Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JANUARY 13, 1975, AT 8:00 P. M. PRESENT: William S. Howell, Mayor-Commissioner L . W. Minton, Jr. Robert R. Rosborough, II F. W. Fogg, Commissioners AND R. C. Vogel, City Manager Oliver C . Ball, City Attorney Gloria June Knight, City Clerk ABSENT: Robert B. Cook, Sr. , Commissioner The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of December 23, 1974 were approved as written upon a motion by Commissioner Minton, seconded by Com- missioner Rosborough and carried. Recognition of Visitors Mr. C. H. Godfrey, 1757 Park Terrace West, requested information on the status of the park located between Park Terrace West and Park Terrace East . Mayor Howell stated that the work is 95% complete in the park area. The city will soon be receiving funds from the federal government for emergency job work and the city plans to hire five or six laborers to work on this project. Mayor Howell stated that he did not think that the City of Atlantic Beach will be in a position to maintain the park as a completely cut lawn type of park. It is going to have natural growth and it will take many months to produce the desired effect. Mrs. William Koenig, 780 Redfin, asked about the land being cleared west of the Dairy Queen on Atlantic Boulevard. Mayor Howell stated that the owner had cleared the land in order to grass it . Mrs. Joe McDaniel, 375 9th Street, asked about the possibility of building a new tennis court. Mayor Howell stated that there was no money allocated in the capital fund to construct a new court but there is money to refurbish the present ones. Mrs. Paige, 920 Sailfish Drive, wanted to know the status of the citizens who are in violation of the code pertaining to off-street parking. Mr. Vogel stated that most of the citizens had complied with the letters that were sent out and that he is following up on all the people who have not complied. MINUTES PAGE TWO JANUARY 13, 1975 The Ocean State Bank - P.U .D. on Plaza Mr. Joe Gill, President of the Ocean State Bank, stated that the Board of Directors and the stockholders wish to withdraw their application for P .U.D. on a drive-in facility located on Plaza. Mayor Howell stated that Item No. 6A will be withdrawn from the agenda. Resolution No. 75-1 Mayor Howell introduced Mr. Preben Johansen, District I Councilman from the City of Jacksonville. Councilman Johansen stated that he wanted to recognize Mr. Raymond G. Houle, member of the Charter Revision Committee. At this time, Mayor Howell presented Resolu- tion No. 75-1 bestowing the title of "Honorary Citizen" to Mr. Raymond G . Houle. It was moved by Commissioner Minton, seconded by Commissioner Rosborough and carried that Resolution No. 75-1 be adopted. Copy of said resolution is attached hereto and made a part hereof. Mr. Houle expressed his appreciation for the honor and expressed the fact that it will be a never ending battle to retain our independence. Oak Harbor Subdivision Unit #3 Mayor Howell stated that the Oak Harbor Subdivision is requesting water service from the City of Atlantic Beach. Mayor Howell read a portion of a letter from the Almand Construction Company as follows: "We realize that this property is currently outside the town limits and appreciate the City of Atlantic Beach considering us for water service. If there is any possibility of having this development taken inside of the town limits by annexation we would welcome the opportunity of discussing this with the City of Atlantic Beach. " Mayor Howell stated that this request and Item No. 6C, Tore King, Inc. , are very complicated and should be discussed as a committee as a whole . There were no objections from the City Commission, The meeting will be held at 8: 00, January 14, 1975 at the City Hall. The public is invited. MINUTES PAGE THREE JANUARY 13, 1975 Appointment of Members for Fire & Police Pension Board of Trustees The following names were submitted for the Fire and Police Pension Board of Trustees: Chief Carl Stucki Officer Joseph Garvin Officer Nicholas Vander Wal Walter Rew (Fireman) Ray Miller (Fireman) Mr. James Burton Mr. R. C. Vogel It was moved by Commissioner Minton, seconded by Commissioner Rosborough and carried that the names submitted be accepted as Trustees of the Fire and Police Pension Board. C,A.T.V. - Councilman Huntley Mayor Howell stated that he had received correspondence from Councilman Huntley, City of Jacksonville, requesting that the city pass a resolution authorizing the City of Jacksonville to grant a franchise for cable television for Duval County. Mayor Howell stated that this item should be held in abeyance until the City Commission has more information. There were no objections from the City Commission. Municipal Judge The City Commission received a letter from A. H. Dunlop resigning as Municipal Judge effective January 15, 1975. It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried to accept Judge Dunlop' s resignation with regrets . Mayor Howell recommended that Mr. Charles Anderson, who has served as the alternate judge for 17 years, be given the position of Municipal Judge and that Oliver C. Ball be designated as the alter- nate Municipal Judge. He further stated that unless the state legislature is able to do something about a constitutional amend- ment on Municipal Courts they will vanish as of January 1, 1977 . Under the new law, in order to be appointed a municipal judge, you must be an attorney. It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that Mr. Charles Anderson be appointed Municipal Judge and Mr. Oliver C. Ball, Alternate Judge. MINUTES PAGE FOUR JANUARY 13, 1975 Mr. Vogel requested commission approval for an addendum to the specifications on the Additional Primary Water Pump bid in the amount of $875.00. He explained that this addendum is for an increase in the electrical service and that the bids will be taken by Mr. Parks, City Engineer. It was moved by Commissioner Minton, seconded by Commissioner Rosborough and carried that the request for $875 .00- electrical service be approved. Houle has shown continued interest in bettering the government of Duval County; 4 and WHEREAS, during his service on the Charter Revision Committee of the Consolidated City of Jacksonville he has always taken the position of total independence for the beaches, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH: THAT, it is the desire of the people of Duval County and the City of Atlantic Beach to hereby bestow the title of "HONORARY CITIZEN" to RAYMOND G .
