05-18-92 v A MINUTES OF THE MEETING OF THE COMMITTEE OF THE WHOLE OF ATLANTIC BEACH CITY COMMISSION HELD IN CITY HALL AT 7:30 PM ON MONDAY, MAY 18, 1992 The meeting was called to order at 7:30 PM by Mayor Gulliford. Present, in addition to the Mayor, were Commissioners Edwards, Fletcher, Tucker and Waters. Also present were City Manager Leinbach, City Attorney Jensen and City Clerk King. Mayor Gulliford explained the meeting had been called for the purpose of discussing and addressing the questions regarding ownership and future maintenance of the streets in the Selva Marina area. The Mayor reported a number of the streets in the Selva Marina area had not been dedicated to the city. A ten-year maintenance agreement with the contractor had expired and it was the desire of the City Commission that the property owners in that area should be informed of the situation which existed. He explained many of the streets did not meet city specifications in either design or construction. The city had no plans for improvements in the area and the meeting was held so that property owners would have an opportunity to provide input. Robert Grovenstein presented a resolution from the Beaches Business Association requesting that the city accept the responsibility for maintaining Selva Marina Drive between Saturiba Drive and Twentieth Street, a distance of 4/10 of a mile, in the same manner as other streets which had been dedicated to the city. A copy of the resolution is attached hereto and made a part hereof. Two petitions also requesting that the city accept the responsibility for maintaining Selva Marina Drive between Saturiba Drive and Twentieth Street were presented by Jay Wangerin on behalf of the residents and owners of Sevilla Condominiums and the homeowners in Sevilla Gardens, and by Mark Lynn, representing the Residents' Council of Fleet Landing. Both petitions are attached hereto and made a part hereof. Bill Kelly, 1845 Hickory Lane noted that the petitions addressed only a small section of road within the area and it was his opinion the entire area should be included in any action the City Commission might take. Discussion ensued and Mayor Gulliford inquired whether anyone present would be in favor of changing the layout of the streets in order to being them up to city standards and it was the unanimous opinion of those present that no major street widening or paving that would require removal of trees should be undertaken. The residents wanted to retain the unique character of the area but pointed out that the city had done repair and maintenance work on these streets in the past and hoped it would continue to undertake this type of maintenance. Following further discussion it was felt that ownership of the streets needed to be determined before any other decisions could be made. Mayor Gulliford felt that the question of how to determine ownership of the Selva Marina Streets and who should pay for such research needed to be addressed. He also felt that the city needed to consider both the Page Two Minutes of Meeting of Committee of the Whole May 18, 1992 public health and safety aspect and the wishes of the residents, and determine what compromise, if any, the city would be willing to accept between the city specifications and the Selva Marina streets. He further inquired whether the city would be willing to accept dedication of the streets and the subsequent responsibility for maintenance and repair of those streets. He felt that these questions should be included on the agenda for action by the City Commission at the next meeting on May 26, 1992. Commissioner Fletcher summarized his feelings of the points raised and said he felt that in its efforts to resolve the situation, the city should possibly make a distinction between those roads which were used as thoroughfares and those roads which are primarily neighborhood roads. He also felt the city may consider any exceptions which might be made to protect the trees. The City Attorney suggested the residents of the Selva Marina area could form a homeowners' association and title of the streets could be conveyed to that association. The homeowners' association could then grant a perpetual easement for maintenance to the city. He suggested they should also consider acquiring liability insurance. He felt this would allow the streets to remain as they currently are and also resolve the question of maintenance. * * * * * * Mayor Gulliford reported on the work of the Interlocal Agreement Citizens Fact Finding Committee. He said the committee had been working for about a year on the city's relationship with the City of Jacksonville in respect to service received in return for ad valorem taxes paid to Duval County and a report would be submitted to the City of Jacksonville by June 1 , 1992, He asked the residents to watch for further information about this and encouraged them to attend Commission meetings and, possibly, meetings of the Duval County Council to support the city's position. There being no further discussion, the Mayor declared the meeting adjourned at 8:50 PM. Maur en King � 21 City Clerk * / RESOLUTION MAY 18 , 1992 To : The Mayor and Commissioners of Atlantic Beach, Florida From: Beaches Business Association Whereas , Selva Marina Drive , which runs North and South, between Saturiba Drive on the South and 20th Street on the North, in Atlantic Beach, Florida, is a 4/10 of a mile residential , divided street , and Whereas , Selva Marina Drive is not only used by residents of single family homes fronting the street , residents and owners of Sevilla Condominiums and Sevilla Garaens , but also residents of Fleet Landing and members of the Selva Marina Country Club, and Whereas , residents of homes , Sevilla Condominiums and Fleet Landing living North of Saturiba Drive use Selva Marina Drive for access and egress , and Whereas , service vehicles such as police , fire , rescue vehicles and garbage trucks use this street as the best route available to Sevilla Condominiums , Sevilla Gardens and Fleet Landing, and Whereas , the City of Atlantic Beach accepted the responsibility for maintaining all of the streets and roads in the annexation of Seminole Beach, Florida, reason would follow that Atlantic Beach, Florida should also maintain streets that were already in existence within the City of Atlantic Beach, Florida , as is the case in this area, Therefore , be it resolved that the Beaches Business Association petition the Mayor and Commissionersof the City of Atlantic Beach, Florida, to accept the responsibility for maintaining Selva Marina Drive between Saturiba Drive on the South and 20th Street on the North, in the City of Atlantic Beach, Florida, in the same manner as they presently service any other street dedicated to the City of Atlantic Beach, Florida. The Residents and Owners of Sevilla Condominiums and Sevilla Gardens hereby petition the Commissioners of the City of Atlantic Beach to accept the responsibility for maintaining Selva Marina Drive between Saturiba Drive and 20th Street in the City of Atlantic Beach, for the following reasons: 1. This 4/10 of a mile thoroughfare is used the same as any other street which is maintained by the City of Atlantic Beach and not exclusively by residents living on both sides of the street. Residents of Fleet Landing use this street in large volume. All City of Atlantic Beach vehicles such as police, fire department, rescue vehicles, and garbage trucks use this street. Contractors, other owners and residents living in the area, and anyone else seeking access to areas North of Saturiba Drive and East of Selva Marina Drive use this street for access and egress. 2. All Residents and Owners living in Sevilla Condaniniums and Sevilla Gardens pay Gasoline taxes the same as all residents in Atlantic Beach for the maintenance of all existing roads in the City of Atlantic Beach, which have been accepted, and should include the public thoroughfare of Selva Marina Drive between Saturiba Drive and 20th Street. The City of Atlantic Beach just recently used gas tax funds to pave the streets in Section H, at no cost to the residents. We believe we deserve the same kind of treatment. 3. Since the City of Atlantic Beach accepted the responsibility for maintaining all of the streets and roads in the annexation of Seminole Beach, we feel it is discriminatory to maintain these roads and streets and not those that were already in existence within the City, as is our case in this area. Since we, the residents and owners of Sevilla Condominiums 1810, 1820 and 1830, and the residents and owners of the homes in Sevilla Gardens already maintain the roads, water and sewer mains within our complex, and pay taxes on the full value of each of our Condaniniums and hares, we feel we are entitled to the same services that any other owner of real property in Atlantic Beach receive.
