MINUTES OF THE REGULAR COMMISSION MEETING OF THE
ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL
ON NOVEMBER 8, 1976

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton followed by the
pledge to the flag .
The minutes of the meeting of October 25, 1976, were approved as
written upon a motion by Commissioner Mhoon, seconded by Commissioner
Minton and carried.
Report of City Manager - The City Manager ' s Report is attached
hereto and made a part hereof. (File copy)
Unfinished Business - Bid Opening - Police Vehicles
Only one bid was received and opened, as follows :
Platt Pontiac, Inc. , Jacksonville, Florida -
3 police patrol cars and 1 full size 4
door station wagon $22,051.44
Alternate bid - 3 full size, 4 door sedans;
1 LeMans Safari Station Wagon 21, 552 .71
The Mayor suggested that the matter be turned over to committee
and called for a special meeting on Wednesday, November 10, 1976,
at 7 :00 P .M. to take action. It was moved, seconded by
Commissioners Minton and Mhoon and carried that the foregoing be
done.
Action on Resolutions
A. Affirmative Action Plan - Resolution 76-13 - Copies of the
City of Atlantic Beach ' s proposed Affirmative Action Plan were
mailed to the Commissioners several weeks ago for study. Mayor

Howell stated that the procedure meets the guidelines of the
Federal Government, and asked if there were any questions. Motion
was made by Commissioner Minton, seconded by Commissioner Mhoon
and carried to adopt the Affirmative Action Plan as proposed.
Said Resolution is attached hereto and made a part hereof.
B . Savings Account, General Fund - Ocean State Bank -
Resolution 76-12A Resolution 76-12A was presented and read in full
by Mayor Howell and upon a motion by Commissioner Mhoon, seconded
by Commissioner Minton, said Resolution was adopted by unanimous
vote. Said Resolution is attached hereto and made a part hereof.
Action on Ordinances - Ordinance 90-76-66 - Continued.
After a short discussion on various sections of Ordinance
90-76-66, motion was made by Commissioner Mhoon, seconded by
Commissioner Jensen, and carried to not pass said Ordinance.
A second motion was made by Commissioner Mhoon to authorize the
City Building Department to issue permits in S/M #9 for those
plans that meet the criteria as set forth in Section II thru IX
of the Covenants & Restrictions as recorded in O/R Volume 4229,
Page 199. The motion was seconded by Commissioner Minton and
carried.
B. Ordinance 90-76-67 - First Reading.
Ordinance 90-76-67 amending Chapters 28-13- (a) , 28-14- (a) , 28-15- (a)
of the Code of the City of Atlantic Beach, Florida, entitled
"Zoning" and covering the retail sale of gasoline only was
presented in full, in writing and read by title only on first
reading by Mayor Howell. Upon a motion by Commissioner Jensen,
seconded by Commissioner Minton, said Ordinance was passed on
first reading - title only and carried.
C . Ordinance 90-76-68 - First Reading .
Ordinance 90-76-68 amending Chapter 28-7- (d) of the Code of the
City of Atlantic Beach, Florida, entitled "Zoning" , covering
Side yard required, was presented in full, in writing, and read
by title only on first reading by Mayor Howell. Upon a motion
by Commissioner Jensen, seconded by Commissioner Minton, said
Ordinance was passed on first reading - title only and carried.
Miscellaneous Business
A. Sewer line extension, Sea Oats to Seminole Road. Mr. Vogel
stated that Mr. Parks had received a price quotation of $4, 255.00

from the contractor of the developer of Selva Marina Unit #9
to lay 230 lineal feet of 12-inch clay pipe from Sea Oats
Drive to Seminole Road. Mr. Parks explained the low price was
due to the contractor already being on the site. The City
Attorney stated the City should call for bids and the Commission
instructed the City Manager to do so . The City Attorney was
instructed to confer with the City Engineer on the ramifications
of the pipe-laying arrangement and report back at the next meeting.
B. Advisory Planning Board Chairman and New Member.
Mayor Howell stated that he had received a resignation from
Mr. R. L. Wardrep, Chairman of the Advisory Planning Board, which
was a result of his doctor' s orders . The Mayor suggested
Mr. John F. Andresen be appointed Chairman. It was moved, seconded
by Commissioners Minton and Jensen and carried unanimously that
Mr. John F. Andresen be appointed Chairman of the Planning Board.
Mayor Howell asked the Commission to consider names for a replacement
of the vacancy created by the foregoing resignation with the view of
taking action at the meeting on Wednesday, November 10th.
There being no further business, Mayor Howell declared that the
meeting be adjourned.

Enclosed herewith are:

Advisory Planning Board meeting of November 2, 1976 .

In order to earn additional interest, it would be prudent for us
to open an account (Passbook Savings) at the Ocean State Bank
to be used as a depository for all incoming revenue due to the
factthatwe will receive daily interest compounded quarterly on all
funds deposited in this account.
By way of explanation, the letter from Mr. Googins was in response
to an exploratory suggestion for simplifying the handling of our
water funds which involve transferring money from our general fund
to an account in the Atlantic National Bank and then transferring
the same funds back into the general fund, with the exception of
the funds to pay our semi-annual interest and annual principal
for retirement of water bonds. This procedure is in compliance
with covenants written into the original bond ordinance in
1958 which obligates the following revenues: water, cigarette
tax, and utility tax. We can invest in time certificates with
the Atlantic Bank amounts equal to the principal due each year
through 1983. The interest earned would exceed the interest
paid to the bond holders and we would receive the additional
interest each year until maturity.
To report on paving and resurfacing streets within our City,
I have conferred with Mr. Hilliard and we feel that investing in
a paver spreader unit for distributing blacktop would possibly
be wise at this time. This is a comparatively small unit
that- would attach to our dump trucks and do a much better job
of laying asphalt than the spreading and raking method we have used
in the past. The end result would be much smoother and more
uniform with the use of this unit. It is also suggested that the
cost of materials on a newly opened road should be assessed
to the abutting property owners on a front foot basis. At the
present cost of materials, we figure this cost to be in the
neighborhood of $2.75/$3.00 per front foot. The City' s contribu-
tion would be capital cost of equipment and labor for the
installation.
