The invocation was given by Commissioner Minton, followed by the pledge to the flag. Approval of the minutes of February 28, 1977: Motion: That the minutes of the regular City Commission Jensen X X Meeting of February 28, 1977 be approved Minton X X as submitted. Howell X * * * * * * * * * * Report of City Manager Mr. Vogel requested Commission approval for the transfer from the General Account to the Pension Account of sufficient funds to financei obligations that have occurred, and future pension payments to City retirees , for the balance of the 1976-77 year. This money can be repaid from the 1978 budget obligations to the Pension Fund. Motion: Transfer sufficient monies to pay retired Jensen X X employees from the General Fund to the Pension Minton X X Fund. Howell X * * * * * * * * * * Unfinished Business A. R. A. Goll re State Grants for Donner and Russell Parks Mr. Goll presented a report on a new program funded this month by the State of Florida, Department of Natural Resources. This program is 100% state funded to a maximum of $50,000 for the construction of active recreational facilities . Mr. Coll suggested that an applica- tion be submitted for Donner and Russell Park areas. Filing dead- lines are 4/15/77 and 8/77. Professional service fee would be $2,400. Goll and Associates, Inc. to Jensen X X proceed with preliminary design and grant Minton X X application for the Donner Park area. Howell X * * * * * * * * * * Mr. Goll also informed the Commission the final application had been submitted this date for Coastal Plains grants funds in the amount of $50,000 for the construction of three storm water french drains along the ocean. Final funding on this program probably will be announced in August or September of this year. B. Mr. Walter Parks re E.D.A. Mr. Parks presented for Commission review the preliminary plans for the new water Pumping Station No. 2 and EDA advertisement forms for signature. He advised the Commission the specifica- tions had been submitted to the printers this date. Plans for the Saltair Subdivision will be ready for bids by Wednesday of this week. Mr. Parks explained that EDA conditions require that the project be divided in five bids, each standing on its own; new water Pumping Station No. 2, water distribution system reinforcements, paving and drainage, Saltair Subdivision- Section 3, sanitary sewer extensions, Saltair Subdivision- Section 3, and water distribution system extensions, Saltair Subdivision-Section 3. The bid documents may be examined at the City Hall, 716 Ocean Boulevard, Atlantic Beach, and the F. W. Dodge Plan Room, 3947 Boulevard Center Drive, Suite 101, Jacksonville, Florida. Copies of the bid documents may be obtain- ed at the office of Walter J. Parks , Jr. , Consulting Engineer, 2014 Arcadia Place, Jacksonville, Florida, upon payment of $20 with a refund of $10 to any unsuccessful bidder. The Commission agreed with Mr. Parks that there should be a clear understanding with the awarded bidder on Paving and Drainage, that clearing and stumping must be completed before the sanitary sewer exten- Sion contractor and the paving contractor commence their work. It was also pointed out that the concerned contractors should perform required work on the Duval County school property during the out-of-school season. Bids will be received April 11, 1977. Jordan, representing the group, requested a completion date of Donner Park' s new addition in order for the citizens to make plans for a celebration. Mayor Howell stated he had talked with Mr. Fred Mills , the contractor, about the delay which was the result of unfavorable weather during the past few months and failure of the vendor in delivering steel doors. Mayor Howell informed the audience Mr. Mills had stated a completion date two weeks hence. D. Jamboree Club Condemnation • Mr. Vogel advised the Commission he had received a telephone call from the attorney representing the 1st mortgage holders and requested the Commission stay action on the condemnation until the foreclosure could be completed. After a short discussion with Mrs . Runyon, one of the interested parties, Mayor Howell appointed Mr. Alan Jensen as a committee to confer with the City Attorney and report back at the next meet- ing with a judgement as to the course of action which should be pursued by the City. E. American National Bank re Development of Royal Palms, Unit 3 Mr. Vogel stated he had received plans from the American National Bank for a 54 apartment complex to be located immediately south of Fox Gardens Apartments. Mayor Howell stated this property is under Planned Unit Development and suggested the proposed project be sent to the Planning Board for review. Motion: American National Bank proposed project be Jensen X X sent to the Planning Board for their Minton X X consideration. Howell X * * * * * * * * * * Action on Ordinances A. Ordinance 25-77-13 Building Code AN ORDINANCE AMENDING PART OF ARTICLE III, BUILDINC CODE, SECTION 6-8. ADOPTION OF THE SOUTHERN STANDARD BUILDING CODE CURRENT EDITION. Said Ordinance was presented in full, in writing, and read on third and final reading by Mayor Howell. Said Ordinance was posted in line with charter requirements . Mayor Howell then declared the meeting in session for a public hearing. As no one spoke for or against, Mayor Howell declared the public hearing closed. Ordinance 70-77-7 - Utility Tax AN ORDINANCE IMPOSING AND LEVYING A TAX ON EACH AND EVERY PURCHASE OF ELECTRICITY, #1 (KEROSENE) , #2, AND #3 FUEL OILS (BUT NOT FUEL OILS OF LOWER GRADES. ) METERED OR BOTTLED GAS (NATURAL LIQUIFIED PETROLEUM GAS OR MANUFACTURED) WITHIN THE CORPORATE LIMITS OF THE CITY OF ATLANTIC BEACH, FLORIDA: PROVIDING FOR THE COLLECTION OF SUCH TAX: PROVIDING THAT IN EVERY CASE THE TAX SHALL BE COLLECTED FROM THE PURCHASER AND PAID BY THE PURCHASER FOR THE USE OF SAID CITY TO THE SELLER OF SUCH UTILITY SERVICE AT THE TIME OF PAYING FOR CHARGE THEREFOR TO THE SELLER: PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE: AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Said Ordinance was presented in full, in writing, and read by title only, on first reading by Mayor Howell. Motion: Said Ordinance be passed on first reading, Jensen X X by title only. Fletcher Senior High School Ad for Senator Mr. Vogel stated he had received a request from Fletcher Senior High School for a donation in the amount of $50 for The Senator. Beach Festival - City Float - $300 Mayor Howell advised the Commission that the cost of the City float, in the amount of $300, for the opening day beach parade needs Commission approval. Motion: Approve payment of $300 for City float Jensen X X for the Annual Beach Parade. Minton X X Howell X * * * * * * * * * C. Mr. Steckla re Report on Signs Mr. Steckla, City Inspector, gave an itemized report on each of the six alleged sign violations: Presbyterian Church - Kindergarden - on personal property Place By The Sea - Barnett Bank representatives indicated that the sign would be removed upon rehabil itation of the building. Fred Mills - Sign on Sherry has been removed. Cloisters - 10th St. - meets all Code requirements Sevilla - located on private property & directional Seaspray - no violations as far as the City is concer ed Mr. Steckla advised the Commission Mr. Ashurian has removed two of the signs that were in violation and suggested if the sign on Atlantic Boulevard was not removed, the City Inspector would file a complaint on behalf of the City. Commission unaminously agreed. Mayor Howell suggested a tree Ordinance be prepared for the next meeting providing that no tree on any building site be cut down or removed except in the particular area of the lot that is under our zoning regulations for a house to be built providing, however, that the building inspector may from time to time in his judgemene allow the cutting of certain trees outside of this area.
