City Manager 11. Commissioners 12. Mayor 13. Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JULY 14, 1975, AT 8:00 P . M. PRESENT: William S. Howell, Mayor-Commissioner L . W. Minton, Jr. Robert R. Rosborough, II F . W. Fogg Robert B . Cook, Sr , , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of June 23, 1975, were approved as written upon a motion by Commissioner Fogg, seconded by Commissioner Minton and carried. Ordinance No. 65-75-5 Street Closing - Final Reading Ordinance No. 65-75-5 closing, vacating, and abandoning a portion of that certain street known as Main Street was presented in full and read on third and final reading by Mayor Howell . Said ordinance was posted in line with charter requirements. He then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, Mayor Howell declared the public hearing closed. Commissioner Fogg moved for passage of Ordinance No. 65-75-5 on third and final reading, seconded by Commissioner Rosborough and carried. Request from James R. Patten Mr. Vogel stated that the city has a request from Mr. James Patten for a variance in zoning to permit a double wide mobile home on Lots 1-6, Block 231, Section H. Mr. Patten stated that prior to purchasing the above mentioned property, he came to city hall and asked about placing a mobile home in Section H. Mr. Vogel assured him that it could be done but that it would have to come before the city commission. MINUTES JULY 4, 1975 PAGE TWO Mr. Vogel stated that at the time of Mr. Patten' s request it was the policy of the city commission to consider each request separately and each request would be placed under the P .U.D. ordinance; each one approved or disapproved on its own merit. Since that time, the city commission has stopped all mobile homes in Atlantic Beach ex- cept in mobile home parks. Mayor Howell stated that mobile homes do not meet the Southern Standard Building Code and therefore are in violation of the city code. Mr. James Adams, Skyline Mobile Homes, Atlantic Beach, presented to the city commission samples of the interior of the mobile home Mr. Patten plans to purchase. He stated that the mobile home meets the FHA requirements. Mayor Howell suggested that Mr. Patten and Mr. Adams find out the criterior of the Southern Standard Building Code as opposed to what specifica- tions are available for mobile homes and take it from that point. Mr. Hilliard stated that if Mr. Adams would send his plans to the Southern Standard Building Code office, they will approve or deny them. Mayor Howell stated that at this time there is nothing the city commission can do about this request except to deny it. There were no objections from the city commission City Manager Mr. Vogel stated that in the original plans for Ocean Village One, North Atlantic Beach, the plans called for metering the water through a single meter. In the process of developing the property, the owners decided to put in individual meters for each condominium. This took commission action to change the plans from what Mr. Parks had originally planned. Now, Mr. Parks has received an inquiry from Mr. George C. Dickerson, court appointed receiver for Ocean Village One, about the feasibility of converting back to a single meter. In the conclusion of Mr. Parks ' letter he said to please advise him if the city would consider permitting the removal of the existing individual meters, subsequent to the installation of a new four inch compound meter, all at the owners expense in accordance with the city ' s requirements. Also, what credit -"he city might allow the owners for meters, yokes and meter boxes delivered to the city in good usable condition? Commissioner Rosborough stated that if a single meter is put into this complex and if the owner does not pay the water bill, the city will have the same problem that exist with Place by the Sea. The city will be unable to cut off the water or collect the money. MINUTES JULY 14, 1975 PAGE THREE Mr. Parks stated that in his opinion to go ahead at this point and try to make a switch to the master meter would actually be more expensive to the receiver. Mayor Howell asked if the receiver is going to continue selling these condominiums, what possible advantage would they have by placing a single meter at the complex? Mr. Parks stated that in development of apartment projects and condominium projects, there is a possibility of accuring revenue, especially from apartments, be- fore the construction loan is closed and the project is put under a permanent mortage. Apartment rental money that you can take in between the two is clear money. Now, as things like this normally go, if it should become difficult to sell condominiums at prices that have been established for such units and unless there is some- thing that is prohibitary in the construction mortage or some other agreement, there is nothing to keep some of those units from being rented to bring in revenue. Mr. Vogel recommended that this request be denied. Commissioner Rosborough stated that he is diametrically opposed to changing the meters to a single meter. Commissioner Minton moved that this request be denied. He stated that his motion was made with prejudice. The motion was seconded by Commissioner Fogg and carried. Mayor Howell Mayor Howell stated that the city commission received a letter from Mr. Parks pertinent to our discussion of the meeting of June 30th, 1975. He suggested that the commission accept the report and dis- cuss it at the next meeting. It was moved by Commissioner Cook, seconded by Commissioner Minton and carried that the report be accepted and discussed at the next meeting. Commissioner Fogg Commissioner Fogg stated that in reference to the request from Mr. Patten he requested that the city manager be instructed not to place any more request for mobile homes on the agenda. Commissioner Cook Commissioner Cook commended Mr. Hilliard for the progress made on the parking lot at city hall. MINUTES JULY 14, 1975 PAGE FOUR Mayor Howell Mayor Howell reported that he and the Chief of Police are meeting June 15, 1975, with representatives from the telephone company to discuss the proposed 911 emergency dialing system.
