Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 22, 1975, AT 5: 00 P . M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. Robert R. Rosborough, II F . W. Fogg Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag . The minutes of the meeting of September 8, 1975 was approved as written upon a motion by Commissioner Minton, seconded by Com- missioner Cook and carried. Correspondence - Harold E. Mullins - Resignation Mayor Howell stated that the City Commission received a letter from Mr. Harold Mullins resigning from the Advisory Planning Board. It was moved by Commissioner Cook, seconded by Commissioner Minton and carried to accept Mr. Mullins ' resignation with regrets. Mayor Howell stated that a replacement for Mr. Mullins would be made at the next meeting. Ordinance No. 20-75-30 Budget 1975-76 Final Reading Mayor Howell read Ordinance No. 20-75-30 adopting the budget for the City of Atlantic Beach, Florida, for the fiscal year 1975-76 on third and final reading. Said ordinance was posted in line with charter requirements. Mayor Howell then declared the meeting in session for a public hearing . As no one appeared either for or against said ordinance, Mayor Howell declared the nmmblic ho .ri a closed. Commissioner Fogg moved for passage of Ordinance No. 20- 75-30 on third and final reading, seconded by Commissioner Ros- borough and carried. Ordinance No . 10-75-12 C.O .P. License for Letizia' s Restaurant Final Reading Mayor Howell read Ordinance No. 10-75-12 regulating hours for the sale of alcoholic and intoxicating beverages in t - City of At- lantic Beach on third and final reading. MINUTES SEPTEMBER 22, 1975 PAGE TWO Said ordinance was posted in line with charter requirements. Mayor Howell then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, Mayor Howell declared the public hearing closed. Commissioner Rosborough asked what were the percentage of alcoholic beverage sales as com- pared to the sale of food? Mayor Howell stated that this is con- trolled by the state and that they must maintain a certain percen- tage of food sales as opposed to the alcoholic beverages. If they do not maintain their percentage, the alcoholic beverage license is revoked. Mr. Vogel stated that the question was raised about off- street parking at this location during the last meeting . Mrs. Letizia has furnished the city with a scale drawing showing that the restaurant is more than adequately covered. Mayor Howell stated that Ordinance No. 10-75-12 only allows the sale of alcoholic beverages at this location as long as Mrs. Letizia can meet all the other requirements of the State of Florida and the City of Atlantic Beach. The motion carried. Ordinance No. 95-75-14 Disposal of Unclaimed Property Mayor Howell read Ordinance No. 95-75-14 providing for the sale, destruction or disposal of unclaimed or confiscated personal pro- perty on second reading by title only. Said ordinance was pre- sented in full, in writing. Commissioner Rosborough moved that Ordinance No. 95-75-14 be approved on second reading by title only, seconded by Commissioner Minton and carried. Public hearing to be held October 13, 1975 . Resolution No . 75-14 Budget Transfer 1974-75 Mayor Howell presented Resolution No. 75-14, changes in the 1974-75 budget. Commissioner Fogg moved that Resolution No. 75-14 be a- dopted. The motion was seconded by Commissioner Minton and carried. 97 Levy Road - Additional Building to Mini Warehouses Mr. Vogel presented plans for additional miniwarehouses located at 97 Levy Road. Mr. Vogel stated that in connection with the plana he is going to require that they show the 64 off-street parking spaces required. It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that the additional warehouses be approved if the plans meet all the requirements of the City of Atlantic Beach; subject to their having 64 paved off-street parking spaces. ATTEST: (Seal) Ol-)6r/Z62" Gloria Jun Knight City Clerk i !ORDIN4NCE NO. 10-75-12 AN ORDINANCE REGULATING HOURS FOR THE SALE OF ALCOHOLIO AND INTOXICATING BEVERAGES IN THE CITY OF ';ATLANTIC BEACH, FLORIDA; RE- STRICTING TILE LOCATION WHEREIN A VENDOR OF ALCOHOLIC BEVERAGES SHALL BE PERMITTED TO CONDUCT HIS 'PLACE OF BUSINESS; FIXING THE MINIMUM VOLUME OF LIGHT TO BE MAINTAINED AND REQUIRING THE SAME TO BE MAINTAINED UPON THE PREMISES OF EACH VENDOR LICENSED TO SELL ALCOHOLIC BEVERAGES; PROHIBITING UNNECESSARY AND UNUSUAL NOISES AND REGULATING THE USE OF PUBLIC ADDRESS AND LOUD SPEAKER EQUIPMENT; AND REPEALING ORDINANCE NUMBERS 10-59-6, 10-59-7, and 177 . BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION I . That the Code of the City of Atlantic Beach and Ordinance 10-61-8 is hereby amended by adding : Sec. 3-3 . Alcoholic Beverages G. The premises commonly known as Letizia's Italian Restaurant so long as the sale for consumption on premises of alcoholic beverages is incidental to the sale of food.
