Mayor Howell called the meeting to order, and welcomed the thirty-five
residents attending the meeting. He explained that the notices in the
paper were required by State law in what is referred to as the Trim Bill.
The Trim Bill provides that a City, in preparing its budget and establish
ing a millage rate for the 1980-81 fiscal year must advertise any increase
that is brought about in tax millage. Mayor Howell detailed the problems
that every city in the state of Florida is facing this year in preparing
a budget. He listed the following parts that make up a budget: those parts
that are mandated upon municipalities by the Federal government; those
parts that are mandated upon municipalities by the State of Florida; the
inflation factor, and with the bottom line that approximately 93-95% of
the budget are items which the governing body of the City of Atlantic
Beach has no control over, such as electricity, gasoline, etc. The Mayor
then turned the floor over to the City Manager who read a letter addressed
to the City Commission that explained his budget. Included in a total of
$2,843,830.00 is the amount of $83,580.00 which constitutes a contracturaL
budget for the Public Service Employment Program funded by the Manpower
Division of the City of Jacksonville. The budget for all operating depts.
and for debt service amounts to $2,760,250.00. The total recap is
$172,842.00 less than a recap of last year's total budget. Mr. Davis
gave reasons for the increase as a loss of revenues from State sources
in the approximate amount of $11,000, and the distinct need, on a one-
time basis, for the creation of a new Public Works facility that has been
budgeted at $100,000.00. In order to continue to provide the current
level of services, Mr. Davis stated that it will require an increase in
the millage levy from 3.1117 to 4. 1117. Copy of Mr. Davis's letter is
attached hereto and made a part hereof. Mayor Howell then opened the
floor for a public hearing. Mr. Floyd Yeager, 1663 Sea Oats Drive, asked
what the additional $173,000 in tax revenue would be spent for, and Mr.
Davis replied that $11,000 was budgeted for the racquetball court, and
the public works facility, among other things. Mr. Yeager, along with
Mr. Terrell A. Gibson, 1708 Park Terrace W. , Mr. Bill Matteoli, 1673 Park
Terrace E. and several others suggested that financing the public works
facility would be a better route to take than increasing taxes. Mr. Gibson
asked if the millage would drop back next year and the Mayor answered
that the $100,000 would not be in the budget, but he could not predict
the inflation factor. Mr. Bert Wilson, 1251 Carnation, complained that
he was paying taxes and not receiving services such as sewer and garbage
service. Mr. Davis stated that when the 201 project is completed he will
receive thoses servcies. This should be in the next few years.

Public Hearing - continued
Dr. George Maida, 884 E. Coast Dr. , Mr. John Coonan, 1733 Park Terr.E,
and others voiced the opinion that the City should reduce the garbage
and trash service to every other day. Mr. Davis stated that the
majority of citizens wished to continue the six day per week service
and that he hoped there would be sufficient funds to do so. Mr. Leik,
355 19th St. asked if he would have to pay taxes on streets that the
City does not maintain. Mayor Howell answered that some of the streets
in the new units of Selva Marina were not dedicated to the City. As
they are privately owned streets, the City cannot maintain them.Mr.Leik
also asked if the Duval County property appraiser had assessed all
properties at 100% and the Mayor replied yes. Phyllis Haeseler, 1852
Sea Oats inquired about the double taxation lawsuit. The Mayor
answered that they have had some very fruitful conversations and have
agreed on certain fundamental issues. They hoped for a settlement
before the first of the year, but it will not affect this year's taxes
because the millage has to be certified and property tax mailed before
the end of the year. He added that any settlement reached should be
reflected in next years taxes.
As no other questions were asked, the Mayor closed the Public Hearing.
Mayor Howell presented and read in full Resolution No. 80-16, a
Resolution adopting and approving the tax assessment roll for the yea
beginning January 1, 1980 and ending December 31, 1980, determining
and fixing the rate of taxation and making the annual tax levy for
the City of Atlantic Beach for the calendar year 1980 to provide fund
for the fiscal year beginning October 1, 1980 and ending September
30, 1981 and providing a special levy for debt service and authorizin
and directing the collection thereof. Commissioner Van Ness moved
for passage of Resolution no. 80-16 and Commissioner Jensen seconded.
Commissioner Minton requested a roll call vote. The Resolution was
passed with a unanimous vote.

Dear Sirs:
The trials and tribulations of newly enacted legislation governing the
budgetary process of all cities in the State of Florida has finally reached
its conclusion for the City of Atlantic Beach.
Tonight, you will be reviewing and adopting the budget developed under the
mandates of the "Trim" Bill. A recap of the totals of all funds as proposed
in the budget for FY 1980-81 amounts to $2,843,830.00. Included in this
total is the amount of $83,580.00 which constitutes a contractural budget for
the Public Service Employment Program funded by the Manpower Division of
the City of Jacksonville. With this amount of dollars excluded from the
recapped amount stated above, the budget for all operating departments and
for debt service for the fiscal year amounts to $2,760,250.00. This total
recap is $172,842.00 less than a recap of last year 's total budget.
One of the primary tasks that each of us has been concerned with is the saving
of dollars in the operation of the government of the City of Atlantic Beach.
The budget for the current fiscal year, as proposed, contains 6% less money
than that of the previous year. This in spite of double digit inflation and
employee pay increases. Contained within this proposed budget is a loss of
revenues from State sources in the approximate amount of $11,000.00 and some
restructuring of other revenue items to be more nearly attuned to actual
amounts reasonably to be expected. Coupled with this loss of revenue is the
distinct need, on a one-time basis, for the creation of a new Public Works
facility. This facility has been budgeted at $100,000.00. Ad valorem taxation
in fiscal year 1979-80 produced $177,418.00. In order to continue to provide
the current level of services, it is necessary to increase ad valorem tax
revenue to the level of $350,678.00. To produce this amount of dollars for
fiscal year 1980-81 will require a millage of 3.5128 for operating purposes
and a levy of .5985 necessary for debt service. These millages total a
required levy of 4.1117. The millage levy for fiscal year 1979-80 was 3.1117.
This budget has a bare minimum of capital expenditures other than the Public
Works facility. One item worth mentioning is garbage pick-up equipment that
should assist us in saving gasoline.

A RESOLUTION ADOPTING AN OPERATING
BUDGET FOR THE CITY OF ATLANTIC
BEACH, FLORIDA, FOR THE FISCAL PERIOD
BEGINNING OCTOBER 1, 1980 AND ENDING
SEPTEMBER 30, 1981
WHEREAS, the City Manager has submitted itemized estimates of the cost
of operating the City Government and has made specified suggestions for the
proper financing thereof, the same having been duly considered by the City
Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA:
SECTION 1. That the following budget of appropriations and expenditures
for the several functions, agencies and departments of the City for the fiscal
period beginning October 1, 1980 and ending September 30, 1981 be and the same
is hereby adopted; and as adopted, the budget shall be the appropriations for
each department as outlined herein, and the legal limit of expenditures by
said City for operations during the 1980-81 fiscal period.
SECTION 2. This resolution shall take effect immediately.

A RESOLUTION ADOPTING AND APPROVING THE TAX ASSESS-
MENT ROLL FOR THE YEAR BEGINNING JANUARY 1, 1980 AND
ENDING DECEMBER 31, 1980, DETERMINING AND FIXING THE
RATE OF TAXATION AND MAKING THE ANNUAL TAX LEVY FOR
THE CITY OF ATLANTIC BEACH FOR THE CALENDAR YEAR 1980
TO PROVIDE FUNDS FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 1980 AND ENDING SEPTEMBER 30, 1981 AND
PROVIDING A SPECIAL LEVY FOR DEBT SERVICE AND AUTHOR-
IZING AND DIRECTING THE COLLECTION THEREOF.
WHEREAS, the City Commission did meet and agree that the City of
Atlantic Beach, Florida, adopt the Duval County 1980 Tax Roll for the
1980 tax assessments for all real and tangible personal property; and
WHEREAS, the Property Appraiser of Duval County has prepared the tax
assessment roll of all taxable real and tangible personal property within
the corporate limits of the City of Atlantic Beach, Florida, as taken from
the Duval County 1980 Tax Roll, for the tax year beginning January 1, 1980
and ending December 31, 1980; and
WHEREAS, the City Commission intends to adopt a budget of the financial
needs of each department and agency of the City for the fiscal year beginning
October 1, 1980 and ending September 30, 1981.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA:
SECTION 1. That the tax assessment roll for the tax year beginning
January 1, 1980 and ending December 31, 1980, as adopted from the Duval County
1980 Tax Roll, be and the same is hereby adopted and approved, and the said
roll showing a total assessed valuation for the entire City aggregating the
sum of $104,022,371 which consists of tangible personal property assessments
aggregating $4,624,055 and real estate assessments aggregating $99,398,316,
shall be and the same is hereby declared to be and become the Tax Assessment
Roll for the City of Atlantic Beach, Florida, for the tax year beginning
January 1, 1980 and ending December 31, 1980.
SECTION 2. That the Budget of Expenditures for the fiscal year beginning
October 1, 1980 and ending September 30, 1981, as set forth in that certain
resolution entitled "A RESOLUTION ADOPTING AN OPERATING BUDGET FOR THE CITY
OF ATLANTIC BEACH, FLORIDA FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 1980

and for the purpose of financing and defraying the expenses of the several
departments and agencies and discharging the indebtedness of the City as
provided for in said proposed budget, it is hereby ascertained, determined
and declared that ad valorem taxes shall be levied, assessed, and collected
as hereinafter provided.
SECTION 3. That upon each dollar of real and tangible personal
property as assessed upon the Tax Assessment Roll as adopted in Section 1. of
this resolution, and not entitled to exemption from taxation under the laws
of the State of Florida, there is hereby levied a tax of 3.5128 mills for
the tax year beginning January 1, 1980 and ending December 31, 1980, for the
purpose of providing such portion of the funds to be appropriated for the
operation of the several departments and agencies of the City for the fiscal
year beginning October 1, 1980 and ending September 30, 1981, as are to be
derived from the ad valorem taxes.
SECTION 4. That upon each dollar of real and tangible personal property
as assessed upon the Tax Assessment Roll as adopted in Section 1. of this
resolution, and not entitled to exemption from taxation under the laws of the
State of Florida, there is hereby levied a tax of .5989 mills for the tax year
beginning January 1, 1980 and ending December 31, 1980, for the purpose of
providing funds for debt service payment on general obligation bonds during
the fiscal year beginning October 1, 1980 and ending September 30, 1981.
SECTION 5. That the amount and rate of taxation for the City of Atlantic
Beach for the purposes and governmental functions set forth in Section 3 and 4
hereof, are hereby determined and the annual tax levy for the calendar year
beginning January 1, 1980 and ending December 31, 1980, to provide funds for
the fiscal year beginning October 1, 1980 and ending September 30, 1981,
aggregating 4.1117 mills upon all property not entitled to exemption from
taxation by the Laws of the State of Florida, said millage being a sixty-five
and one-half percent (65.5) increase in property taxes, and -0- mills upon
all property of the type entitled to certain exemption from taxation by the
Laws of the State of Florida, is hereby made as provided in the foregoing sections.

is authorized to adjust the adopted millage rates if the taxable value included
on the tax roll as adopted by Section 1. is at variance from the taxable value
shown on the roll to be extended. The adjustment shall be such that the taxes
computed by applying the adopted rate against the certified taxable value are
equal to the taxes computed by applying the adjusted adopted rate to the taxable
value on the roll to be extended.
SECTION 8. That the Tax Collector be and he is hereby authorized and
directed to collect out of the property listed upon the Tax Assessment Roll
herein adopted, and from each of the persons, firms, and/or corporations named
in said annual Tax Assessment Roll, the taxes and money set down in such annual
Tax Roll opposite each name or lot, parcel or tract of land therein described
in accordance with the assessment and levy herein adopted and imposed, and in
case the taxes so imposed are not paid at the time prescribed by law, the said
Tax Collector is hereby commanded to have the collection thereof enforced in
the manner provided by law, and the said Tax Collector shall account for all sums
of money collected by him as the Tax Collector of the City of Atlantic Beach
at the time and in the manner as shall be required by him by ordinance.
SECTION 9. The invalidity of any section or provisions of this resolution
shall not invalidate any other section or provision thereof.
SECTION 10. This resolution shall take effect immediately.
