MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, MAY 24TH, 1965 AT 8 P.M.
Present:

The meeting was called to order by the Mayor-Commissioner,
Mr. Olsen.
The Invocation was given by Commissioner Weldon,
There being no corrections or additions to the minutes of April
26th, 1965, Mr. Olsen declared them approved as written.
Mr. Olsen called for additions or corrections to the minutes of
the Special Meeting of May 7th, 1965. Mr. Goodling suggested that
these minutes show that it is not the policy to hold special meet-
ings for an award of bid, but since there was only a single bid
and the work on the streets needed to be done, and as there would
not be a quorum at the regular meeting due to vacations and annual
military service, it was deemed advisable to hold the special
meeting under these circumstances. With this explanation, and
there being no other corrections or additions, the minutes were
declared approved as written.
Mr. Olsen called for any additions or corrections to the minutes
of May 10th, 1965,and directed that the record show that Mr. Parks
was in town on that date but was notified by the Mayor that it was
not necessary for him to attend as there would not be a quorum,
due to reasons stated above. With this information noted, the
Mayor declared the minutes approved as written.
Mr. Olsen recognized visitors present and called for any business
from the floor not on the agenda. Mr. Otis E. Carr, 1071 Atlantic
Blvd. stated that for 20 years he has rented space on his property
for a billboard which has been one source of income for him, and
he would ask that they permit the Bache Sign Co. to erect the sign
as applied for, as it is going in same location as one blown down
by Hurricane Dora. Mr. Olsen advised that this would be considered
under the Planning Board' s report later in the meeting.

There was no other business from the floor at this time.
Mayor Olsen presented Ordinance #90-65-21 said Ordinance amends
Zoning Ordinance by creating and establishing a Business A-1
zone on part of Hotel Reservation which was previously zoned
Business "A" . Copy of certified proof of publication of notice
of Public Hearing on this ordinance for May 10th, 1965 is atta-
ched to these minutes and made a part hereof. The Public
Hearing of May 10th was adjourned to 8 P.M. this date, May 24,
1965. Mr. Olsen read the ordinance in full following which he
declared the meeting in session for the adjourned Public Hear-
ing on said ordinance. As no one appeared either for or against
said Ordinance, the Mayor declared the Public Hearing closed.
Whereupon Mr. Parks moved that Ordinance #90-65-21 be adopted
on second and final reading, seconded by Weldon and carried.
Mr. Olsen next presented Ordinance #90-65-22 which Ordinance
amends Zoning Ordinance 90-59-3 by rezoning a part of the Hotel
Reservation designated as "Ward property" from Residence A to
Residence C. Copy of certified proof of publication covering
Public Hearing on said Ordinance is attached to these minutes
and made a part thereof. Mr. Olsen read the ordinance in full
then declared the meeting in session for Public Hearing on same.
No one appeared either for or against the ordinance except Mr.
Ward who stated he was in favor of and had requested the change.
It was also stated that the sign was posed on the property as
required. Mr. Olsen declared the Public Hearing closed, where-
upon Mr. Parks moved the adoption of Ordinance #90-65-22 , second-
ed by Mr. Weldon and carried.
Mr. Olsen next recogonized Deputy Marshall D.K.Jahnke of the
Neptune Beach Police Department who advised that there was some
question as to advisability of his driving the wrecker for the
Perry' s American Service Station where he is working part-time
when off duty. His work is as service station attendant and at
times he drives the wrecker. He advised that he is doing this
with permission of his chief so long as he is not on duty or in
uniform. It was brought out that the wreckers are called on
rotation and the list is a'ai_lable for public inspection. Chief
Vogel advised that he had nothing against the arrangement, but
that some of our patrolmen were concerned over the criticism
that might be leveled against them thinking they were favoring
another officer. Mr. Goodling asked the attorney if this was a
matter the Commission has authority to pass on, and Mr. Thompson
advised he thought not. The matter was discussed further and at
length following which Mr. Weldon moved that we make no distinct-
ion in the American Service Station or in its wrecker drivers
with respect to being called for service in Atlantic Beach until
such time as there is a complaint and then we will look into the
matter iurther, seconded by Mr. Parks, and following further
discussion the Mayor put the question and the call vote was :

Mr. Goodling advised that he thinks there is a conflict of inter-
est and perferred to abstain from voting. Mr. Olsen declared the
motion carried.
City Manager Craig reported on behalf of the Advisory Planning
Board. The Board recommends that action be delayed on Mrs. Thel-
ma Keeth ' s rezoning request until after the passage of the Ordi-
nance amending the Zoning Ordinance as regards square foot area
in apartment living units. Copy of proposed ordinance will be
sent to Mrs. Keeth.
Mr. Craig advised a request was received from Mr. Jack Shannon
to sell an 8 ' X28 ' trailer to be used as office and night watch-
man' s quarters at Don' s Barber Shop place on Mayport Road. The
Planning Board recommended that the request be denied, as our
ordinance does not permit the use of trailers except in trailer
parks. Mr. Goodling moved that the letter be acknowledged and
request denied as recommended, seconded by Mr. Weldon and carried.
Mr. Craig reported that a letter had been received from Mr. D.K.
Jahnke requesting permission to sell used cars at the American
Service Station at 715 Atlantic Blvd. The Planning Board recom-
mended that the request be denied as the location is in Business
AA where no outside storage is allowed and it would not be a ser-
vice to the neighborhood. After discussion, Mr. Parks moved that
the recommendation of the Board be accepted in this instance as
the policy of the Commission, seconded by Mr. Weldon and carried.
On a permit request from Wm. S. Howell for a 61" X 25" sign at
his insurance office location on Atlantic Blvd. Mr. Craig advised
that he talked to Mr. Guest of the State Road Department who stat-
ed that the sign was acceptable under present conditions and the
sign could in no way obstruct traffic. The Planning Board recom-
mended approval. Mr. Parks moved that the request be approved
as recommended by Planning Board, seconded by "'r,. Goodling and
the vote was

Whereupon the Mayor declared the motion carried.
Mr. Craig advised that as regards the billboard sign,application
for which was made by the Bache Bros. Sign Co. to be erected on

Mr. Carr' s property on Atlantic Blvd, the Planning Board recom-
mended disapproval. This is the sign Mr. Carr mentioned previous-
ly in these minutes. The matter was discussed, and Mr. Parks
inquired if we had an ordinance that prohibited the erection of
the sign end Mr. Craig advised that he could not find anything
that prohibited the sign if approved. It meets the requirements
for signs of this type as set up in the building code. After
further discussion Mr. Weldon moved that there being nothing in
ordinances which would prohibit and the fact that it is being
placed on private property and appears to be well designed, au-
thority be granted for erection of the sign, seconded by Mr.Parks.
Mr. Olsen stated that he thinks we have enough signs but since
it is taking place of sign blown down by Hurricane "Dora" he
would be for it. Mr. Olsen then put the question and the motion
was carried.
There was considerable discussion as to billboards and signs, as
well as procedures for requests for spot zoning, and the Planning
Board was requested to make recommendations as to firming up and
tying down these subjects for the Commission' s consideration.
Appreciation was expressed for the work being done by the Advis-
ory Planning Board for the City.
Resolution #65-15 was presented covering transfer of funds from
Account #802 -Sewer Department to Account #503 Sanitation in a-
mount of $300.00 to cover garbage containers . Following dis-
cssion Mr. Parks moved the adoption of said resolution, second-
ed by Mr. Weldon and carried. Copy of Resolution #65-15 is at-
tached to these minutes and made a part thereof.
Resolution #65-16 was presented covering the appointment of E.G.
Roche, Carl Roumillat, and Arthur J. Craig as Board of Plumbing
Examiners for a period of one year beginning July 1, 1965. Mr.
Weldon moved the adoption of said Resolution, seconded by Mr.
Goodling and carried. Copy of Resolution #65-16 is attached to
these minutes and made a part thereof.
Resolution #65-17 was presented covering the appointment of
McFadden A. Newell, Jr. for a three year term on the Board of
Assessment Review and confirming the terms of Walter H. Freeman
for two years and Richard Hamilton for one year as of July 1st,
1965. Mr. Weldon moved the adoption of said Resolution, seconded
by Mr. Parks and carried. Copy of Resolution #65-17 is attached
to these minutes and made a part thereof. Copies of said Reso-
lution will be sent to members of the Board.

Resolution #65-18 was presented covering Lot Cleaning for 1965
of certain lots as listed. There was a discussion during which
costs were discussed as well as method of billing the lien. It
was suggested that bill could go out with tax statement, as our
present tax form does not provide space for special liens. Mr.
Parks moved adoption of said Resolution, seconded by Mr, Weldon
and carried Copy of Resolution #65-18 is attached to these min-
utes and made a part thereof.
Resolution #65-19 was presented expressing appreciation of the
favorable publicity Miss Elesa Nelson has brought to the City as
a teenager who has received outstanding recognition in the field
of tennis. Mr. Goodling moved the adoption of said Resolution*
seconded by Mr, Weldon and carried. Copy of said Resolution 65•
19 is attached to these minutes and made a part thereof. Copy
of resolution will be sent to Miss Nelson and the press.
Resolution #65-20 was presented expressing appreciation to Mr.
Alan Potter for faithful service to the people of Atlantic Beach
as a member of the Board of Assessment Review. Mr. Goodling
moved the adoption of said Resolution, seconded by Mr. Weldon
and carried. Copy of Resolution #65-20 is attached to these min-
utes and made a part thereof.
An ordinance amending Section VII Paragraph 7 (c) as regards re-
quirements on size of living area per unit in multiple family
dwellings in Zoning Ordinance 90-59-3 was presented in writing
in full. Copies were sent to the Commissioners in advance as
required, Mr. Weldon suggested that the wording be changed from
"the maximum number of living units per acre, etc. " al written
to "the maximum ratio of living units per acre, etc. " Mrd Park,
moved that the Ordinance be passed on first reading by title only
as amended, seconded by Mr. Weldon and carried. June 14th, 1965
was set as date for Public Hearing on said Ordinance. Copy of
ordinance will be sent to Mrs. Keeth advising her also of Public
Hearing date.
Mr. Craig requested approval for purchase of 12 meter boxes from
Account #1501 in the amount of $32.40 plus freight. Mr. Goodling
moved approval of the purchase, seconded by Mr. Weldon and carried.
Request received from Mrs. Bertha Hairston for rezoning of her
Lots 5 & 6, Block 1, A.B.P. from Residence A to Residence C was
referred to the Advisory Planning Board for study and recommen-
dation in line with motion of Mr. Weldon, seconded by Mr. Parks
and carried. Copy of ordinance amending Zoning Ordinance as to
size of living areas will be sent to Mrs. Hairston with date of
Public Hearing covering same.

A letter was read from the Florida State Road Department advis-
ing that they are changing the speed limit on Mayport Road within
the City Limits to 35 MPH and to 45 MPH from City limits to en-
trance to Mayport base. This is temporary pending construction
of highway. The letter was received for filing and information.
Copy of letter from Robt. W. Gordon, Councilman of Neptune Beach
to John P. Ggllager & Asso. regarding a utility study was re-
ceived for information and filing.
Letters were read for information and filing from Atlantic Beach
First Baptist Church and from the Ville de Montreal, Canada.
The report of Police and Fire Department for month of April, 1965
was received for information and filing, as were the several
copies of the municipal court dockets for month of May, 1965.
There was discussion of arrests and number made by different
officers. There was general discussion of the reports.
Mr. Craig reported that steps have been completed at 2nd, 4th,
6th, 10th, 11th and 13th Sts, and plan to have all finished in
near future. The sprinkler system at the City Hall park has been
partially completed. The street re-surfacing by Houdaille-Duval
has been completed and good work was done. We are limerocking
other bad areas in the City. He advised there would be a street
light on Sailfish in neighborhood of Pic "N Save.
There was discussion as to locations on which "stop"signs were
needed and the Public Works department will handle. Chief Vogel
advised the surfers have been requested to use area between 7th
St. ramp and pier site as they aid last year.
Chief Vogel reported on Law Enforcement Academy which he attend-
ed in Tallahassee.
The Commission will get to-gether as a committee on finances on
Wednesday.
There being no further business th: ayor declared the meeting
adjourned.

WHEREAS, Miss Elesa Nelson has given to the City of
Atlantic Beach a great deal of favorable
publicity as a fine example of an outstanding
teen age citizen, and,
WHEREAS, her accomplishments in the field of tennis have
been possible only through countless hours of
sacrifice, effort and concentration, and,
WHEREAS, she is one of the finest women tennis players
in her age division, being Women' s Champion
in Duval County, ranking No. 2 in the State
and 21st in the Nation, andlhas received
recognition by all of the news media,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH, FLORIDA, that,
