CITY HALL ON TUESDAY, OCTOBER 7 , 1975, AT 8:00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell,
and immediately went into session as a Canvassing Board to receive
the Certificate of Results from the Election Officials covering
the Primary Election of City Officials for Commission Seat No.1,
Seat No. 2 and Seat No. 3. Copies of the Certificate of Results
of the Primary of October 7, 1975 were presented to the Board by
Mayor Howell and the City Clerk.
Mayor Howell presented Resolution No. 75-15 certifying the results
of the Primary Election of the City of Atlantic Beach, Florida,
held Tuesday, October 7 , 1975. Commissioner Fogg moved for
adoption of Resolution No. 75-15, seconded by Commissioner Cook
and carried. (Copy of Resolution No. 75-15 is attached hereto and
made a part hereof)
Mayor Howell stated that the results have now been certified. There
will be a run-off between Mr. John J. Hines and Mr. James E. Mhoon
for Seat No. 2 on October 21, 1975 . As a result of the tie vote
between Mr. Robert F. Price and Mrs. Adelaide C. Kirkpatrick for
Seat No, 3, the City Commission can move to hold a special election
on October 14, 1975 to break the tie or, as provided by Florida
State Law, Chapter 100.091, Section 3, "in case two or more persons
shall receive an equal number of votes, such persons shall draw
lots to determine who shall receive the nomination. " At this time,
Mayor Howell asked Mrs. Kirkpatrick and Mr. Price if they wanted
to draw lots? Both candidates refused to draw lots .
Commissioner Rosborough moved that an emergency ordinance be passed
to have a special election on October 14, 1975 between Mrs.
Adelaide C. Kirkpatrick and Mr. Robert F. Price for the decision of
the run-off for Seat No. 3; the winner in said election to be the
candidate in the run-off for Seat No. 3 against Mr. Alan C. Jensen.
The motion was seconded by Commissioner Cook and carried.

Ordinance No. 33-75-3 providing for a special election October
14, 1975, between Adelaide Kirkpatrick and Robert Price for the
decision of the run-off for Seat No. 3; the winner in said election
to be the candidate in the General Election on October 21, 1975,
Seat No. 3 against Alan C Jensen was read by Mayor Howell on first
reading. Commissioner Minton moved for passage of Ordinance No.
33-75-3 on emergency, seconded by Commissioner Fogg and carried.

Ordinance No. 33-75-3 providing for a special election October
14, 1975, between Adelaide Kirkpatrick and Robert Price for the
decision of the run-off for Seat No. 3; the winner in said election
to be the candidate in the General Election on October 21, 1975,
Seat No. 3 against Alan Ce Jensen was read by Mayor Howell on
second reading . Commissioner Cook moved for passage of Ordinance
No. 33-75-3 on emergency, seconded Commissioner Minton and carried.
Ordinance Noo 33-75-3 Special Election - Final Reading - Public
Hearing
Ordinance No. 33-75-3 providing for a special election October
14, 1975, between Adelaide Kirkpatrick and Robert Price for the
decision of the run-off for Seat No. 3; the winner in said election
to be the candidate in the General Election on October 21, 1975,
Seat No. 3 against Alan C. Jensen was read on third and final read-
ing by Mayor Howell. He then declared the meeting in session for a
public hearing. As no one appeared either for or against said
ordinance, Mayor Howell declared the public hearing closed. Com-
missioner Cook moved for passage of Ordinance No. 33-75-3 on emer-
gency on third and final reading, seconded by Commissioner Minton
and carried.

Resolution No. 75-16
Mayor Howell presented Resolution No. 75-16 certifying the results
of the Primary Election of the City of Atlantic Beach, Florida
held Tuesday, October 7, 1975. Commissioner Rosborough moved for
adoption of Resolution Noe 75-16, seconded by Commissioner Minton
and carried. (Copy of Resolution No, 75-16 is attached hereto and
made a part hereof.
There being no further business, Mayor Howell declared the meeting
adjourned.

voted that said returns be accepted as reported and
That it is hereby found and determined by the City Commission of
Atlantic Beach, Florida, acting in the capacity of a Canvassing
Board that the qualified voters who participated in said Primary
Election cast their votes in favor of the following candidates
as follows:

SEAT NO. 2, COMMISSIONER, Run-off General Election October 21,
