meeting was called tc order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Fogg, followed by the
pledge to the flag.
The minutes of the meeting of September 2.2, 1975 were approved as
written upon a motion by Commissioner Fogg, seconded by Com-
missioner Rosborough and carried.
Selection of Member for Advisory Planning Board
Mayor Howell stated that Mr. Robert Wardrep, Chairman of the
Advisory Planning Board, asked that the City Commission withold
the appointment at this time. The board will present recommenda-
tions to the City Commission for consideration. Mayor Howell
stated that if there were no objections, Item 6A will be passed
over until the next meeting. There were no objections from the
City Commission.
Ordinance No. 95-74-14 - Disposal of Unclaimed Property
Mayor Howell read Ordinance No. 95-75-14 providing for the sale,
destruction or disposal of unclaimed or confiscated personal
property on third and final reading. Said ordinance was posted
in line with charter requirements. Mayor Howell then declared
the meeting in session for a Public Hearing.
Mr. Walter Parks wanted clarification on the destruction of drugs
and drug implements. Mayor Howell stated that a written request
must come from the Chief of Police, then the Municipal Judge orders
the destruction.

Commissioner Fogg asked about Section 8 -- "all confiscated drugs
and drug implements will be destroyed within thirty (30) days after
seizure" . The Chief of Police stated that this ordinance was
drafted following the model ordinance used throughout the State of
Florida. The thirty days is based cn giving the department time to
do the necessary work before closing the case and then at that
point, the Police Department will destroy the drugs and/or imple-
ments. Chief Stucki stated that previously the Board of Public
Health destroyed the drugs, but it has new been delegated back to
the arresting agency. The city needs thi,D ordinance because the
Police Department presently has thousands cf dollars worth cf
drugs on cur premises. As no one else wish to speak either for
or against said ordinance, Mayor Howell declared the Public Hearing
closed.
Commissioner Fogg moved, seconded by Commissioner Rosborough and
carried that Ordinance No. 95-75-14 be passed on third and final
reading amending Section 8 to read as follows "All confiscated
drugs and drug implements will be destroyed within thirty (30) days
after seizure, or as soon thereafter as practical, upon written
request of the Chief of Police and upon order of the Municipal
Judge,
Building Alteration - A Nice Place - 469 Atlantic Blvd,
Mr. Vogel presented plans to the City Commission for an addition
to A Nice Place. The City Manager stated that he had not reviewed
the parking facilities but assured the City Commission that it
would be adequate before a building permit was issued. It was
moved by Commissioner Cook, seconded by Commissioner Rosborough
and carried that the addition to 469 Atlantic Blvd, be approved;
subject to the proper amount of off-street parking as required by
ordinance, approval of the Hotel and Restaurant Commission and
meeting the Southern Standard Building Code,
Higley Publishing Corporation - Saltair Subdivision
Mayor Howell stated that several years ago the City cf Atlantic
Beach returned tc acreage a certain number of lots in the Saltair
Subdivision which are on the South and West of Russell Park, In
that area, there still exist a dedicated city street. Mr. Pete
Johnson, representing Robert M. Angas & Associates, is making
application for the Higley Publishing Corp, to close Circle Street
and Palm Avenue between Plaza and Seminole Read and the Southerly
150 feet of Cypress Street.

Mayor Howell stated that if the City Commission approves this
closing, the city will be abandoning approximately 30,000 square
feet. He stated that the City Commission might agree with the
overall plan and that opening of this street might not be con-
ducive or help any of the citizens, but to abandon that much pro-
perty will take considerable more thought and study. He suggested
that the owners discuss the possibility of deeding tc the city
the three lots that back up to the ball park. Mr. Johnson requested
that this application be passed over at this time until the de-
cision could be reach as tc what is the most econmical way to deve-
lop this area. It was moved by Commissioner Rosborough, seconded
by Commissioner Cook and carried that this request be passed over
until the next meeting.
Chief of Police
Chief Stucki requested permission to purchase a copier in the
amount of $895 .00. He stated that he is no longer able to purchase
supplies for his old machine. It was moved by Commissioner Cook,
seconded by Commissioner Fogg and carried that this request be
granted.
Director cf Public Works
Mr. Hilliard stated that in August he had sent Buccaneer Trailer
Park, 2200 Mayport Road, a letter notifying them that ground water
was coming into the sewer system from the trailer park. To date,
he has not heard from the owners how they intend to correct this
situation. He requested that the City Attorney find out what
course of action can be taken. Mayor Howell instructed the City
Attorney to get together with Mr. Hilliard about this problem.
Mr. Hilliard also requested approval to pay for repairing the
transmission on a garbage truck. The amount of the bill is $750.00.
It was moved by Commissioner Cook, seconded by Commissioner Minton
and carried that the payment for the repairs be approved.
Mr. Hilliard stated that he received a number of complaints about
drainage in the last few weeks due to the heavy rainfall. The
problem seems to be at the north end of the lagoon.

There is a 16" drain pipe behind the dam. In order to alleviate
this problem the city needs tc install a 72" wide low head pipe
at the same flow line as the top of the dame The approximate
cost will be about $820.00 for the pipe. Mr. Hilliard stated that
he would also need Mr. George Bull ' s permission to install the
pipe. It was moved by Commissioner Rosborough, seccnded by Com-
missioner Minton and carried that this request to spend approxi-
mately $820.00 be approved.
Commissioner Cook
Commissioner Cook stated that that since today is the 200th
Anniversary of the U. S. Navy that the city should pass a resolut-
ion and forward it to the Ccmmanding Officer extending the city ' s
congratulations and best wishes for 200 more years. It was moved
by Commissioner Ccok, seconded by Commissioner Rosborough and
carried that Resolution No. 75-11 be adopted. (Copy of said
resolution is attached hereto and made a part hereof.)
There being no further business, Mayor Howell declared the meeting
adjourned.
