The meeting was called to order by Mayor Howell. The invocation, offered
by Commissioner Minton, was followed by the pledge to the flag.

City Manager's Report
Mr. Davis requested permission to purchase, under GSA contract No,
GS-10S-43481, two #437 refuse vehicles, The base price per vehicle is
$4,958.40 and he added that $12,000 was budget approved with an idea
toward more efficient refuse collection for the City.

Mr, Davis further requested permission to purchase a 52" Groundsmaster
mower for ballpark and park purposes under State Contract No,515--63-80-1,
in the amount of $4,000, which was also budgeted in the current year,

Mr. Davis advised that he and Mr. Lucas, of Bessent, Hammack & Ruckman
have met with the "Target Area" community Thursday night at the Community
Baptist Church. Reception has been good, One additional meeting will be%
held before filing the grant application.

New Business
A. Einer and Elsa Jensen re petition to allow horses at 1550 Main St.
The Chair recognized Mr.Jensen, who presented a petition signed by
20 neighbors to allow him to keep one pony on his 14 acres of fenced
land. Discussion followed concerning the Ordinance Code of the City,
specifically Chapter 4, Article 2, Section 4-7, subparagraph (e) that
prohibits the housing and keeping of horses within the City limits.
Motion: The Ordinance Code of the City of Atlantic Beach not be Jensen x
changed to allow horses and Mr. Jensen's request be Mhoon x x

B. Introduction of an Ordinance creating a Code Enforcement Board
ORDINANCE NO. 95-80-21, AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORIDA, CREATING THE CODES ENFORCEMENT
BOARD OF THE CITY: DESCRIBING QUALIFICATIONS AND TERMS OF MEMBERS,
AND THE JURISDICTION, POWERS AND PROCEDURES OF THE BOARD; PROVIDING
NOTICE AND HEARING PROCEDURES; PROVIDING FOR PENALTIES WHERE VIOLATIOINS
ARE FOUND TO EXIST; FURTHER PROVIDING FOR AN APPEAL BY WRIT OF
CERTIORARI TO CIRCUIT COURT; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING
AN EFFECTIVE .DATE.
Said Ordinance was presented in full, in writing, and read by title
only, on first reading.

Motion: Said Ordinance be passed on first reading by title only. Mhoon

Discussion followed after the motion. Commissioner Mhoon questioned Van Ness x x
the membership of the board stating that he felt no. 2 should read: Howell
A business man and/or professional person. Mayor Howell explained
that this law was passed by the State Legislature who stated the
members to be appointed. He strongly suggested the City track the
Florida Statutes in passing the Ordinance. Commission agreed.

Unfinished Business
A. Bill from Coffman & Coleman - Commissioner Jensen
Commissioner Jensen reported that he, Mr. Ball, and Mr. Davis had
met with Mr. Pat Coleman on the pending litigation. They left Mr.
Coleman with a very confident feeling of the City's position.
Commissioner Jensen recommended the bill submitted at the meeting of
October 27, 1980 be paid.

OF RACE, COLOR, SEX, RELIGION OR NATIONAL ORIGIN; TO DISCRIMINATE
FOR SUCH REASONS IN THE TERMS, CONDITIONS, OR PRIVILEGES OF SALE OR
RENTAL OF THE SAME; TO PUBLICLY INDICATE ANY PREFERENCE ON ACCOUNT 1 ,

Said Ordinance was presented in full, in writing, and read on third
and final reading by the City Manager. Said Ordinance was posted in
line with charter requirements. The Mayor then opened the meeting
for a public hearing. The suggestion was made for an amendment. On
Page three the Ordinance now reads the"City Court.' Mayor Howell
suggested this be changed to read "a court or board of competent
jurisdiction". As no one else spoke for or against, the Mayor declarec
the public hearing closed.

CITY MANAGER'S REPORT
I request permission to purchase, under GSA Contract No. GS-10S-43481,
two (2) #437 refuse vehicles. You will recall this was an item that
was placed in the budget with an idea toward more efficient refuse
collection for the City.
I further request permission to purchase a 52" Groundsmaster mower for
ballpark and park purposes under State Contract No. 515-63-80-1, for
a total price of $4,000. This item was also budgeted in our current
budget.
Mr. Lucas, of Bessent, Hammack & Ruckman, and I have met with the
"Target Area" community Thursday night at the Community Baptist Church
on Lewis Street in Atlantic Beach, and we have one additional meeting
scheduled preparatory to filing the City of Atlantic Beach's grant appli-
cation. Reception from the community has been good.
