04-15-65 v .Y MINUTES OF THE SPECIAL MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON THURSDAY, APRIL 15TH, 1965 AT 8 P.M. Present: George R. Olsen, Mayor-Commissioner and Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Olsen who explained that it was impossible to get a quorum until 9 P.M. He therefore continued this meeting to reconvene at 9 P.M. The meeting was called to order at 9 P.M. with the following present: George R. Olsen Chas. R. Moore Donald Goodling Walter J. Parks, Jr. John W. Weldon, Commissioners and Frank Thompson, City Attorney Arthur J. Craig, City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Olsen. The Invocation was given by Commissioner Weldon. Before opening the meeting for Public Hearing on the Re-Zoning of part of the Hotel Reservation Site, Mr. Olsen read a report giving suggested classification worked out as a compromise at discussions held with the prospective buyers. Copy of this report is attached to these minutes and made a part thereof. Mr. Thompson advised that he knew of nothing in charter to prevent zoning as Business "A" then immediately presenting a new Ordinance re-zoning to Busi- ness "A-1" . Mr. Olsen requested all speakers to address the chair and identify themselves. He then declared the meeting open for continuation of the Public Hearing. Mr. Henry Isaacs suggested that the Commission pass the Ordinar., on second and final reading as we have already had discussion and the buyers and sellers are ragf`ecd on report presented and the meeting could be closed. Minutes of 4-15-65, Page #2 Messrs. Tom Shuff, George Pettway, Ernest Smith, H.D. Sherwood, Mr. and Mrs. Ralph Brown and others spoke restating their opposi- tion as expressed in the previous meeting. They do not want a convention type motel-hotel , nor a hotel next to their homes in Residence "A" , and are concerned about the traffic problem. Messrs. Jack Revels, George Pritchard and Alan Potter feel we should have preliminary plans of proposed development. Messrs. Fred Allen, Bob Lynch, A.J. Bloom , Henry Isaacs, Angus Dunlop, John Tischer, Mrs. Josephine Blenadheim and others appeared in favor of the re-zoning. Mr. Gerry Adams, present owner of the Atlantic Beach Hotel, advised that in developing Club Manor they provided deed restrictions so that they would always during life of restrictions have residences there, but that the hotel site has been business since the beginning of use of that land, and he did not know that it had been changed at the time of the overall rezoning in 1959. Mr. Parks spoke at length on our apprehension of change, yet we not even in our own homes can remain without change. He expressed concern over the traffic problem which will have to be dealt with, and the access to the property. He pointed out the widths of Ocean Blvd. especially that part adjoining the Hotel Site on the west which only has 21 foot paving, that something is going to have to be done, but that he is opposed to the City's purchasing right-of-way from the new purchasers for the enhancement of their proposed development. He believed the purchasers would carry out the traditions established by Mr. Adams in operating the establish- ments. Mr. Weldon again brought out the question of the deed to the right- of-way ight- of-way which he would like brought out again for acceptance by the Commission, but Mr. Thompson advised that it contained a con- dition that it be accepted in 6 months, and the time limit had long passed. There was discussion of this right-of-way between 7th St. and 10th St. on Ocean Blvd. and it was agreed that we have no title other than that obtained through use. Following further discussion, in which Mr. Oliver Ball advised as a home owner and close neighbor he was in favor of the re-zoning as felt it would be an improvement that would benefit the whole town, Mr. Olsen declared the Public Hearing closed. Mr. Goodling advised that he was satisfied that the proposed re- zoning and report made by the Mayor would be to the benefit of the community as a whole with proper diligence on part of this and subsequent Commissions and he therefore moved that Ordinance No. 90-65-20 be adopted on second and final reading, seconded by Minutes 4-15-65, Page #3 Mr. Moore. It was the consensus of all the Commissioners that they were voting for no personal reasons, but for what they felt was best for the City as a whole. There was further discussion as to the right-of-way between 7th and 10th St. , and Mr. Moore brought out that the widening would also be beneficial to those living both north and south of this section, and would benefit the town as a whole. The Mayor then put the question and the call vote was: Aye: Goodling, Moore, Parks, Weldon, Olsen Nay: None Whereupon Mr. Olsen declared Ordinance #90-65-20 passed on second and final reading. Mr. Olsen then presented an ordinance in full in writing said Ordi- nance amends Zoning Ordinance #90-59-3 by establishing a Business Zone "A-1" establishing definite uses and describing exact location of said Business Zone "A-1". Mr. Goodling moved that the rules be waived and that said Ordinance as presented be adopted on first reading by title only, said Ordinance to provide a buffer zone of 72 feet, seconded by Mr. Moore and carried. The Public Hearing on said Ordinance was set for May 10th, 1965 at 8 P.M. There being no further business to come before this meeting, the Mayor declared the meeting adjourned. Grage, City Cle .0 I April 15, 1965 At the last public hearing it was suggested that we attempt to meet with the prospective purchasers of the hotel property and try to work out a compromise concerning the Business A classification on the southermost parcel. Discussions with the prospective buyers has resulted in the proposal to establish a classification of Business A-1, which would allow the following uses: A. Any uses specified in Sections IV,V,VI, and V11 of the zoning ordinance. B. Hotels and Motels C. Restaurants (except drive-in restaurants) , Cocktail lounges, barber shops, beauty parlors, retail stores, and similar businesses operated in conjunction with and within a motel or hotel. In addition, the specific boundaries of this district A-i will be contained in the ordinance. These boundaries comprise the areas set forth as parcels A and C of the Hotel Reservation on the survey. In order to comply with legal requirements the commission must act on the original ordinance which was presented and read in full at the public hearing held Thursday April 8, 1965 in City Hall of Atlantic Beach. If this ordinance is passed the ordinance establishing the classification of Business A-1 will be presented on first reading for passage by title only. A public hearing will then be set. The prospective purchasers of the property are aware of this procedure and plan and are in agreement with it since the A-1 Classification will be sufficient for their plans. We are asking you to keep the above items in mind as we conduct tonight's public hearing.
