MINUTES OP THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH
CITY'COMMISSION HETET).AT TIE CITY HALL ON MONDAY, SEPTEMBER
11TH, 1961, AT 8 P.M.

The meeting was called to order by the Mayor—Commissioner,
Mr. Howell.
Minutes of the meeting of "August 28th; 1961 were approved as
written upon motion of Dr. Whitehurst, seconded by Mr. Moore
and carried.
Mayor Howell recognized -visitors present -and called for any
business from the floor. There was none.
A letter was presented from Wm. I Segal requesting that the
property on the northwest corner of Levy Road and Mayport Rd.
be zoned back to Business "B" rather than Industrial which it
was changed to. The matter was discussed at length, and it
was brought out that it was felt that having this property
Industrial fitted into the overall plan for an-.Industrial park
area which is under consideration at this time. It was also
questioned by Mr. Moore as to whether it was the best thing
to change this property to Industrial since it is surrounded
on 3 sides by Business "B" zone, and that we should give the
request serious consideration. After further discussion Dr.
Whitehurst moved that the matter be referred to the Commission
acting as a Zoning Committee for consideration and report back
to the next meeting, seconded by Mr. Claiborne and carried.
Mr. Moore moved that we advertise for bids to be received at
the meeting of September 25th, 1961 on the West Second Street
Sewer Project, seconded by Mr. Johansen and carried.
A letter was presented from the owners of Lot 12, Block 10
requesting permission to build a garage on their lot in which
to store their belongings until such a time as circumstances
allowed them to build their house. The matter was discussed
following which Mr. Claiborne moved that since the Zoning
Ordinance does not permit the building of the accessory'build— .
ing before the main building that- the request be denied, sec—
onded by Mr. Johansen and carried.
Mr. Waggoner presented bills from Mr. Walter J. Parks, Jr. En—
gineer covering services on Second St. Paving Project in the

amount;.of: $468.00 and the Ocean Blvd. Project in the amount of
$2,622.40. Mr. Johansen moved that these bills be paid '.in the
amounts as specified, seconded by Mr. Moore and carried.
Relative to the City Playground project lir. Waggoner advised:,
that we have received and'recorded the deed from Hr. and Mrs.
Bailey on Lot 38, Saltair, but that we had not heard from the
Dow heirs relative to Lot 50, Saltair. He also reported that
the landfill has started on the proposed area.
Mr. Howell presented Resolution #61-29 setting the installment
dates on the -Ahern Street Special Assessment Roll and read same
in full. Dr. Whitehurst moved the adoption of said Resolution
#61-29, seconded by Mr. Johansen and having been duly considered
the Mayor put the question thereon and the vote was unanimous in
favor of said Resolution. Copy of Resolution #61-29 is attached
to these minutes and made a part thereof.
Mayor Howell next presented Ordinance #90-61-12 and read same
in full, and declared the Commission in session for Publio Hear-
ing on said ordinance which amends Zoning Ordinance # 90-59-3 as
regards fences and walls. Copy of certified proof of publication
of Notice of Public Hearing on said Ordinance is attached to these
minutes and made a part thereof. Mr. Harcourt Bull advised that
he felt there should be clarification as to corner lots and the
heighth of fences . It was agreed that the provisions of para-
graph 14 of Sec . Ill of Ordinance 90-59-3 be tied-in with the
provisions of this Ordinance . Following the discussion:. , the
Mayor declared the Public- Hearing closed. Whereupon Dr. Whitehurst
moved that Ordinance #90-61-12 be adopted on second and final
reading amended as suggested, seconded by Mr. Moore and carried.
Mayor Howell presented in full ' in writing an Ordinance changing
the name of parts of Levy Road: Mr. Johansen moved its adoption
by Title Only on first reading, seconded by Mr. Moore and having
been duly considered the motion was unanimously carried. Septem-
ber 25th, :.1961 was set as the date for Public Hearing on said
Ordinance.
Mr. Johansen presented an Ordinance in full in writing covering
Fallout Shelters and moved its adoption on first reading by Title
Only, seconded by Mr. Claiborne, aft(' having been duly considered
the motion was unanimously carried. September 25th, 1961 was set
as date for Public Hearing on said Ordinance .
The City Clerk announced that the millage for the 1961 Tax Roll
is 6.73 Mills.
There being no further business the Mayor sic e the mee '

RESOLUTION NO. 61 - 29
WHEREAS, at the time of the passage of Resolutions
No. 60-25 and No. 61-10 the letting of the contract
covering the paving of Ahern Street between East
Coast Drive and Sherry Drive was contemplated, and
WHEREAS, a delay was occasioned in the letting of
said contract,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF ATLANTIC BEACH, FLORIDA, That
The first installments of the assessments designated
on said Special Assessment Roll shall be due and pay-
able 30 days from September 11th, 1961 and the second
installment one year from due date of the first in-
stallment, and that
In all other respects said Resolutions No. 60-25 and
No. 61-10 are hereby ratified and confirmed.
Passed by the City Commission of the City of Atlantic
Beach, Florida on September 11, 1961.
