MINUTES OF THE SPECIAL CALLED MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON JULY 3, 1984 AT 7:00 P.M.
PRESENT: William S. Howell, Mayor-Commissioner
Robert B. Cook, Sr.
William I. Gulliford, Jr.
John W. Morris, Jr.
Catherine G. Van Ness, Commissioners
AND: A. William Moss, City Manager

The meeting was called to order at 7:00 p.m. by Mayor Howell. The first item on
the agenda was the CATV Board. A lengthy discussion followed on whether or not
the city had relinquished their responsibilities when they signed the interlocal
agreement; whether or not to recommend to the other beaches that the board be
abolished, and who to appoint as the City of Atlantic Beach's representative to
the board.
Mr. Robert B. Persons, Jr. explained in detail his actions and opinions from the
time the board denied Cox Cable, Inc. a rate increase from $7.50 to $12.00 a
month to the recent decrease in rates approved by the Board.
Following discussion, Commissioner Gulliford moved for the following:
Motion: Move to dissolve the board by August 15, 1984 and request
the other cities to do the same.
The motion was seconded by Commissioner Van Ness. During discussion before the
vote, Commissioner Van Ness asked what does the motion do to the interlocal
agreement which calls for a board. City Attorney Mullis advised that the
interlocal agreement would no longer be if one of the other beach cities
votes to dissolve the board. A two-third vote of the municipalities can abolish
the board. The question was called and the motion carried with a four to one
vote. Commissioner Morris voted nay.

Commissioner Morris then moved for the following:
Motion: Ratify and affirm the appointment of Robert B. Persons, Jr.
to the Beaches CATV Board effective 11/23/81, and to further
ratify and affirm all acts taken by him as a member of said
Beaches CATV Board since that time, and to further ratify and
affirm all acts or actions of said CATV Board since 11/23/81.
Mayor Howell called the motion out of order on the basis there is no opening
on the board. Mayor Howell then stated he was resigning his position on the
CATV Board effective 8:38 p.m. July 3, 1984.

Commissioner Gulliford moved to empower the Mayor to appoint a member to the
CATV Board. Mayor Howell called the motion out of order as it violates the
interlocal agreement, and the Charter provides that all boards shall be
appointed by the City Commission of Atlantic Beach.
Commissioner Morris then moved for the following:
Motion: Appoint Robert B. Persons, Jr. to be the City of Atlantic Beach
Jacksonville Beaches CATV Board Member.
The motion was seconded by Commissioner Van Ness. A roll call vote was taken
and the motion failed with a three to two vote. Commissioners Cook and Gulliford
and Mayor Howell voted nay. Commissioners Morris and Van Ness voted aye.
Mayor Howell stated the seat is vacant and asked the City Manager to put an
item on the agenda for a CATV Board appointment.
The second item on the agenda was the Federal Grant- wastewater System
Improvements program. Mr. Moss stated that on June 26, 1984, the City was
notified that federal grant funds are now available for the City of Atlantic
Beach. Mr. Moss requested authority to work with Robert Bates and Associates ,
Consulting Engineers, to submit the grant application for federal funding.
Motion: Authorize the City Manager to work with Robert Bates &
Associates, consulting engineers to submit the grant application
for federal funding.
The motion was seconded by Commissioner Morris and carried unanimously.

There being no further business to come before the Commission, the Mayor
declared the meeting adjourned.
