Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, AUGUST 25, 1975, AT 8: 00 P . M. PRESENT: William S . Howell, Mayor-Commissioner L. W. Vogel, City Manager Oliver Ce Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howells The invocation was given by Commissioner Minton, followed by the pledge to the flag . The minutes of the meeting of August 11, 1975 were approved as written upon a motion by Commissioner Fogg, seconded by Commissioner Rosborough and carried. Recognition of Visitors Claire McClary, Sailfish Drive, presented to the city commission a plaque in appreciation for furnishing lights and umpires at Jack Russell Park for the girls softball teams in Atlantic Beach. Milo Smith and Associates Mayor Howell stated that with the permission of the city commission, he would like to introduce Mr. Albright of Milo Smith and Associates. Mr. Albright is scheduled later on but because of transportation problems he would like to be moved up on the agenda. There were no objections from the city commission. Mr. Vogel introduced members of the Advisory Planing Board to Mr. Albright . Mr. Albright stated that the 701 Program is a federally funded program through Comprehensive Planing. The plan considers three general questions about a community and provides methods for answering these questions. 1. What presently exist in the com- munity? 2. Where does the community desire to progress? 3. How will the community attain their goals? MINUTES AUGUST 25, 1975 PAGE TWO The Comprehensive Plan provides the methods for answering these question by (1) obtaining the necessary information about the existing future characteristics of the community through Basic Re- search and Analysis (2) by developing Comprehensive Plan Elements to guide the community in the direction it wishes to progress and (3) by providing methods for achieving the desired goals through Im- plementation of the Comprehensive Plan. The plan affects all the residents in Atlantic Beach. Mr. Wardrep, Chairman of the Planing Board, asked what the time schedule was for this plan? Mr. Albright stated that Milo Smith and Associates have already started and will have one year to complete the plan. Correspondence Mr. Vogel read a letter from Mrs. Edna Klussner, 342 11th Street, commending the Public Works Department on the improvements made at the foot of 11th Street. Mr. Vogel stated that he had also received a letter from the Department of Housing and Urban Development, Washington, D. C. complimenting the City of Atlantic Beach for taking steps to pass Ordinance No. 25-35-11 concerning the Flood Plan program. Walter Eleazer Reg Lots 283 - 284 Saltair Mr. Walter Eleazer, Jacksonville, stated that he represented his son, owner of Lots 283 and 284 Saltair. He stated that the reason for appearing before the city commission is in regards to sewer, water and garbage to Lots 283 and 284. He proposes to build a home on Lot 283 and had been told by Mr. Hilliard, Director of Public Works, that he would have to pay for a down stream pollution charge and also for a manhole, in the amount of $850.00 . Mr. Eleazer also stated that he had been told that the quarterly rates for water, sewer and garbage is $22 . 50 but that the city would be un- able to collect the garbage due to the fact that the road is not paved and the city trucks are unable to get to the property on the existing road. He feels as though he should have some relief in paying for garbage service when it does not exist. Also, he feels the manhole charge is unneccesary . Mr. Hilliard stated that the road is too narrow for the city ' s garbage trucks. He stated that this question came up about six months ago regarding people building on undeveloped land where the roads are not paved. The city cannot properly service these people with emergency fire, police or garbage pickup. MINUTES AUGUST 25, 1975 PAGE THREE Mr. Eleazer stated that he signed a paper at City Hall three: moths ago in which he agreed to pay for sewer and water and then Mr. Hilliard told him he would have to build a manhole for the sewer on Lot 283 . Commissioner Rosborough asked if there was a manhole in the area? Mr. Hilliard stated that there is a manhole there but where the problem exist is that it is located 11 or 12 feet deep and that it will cost approximately $850.00 to construct laterals to take care of the sewage. Mr. Eleazer stated that he had recently had the property re-surveyed and re-platted and that he was willing to pay the cost of the sewer and water lines, but not the manhole. Mayor Howell stated that, theoretically, Mr. Eleazer could build a house tomorrow so far as the sewer and water is concerned and hook up to the existing manhole, but since the property has been re-platted it will require an additional line running into the manhold. It appears that there is no great problem on the sewer and water if Mr. Eleazer wants to pay for it. As for the garbage, if the city cannot send a truck to the property, the owner will not be billed for that service. Mr. Eleazer stated that he wanted to know what it would take to get started on furnishing him with sewer and water. Mayor Howell stated that the city will have to determine exactly what the cost will be. It was moved by Commissioner Cook, seconded by Com- missioner Rosborough and carried to call for bids and present the bid to Mra Eleazer and as soon as he deposits the entire amount with the city the work will begin. Mr. Eleazer also requested that a variance be granted on the rear and side line requirements. If a variance is not granted, then the property should never have been zoned or sold for residential use. Mayor Howell stated that the set back and side lines have been established for many years and that if a variance is requested then Mr. Eleazer must first appear before the Advisory Planing Board for recommendations to the city commission. Close Selva Marina Drive, 1633 to 1647 , 4 to 8 P . M. August 30, 1975 The city has a request from a number of people on Selva Marina Drive in the 1600 block to close the east lane on August 1, from 4J00 to 8g00 for the purpose of a "block party" . It was moved by Com- missioner Rosborough, seconded by Commissioner Cook and carried that this request be granted. MINUTES AUGUST 25, 1975 PAGE FOUR Emergency Sewer Repairs Mayor Howell stated that the emergency repairs was a problem the city had on ground water getting into the sewer lines. The problem had to be corrected and it was necessary to do it promptly. The cost was $1973.48. It was moved by Commissioner Cooks, seconded by Com- missioner Rosborough and carried to pay $1973.48 to Jax Utilities Construction Company from Account 2054. Ordinance to Permit C.O.P. License for Letizia' s Restaurant Mayor Howell read Ordinance No. 10-75-12 regulating hours for the sale of alcoholic and intoxicating beverages in the City of Atlantic Beach on first reading by title only. Said ordinance was presented in full and in writing. Ccmmissioner Rosborough moved that Or- dinance No. 10-75-12 be approved on first reading by title only, seconded by Commissioner Cook and carried. Ordinance No. 20-75-30 Adopting the Budget 1975-76 Mayor Howell read Ordinance No. 20-75-30 adopting the budget for the City of Atlantic Beach, for the fiscal year 1975-76 on first reading by title only. Said ordinance was presented in full, in writing. Commissioner Rosborough moved that Ordinance No. 20-75- 30 be approved on first reading by title only, seconded by Com- missioner Rosborough and carried. Director of Public Works Mr. Hilliard wanted to know what to do about the sewer tap on Lots 283-284 Saltair? Mayor Howell stated that if Mr. Eleazer wanted a sewer tap, the city must have a firm price and the money be de- posited with the city before a contract can be awarded. City Manager Mr. Vogel stated that he and Mayor Howell attended the Technical Advisory Committee meeting in Jacksonville Beach. Mayor Howell was unanimously elected chairman. Mayor Craig was elected vice-chairman and Bob Gordon was elected secretary. This committee is being es- tablished for the purpose of planing the proposal of the final effluence for the area east of the intra-coastal waterway. This committee was formed by resolution from the City of Jacksonville Beach, Neptune Beach and the City of Atlantic Beach. MINUTES AUGUST 25, 1975 PAGE FIVE Mayor Howell stated that the committee appointed Jacksonville Beach to be the "lead" or applicant city. The Technical Advisory Committee recommended, through the City of Jacksonville Beach, that the firm of Smith and Gillespie be appointed as engineers for the pro- ject. The Technical Advisory Committee is governed by the three city commissions. The first step is the application to the Environ- mental Protection Agency for government funds to commence the plan- ing study to determine what the three cities are going to do with the effluent from the various sewer plants. The committee also decided that the initial cost of this will be handled on a popula- tion basis of the three cities. The cost of submitting the appli- cation will be approximately $5,000.00. As far as Atlantic Beach is concerned, it will cost approximately $1500.00. This is based on the lastest official population census made by the University of Florida The committee has also requested that Mayport Naval Station appoint a reporsentative to the Technical Advisory Committee because of the Navy Station sewer treatment plant and an additional 400 units just north of the city limits that are being proposed. Mayor Howell stated that the city commission needsto meet as a committee as a whole to discuss all phases of the budget other than payroll. The meeting is scheduled for Thursday, August 28, at 7 : 30 P . M.
