The meeting was called to order by Mayor Howell, The invocation,

Approval of the Minutes of the Special Called Meeting of April 24,1981
Motion:The minutes of the Special Called meeting of April 24,1981 Jensen x x
be approved as corrected by Commissioner Van Ness to include Mhoon x
her name in the committee to meet with the State Attorney's Minton x x
Office. The sentence now reads: Commissioners Minton and Van Ness x

Recognition of Visitors
A large number of residents discussed with the Commission and the City
Attorney the promulgation of the Duval County grand jury presentment.
Those expressing criticism included Mr. Charles Slater, 237 Pine St. ,
Mr. Joe Conley, Mrs. Ruth O'Conner, and Mr. Bernard Gray. Those
offering favorable comments were Mr. Alan Potter, Mr. George Bull,Sr. ,
Mr. Wonderwood, and Mrs. Ruth G. Gregg. All of the Commissioners,
including the Mayor addressed the audience, but Mr. Ball, the City
Attorney, responded to the majority of inquiries. The Mayor added
that every presentment the Grand Jury has listed is being investigated,
and that when the committee which consists of Commissioners Minton and
Van Ness, the auditor, the city attorney, and the Acting City Manager,
meets with the State's attorney, every effort will be made to correct '
all the problems that may exist.

A. Letter from Jacksonville Beach City Manager Wayne Bowers re
Jacksonville Beach/Atlantic Beach Traffic Engineering Technician
Program
Mayor Howell reminded the Commission that some time ago there was
a discussion that Jacksonville Beach and Atlantic Beach together
apply for a grant for a traffic engineering technician program.
The Mayor said that the City Council had instructed Mr. Wayne
Bowers, City Manager to advise him that the City of Jacksonville
Beach had decided not to proceed with the program. The decision
was based on the implied commitment to hire the person once the
State funding was exhausted. Since the project is funded annually
budget constraints could have shortened the three-year time frame
requiring the Cities to then pick the position up on their respec-
tive payrolls, and in this time of budget cut-backs the City of
Jacksonville Beach is not prepared to make any future spending
commitments. Commissioner Minton expressed his disappointment that
the City of Jacksonville Beach had decided not to participate, as
he thought it was an excellent program, and he would have supported
it in Atlantic Beach, but he did not feel the City could handle it
alone.

Advisory Planning Board-Commissioner Van Ness
A. Margaret Then - P.U.D. Application - 193 Beach Avenue
Commissioner Van Ness reported that the Advisory Planning Board
met on Tuesday evening, April 21, 1981. The Board took no action
on Mrs. Then's P.U.D. action - they neither approved nor disapproved,and
a motion was made and died for lack of a second. The Chair asked
for a decision to deny or hold a Public Hearing.

B. Mike Ash - P.U.D. Application - 5 unit townhouse complex-Sylvan
Commissioner Van Ness reported that Mr. Ash brought a set of plans
to the Advisory Planning Board meeting that were inaccurate and
he has been instructed to bring revised plans to the next Plannilg
Board meeting for review. The matter was passed over.

City Manager's Report
II
The City Manager reported that as directed, he attempted to meet
with the State Attorney's office, but Mr. Mathis was out of town
until May 4, 1981. Mr. Stucki stated that he had met with two of
the investigators assigned to the case, and had advised them he
would like for the committee to meet with them as soon as possible
to obtain more specifics in order to correct the allegations
the Grand Jury presented. Mr. Stucki added that hopefully by the
next Commission meeting,he will some direction in which specific
avenues they desire changes.
Unfinished Business
A. Acceptance of Selva Marina Unit 10-C Water and Sewer Utility
Lines - Mr. Glenn A. Edwards.
Mr. Edwards reported that he had met with B.B. McCormick on April
14, 1981 for the purpose of determining that all water service
was intact, and everything checked out. He recommended that the
city accept the water and sewer service lines serving Selva Marina
Unit 10-C.

B. Mr. George Bull re Selva Marina Garden
Mayor Howell stated that it was his understanding that Mr. Parks
was now satisfied with Mr. Potter's final engineering plans for
the captioned subdivision, and Mr. Parks replied in the affirmative.
The Mayor addressed Mr. Bull saying that from the letter received
on April 21st, that Mr. Bull requested permission to also install
the concrete swales across the pavement as initially proposed. The
catch basins and storm drains will also be constructed as Mr. Parks
requested, but under protest, Mr, Bull stated that he was confiden-
time will prove that the concrete swales move little, if any. water
and the catch basins and culvert move none. He added that perhaps
this graphic demonstration will convince the Commissioners that it
is unnecessary to follow old concepts in order to achieve the
orderly environmentally oriented development of the City. Mayor
Howell said it was his understanding that Mr. Parks had recommended
the valley gutters not be approved due to a traffic situation where
they will cross the street. Mr. Parks stated that is correct,

Commissioner Jensen requested a roll call vote be taken, Howell x
Commissioners Jensen and Minton voted no and Commissioners Mhoon,
Van Ness and Mayor Howell voted aye.

Mr. Parks confirmed that he had inspected the mylar presented for
signatures and it now shows the necessary easements.

Mr. Bull then presented a topographic survey of the remaining
Bull land. A discussion followed on the development and whether
or not the streets would be dedicated to the City. Mr. Bull asked
that the plans be submitted to the Advisory Planning Board under
Planned Unit Development. Mayor Howell instructed the matter be
sent to the Advisory Planning Board.
Miscellaneous Business
The Mayor instructed the Acting City Manager to place an ad in the
Florida Municipal Record and the International Association of City
Managers that the City of Atlantic Beach is accepting applications
for a City Manager. He suggested that Mr. Stucki confer with Mr.
Ball, the City Attorney on the various qualifications as set fort
in the charter of the City of Atlantic Beach.
There being no further business, the Mayor declared the meeting
adjourned.
