The invocation,offer- ed by Commissioner Van Ness, was followed by the pledge to the flag. Approval of the Minutes of April 11, 1983 It was duly noted that the minutes of April 11, 1983,reflected in error that Commissioner Morris was present at the meeting of April 11, 1983. Commissioner Morris was, in fact, out of town on that day. Van Ness x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Persons x Recognition of Visitors Mayor Persons recognized and welcomed Bruce Corbitt, Jacksonville Beach Councilman, and also a candidate for a Council seat in Jacksonville. Mr. Corbitt was introduced to the Commission who thanked him for coming. Correspondence A. From John Leslie re Status of South i of LOT 6,BLK 219, and South i of LOT 6, BLK 220, Section H Mr. John Leslie owns LOT 1, BLK 206, Section H, which borders on Begonia, Tulip, and a 25' right-of-way (South 1 of LOT 6, BLK 219, and South i of LOT 6, BLK 220) that is owned by the City. Mr. Leslie requested clarification of the status of the right-of-way,as it is presently being used as a dirt road for ingress and egress to Tulip St. from Begonia, and he would like to construct his home facing that dirt road. A general discussion followed. The consensus of the Commission was that they would not guarantee the City would maintain the right-of-way as a street. Mr. Leslie commented that he would be interested in buying the 25' parcel owned by the city if it ever comes up for sale. Advisory Planning Board A. Request for Change in Zoning Classification-L.B. MacDonnell/Cardinal Industries (Section H. ) PAGE TWO V V MINUTES Names of APRIL 25,1983 Commrs. M S Y N Advisory Planning Board - continued A. Request for Change in Zoning Classification A lengthy debate was held on the request by Mr. Louis MacDonnell/Mr. Bert Revells, Cardinal Industries that the zoning classification be changed from CG (Commercial General) to RG3 (Multi-Family) in Sec. H. The proposed development would be 64 one story, one bedroom rental apartments located on four acres. Commissioner Gulliford opposed the change of zoning as it could set a bad precedent, and he made the following motion: Motion: Deny the recommendation of the Advisory Planning Board Cook X for approval, and reject the rezoning necessary for the Gulliford x x project. Morris X Van Ness x x The vote was three to two in favor of the motion, but it takes a Persons x 4/5 vote to override the recommendation of the Advisory Planning Board. The Ordinance for rezoning will be presented at the next meeting to be read on first reading. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * B. Request for Change in Zoning Classification - Mr. & Mrs. John Woleslagle and Watson Realty(Agent)-Lots 664 and 665, Saltair Sec. 3 Commissioner Morris reported that the Advisory Planning Board recommended disapproval of the change of zoning classification from RS2 to RG1 requested by Mr. & Mrs. John Woleslagle and Watson Realty. Motion: Accept the recommendation of the Advisory Planning Board Cook x and deny the request by Mr. & Mrs. John Woleslagle for Gulliford x x Morris x x the change of zoning classification from RS2 to RG1. Site Plan Review of Atlantic Village Shopping Center The City Manager introduced Mr. Asa Candler, Developer of the Atlantic Village Shopping Center, and his contractor, Mr. Bill Dyer. Commis- sioner Morris was asked to report on the Advisory Planning Board's recommendations for the project, and he said they had some concern on the ingress and egress of the traffic that will have to do with the shopping center, and also the problem of the outfall from the shopping center and the drainage of the storm water. Mr. Dyer advised the Commission that he had talked with the Department of Transportation on this date and it is the DOT's intent to issue their permit for access to the shopping center off of Atlantic Blvd.through the center of the shopping center. They are going to improve the medians and require a left hand turn lane there. Discussion was held on the access through Royal Palms as there was concern that the curve on Royal Palms might not be wide enough to accommodate the traffic. MS Y N — __4 1 Advisory Planning Board - continued- Atlantic Village Shopping Center Discussion was held on the water retention problems caused by the impact of the parking lot. The contractor stated that their plans meet the retention requirements of Chapter 1725 of the Florida Administrative Code. They only have to meet the minimum require- ments as the City of Atlantic Beach does not have a storm water Ordinance. For the record, Commissioner Morris suggested that the City consider adopting a storm water Ordinance in the near future. After discussion and reviewing the site plan, the City Manager stated the contractor is ready to go and hopes to start within two weeks after the permit is issued from the City. City Manager's Report A. Item #1-Provision of Utility Services Outside Corporate Limits The City Manager reported that one of the recommendations made by the Sewer Plant Committee during their meeting of April 14, 1983 concerning the expansion of the utilities beyond the corporate limits was there be no decision other than making expansion on a case-by- case consideration of design of the system. The City Manager recom- mended that the City Commission adopt a policy concerning the continu-d expansion of water and sewer utilities beyond the corporate limits. Item #2 - Award of Contract-Furnish and Install Baseball Field Backstop - Russell Park 4 The City Manager advised that the amount of $2,500 has been allocate. in the FY 1982-83 budget. Date of bid opening was April 21, 1983 at 2:00 p.m. Three bids were received. (Tabulation of bids is attached hereto and made a part hereof) .The City Manager recommended that the City Commission award the contract for the furnishing and installing of a baseball field backstop to Newsom Fences of Jacksonville, the low bidder, in the amount of $1,875.00. He requested a meeting be held on May 9, 1983 at 7:30 p.m. for all Pension Board members. PAGE FOUR V V MINUTES Names of APRIL 25, 1983 Commrs. M S Y N City Manager's Report- continued Mr. Moss presented a written report on the 37th Annual Conference of the Florida City and County Management Association that he attend- ed. He thanked the Commission for the opportunity to go to that very worthwhile meeting. The City Manager reported that construction on the new public works building was going well. Beach Avenue resurfacing is completed with- out too many complaints. There are a couple of problems on storm water drainage on properties that were built below street grade and he is trying to address that. Mr. Moss acknowledged receipt of a report from Robert Bates, Consult- ing Engineers, regarding the impact of the Buccaneer's water plant for which they have made application. The summary of the report suggests that the wells will not have a substantial impact on the City of Atlantic Beach. Specifications have been prepared as requested by the City Commission for the group health insurance, and have advertised for bids. At present, nine companies are reviewing the specifications. Bid Open- ing is scheduled for May 24, 1983. Bid opening for a Financial Consultant is scheduled for May 2,1983, and hopefully will bring forth recommendations at the meeting of May 9, 1983. Items being considered by the Florida State Legislature that the City Manager brought to the attention of the Commission: A move to require the licensing of building officials- certification by the State. Mr. Moss recommended that the City oppose state mandated requirements for our employees. The Cities should share some of the liability in the inspection of the buildings. The bill also requires that all building fees go into the building inspection department. Mr. Moss asked for direction from the Commission as to whether or not the City Manager should express the city's feelings by letter toward the various legislations regarding the building inspection bills. League of Cities is attempting to institute that will allow the cities to continue to receive refunds from the State from the 5% sales tax. There is some movement that the State preempt the municipalities in comprehensive planning and zoning and should be watched. PAGE FIVE V V MINUTES Names of APRIL 25, 1983 Commrs. M S Y N City Manager's Report - continued - Proposed bills : Uniform Municipal Election Dates - All municipalities will have their elections on the same day. This overrides our Charter. It also mandates that county supervisors of elections conduct all municipal elections and be reimbursed by the cities for the expense of the elections. The Commission opposed the adoption of this legislation. The City Commission was provided a copy of a memorandum from Carl Stucki, Chief of Public Safety,regarding litter on the Beach. New Business A. Request by Mr. & Mrs. Hugh Miley to Sell Beer and Wine for Package Goods Qnly - 85 Sailfish Drive Discussion was held on Mr. & Mrs. Miley's request to sell beer and wine for package goods only in their new meat market at 85 Sailfish Drive. It was the consensus of the Commission that this would be classified as a grocery store and come under the exception of Section 3-6(c) of Chapter 3 of the Code of Ordinances of the City of Atlantic Beach. Cook x Motion:Grant the request by Mr. & Mrs. Hugh Miley to sell beer and Gulliford x x wine not consumed on the premises at 85 Sailfish Drive. Morris x For the record, it was agreed that if there is some question in the Van Ness x minds of the staff and/or the City Clerk that something is or is not Persons x classified as a grocery store,the matter will be brought before the City Commission. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Report of Committees A.
