HELD AT THE CITY HALL ON MONDAY, MAY 8th, 1961 AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of April 28th, 1961 were approved as
written upon motion of Mr. Moore, seconded by Mr. Claiborne
and carried.
Florida Highway Patrol Trooper,D.R.Jansen, Troop G Safety Offi-
cer presented the Florida Department of Public Safety award to
the City for not having a traffic fatality during 1960. Mayor
Howell accepted the award on behalf of the City.
Mayor Howell recognized visitors present and called for any bus-
iness from the floor. The Reverend Mr. Hudson, Pastor of the
Assembly of God Church on Mayport Road, requested that a speed
zone be designated on that part of Mayport Road in front of their
church property, and also that when the next street lights are
available that one be installed at their church corner.
Mr. Russell F. Smith requested advice as to what can be done
about the damage dogs are doing to his property. He was ad-
vised of the provisions as set up in the new Dog Ordinance.
The Commission next went into session for Public Hearing on the
Special Assessment Roll covering the paving of Ahern Street be-
tween East Coast Drive and Sherry Drive. Certified copy of
Proof of Publication is attached to these minutes and made a
part thereof. Mr. Wm. H. Bennett, Miss Margaret Macon and Miss
Miriam Carter appeared against the paving. Mr. Moss and Mr. and
Mrs. Markert appeared for the paving, and Mr. H.F. Forst advised
that he was in favor of the paving if it would help the (xainage
problem. Mr . R.R.Boatright of Sinclair Refining Co. advised
that his Company would be ready to pay their assessment if same
is approved. There were 5 remaining owners who were not pre-
sent. Following this discussion the Mayor declared the Public
Hearing closed, whereupon Mr. Claiborne presentd Resolution
#61-10 confirming the Special Assessment Roll on the paving
of Ahern St. between East Coast Dr. and Sherry Dr. , and moved
its adoption, seconded by Mr. Moore, and having been duly con-
sidered the Mayor put the question thereon and the vote was
unanimous in favor of. Copy of Resolution #61-10 is attached

Upon motion of Dr. Whitehurst, seconded by Mr. Moore approval'.
was given to Call for Bids on the Ahern Street Paving project,
bids to be received on June 12th, 1961 at 3 P.M.
A request was received from Mr. L. Counts for license to operate
a business -at 411 Levy Rd. for the purpose of assembling fuel
oil guages . The business is known as the 3 in One Guage Co.
It was discussed and brought out that there would be no manufaG.-
turing but only an assembling of parts that are made elsewhere;
There would be no noise, smoke or fumes in this operation. Dr.
Whitehurst moved that the license be granted, seconded by Mr.
Moore and carried.
Mrs. Delma Hill, whose request to operate a Day Nursery was re-
ceived at the last meeting, was present and presented signatures
of neighbors adjoining her property advising that they had no
objection to Mrs. Hillis caring for children in her home. She
also presented a letter advising of her qualifications . The
matter was discussed and upon motion of Mr. Moore, seconded by
Dr. Whitehurst - and carried, approval was given for issuing a
license to Mrs . Hill for a day nursery.
A request was received from Hattie Mae Bell of 50 Dudley St. to
have a small grocery store in her home at this address . The
matter was discussed following which Mr. Moore moved that Hattie
Mae Bell be permitted to operate a small grocery 14 her home,
seconded by Mr. Claiborne and carried.
Mr. Waggoner recommended that the Commission approve the purchase
of the backhoe from the Forrestry Equipment Company who made
the low bid of $2,495 .50 . It was discussed following which
Mr. Moore moved that Mr. Waggoner' s recommendation be accepted
and that the backhoe be purchased - from the Forrestry Equipment
Co, the low bidder, seconded by Dr. Whitehurst and carried.
Mr. Waggoner recommended that we run our water service down May-
port Road some 510 feet to West First St. using 8" pipe at an
approximate cost of $1,700.00 and he also recommended that a
fire plug be installed at the corner of W. 1st St. and Mayport
Rd. It was brought out that this is in line with Engineer' s plans..
Following a discussion, Mr. Moore moved that the water serVice
be extended as recommended by hr. Waggoner, seconded by Hr. Clai-
borne and carried.,
A bill was presented from Mr. Walter J. Parks , City Engineer,
in the amount of $2,993.80 to cover services rendered in connec-
tion with the Donner Sewer Project. Upon motion of Mr. Moore,
seconded by Dr. Whitehurst and carried approval was given for the
payment of this bill.,
Dr. Whitehurst presented Resolution #61-11 accepting sewer lines,
water lines , paving, etc . on parts of' Sailfish Dr. , Sabalo Dr:
and Redfin Dr in Royal Palms Unit #2; and moved its adoption,
seconded by Mr. Claiborne and carried. Copy of Resolution #61-i1
is attached to these minutes and made a part thereof.

On the matter of the Interstate Contracting Co. Water line on
the Plaza, the information was referred to the City Attorney,
Mr. Thompson to write the necessary Resolution and certificate
of indebtedness to cover. The Commission affirmed its previous
decision of making payment in amount equal to 15% of sewer ser-
vice charges collected from Royal Palms Unit #1 .
Mr. Waggoner advised that he is in receipt of request to tear
down the shack' located on the Northeast corner of Mayport Road
and Ardella St, and plans for a new building to be erected thereon.
He requested the Commissions ' approval. - It was discussed and
upon motion of Mr. Moore, seconded by Mr. Claiborne and oarried
apptoval was given for the improvement as presented by Mr. Waggo..
nor.
Mr. Howell next read Ordinance #65-61-1 in full covering the aban-
doning of the alley lying north of Lots 1 through 6 , Atlantic
Beach Terrace and declared the Commission in session for Public
Hearing on said Ordinance. Notice of Public Hearing on this Ord-
inance has been posted in line with charter requirements. As no
one appeared either for or against this Ordinance the Mayor de-
clared said Public Hearing closed, whereupon Dr. Whitehurst moved
that said Ordinance #65-61-1 be adopted on second and final read..
ing, seconded by Mr. Moore and carried.
Mr. Claiborne presented an Ordinance in full in writing covering
the re-zoning of the northwest corner of Mayport Rd. and Levy Rd.
and Tract 3 of Donner' s Replat from Business "B" to Industrial;
and moved its adoption on first reading, seconded by Mr. Moore.
Having been duly considered, the Mayor put the question thereon
and the vote was unanimous in favor of said Ordinance. The date
for Public Hearing was set for June 12th, 1961.
There being no further business the Mayor declared the meeting
adjourned.

RESOLUTION NO. 61-10
A RESOLUTION CONFIRMING THE SPECIAL
ASSESSMENT ROLL AND THE ASSESSMENTS
THEREON SHOWN, LEVIED TO DEFRAY A PART
OF THE COST FOR THE PAVING OF A POR-
TION OF AHERN STREET, PREPARED IN
ACCORDANCE WITH RESOLUTION NO.60-25
OF THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA
WHEREAS, pursuant to Resolution No. 61-6 of the City
Commission of the City of Atlantic Beach, Florida, and the
Notice given and published as provided thereby, the said
City Commission did sit in the City Hall of said City at
8 o'clock P.M. on May 8, 1961, as an equalizing board to
hear and consider any and all complaints as to the special
assessments shown on the special assessment roll prepared
pursuant to Resolution No. 60-25 of said City Commission
providing for special assessments to defray part of the
costs for the paving of a portion of Ahern Street lying
between East Coast Drive and Sherry Drive in said City;
and
WERREAS, the said City Commission has found and de-
termined that the said assessments as shown on said ass-
essment roll are, and each of them is, just and right;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF ATLANTIC BEACH, FLORIDA:
That the special assessments, and each of them, as
shown on said special assessment roll, be and the same are
hereby confirmed and shall remain legal, valid and binding
first liens upon the property against which such assessmentS
are made until paid; provided however, that upon completion
of said improvement, the City shall credit to each of said
assessments the difference in the assessment as shown on
said Roll and hereby approved and confirmed, and the pro-
portionate part of the actual cost of said improvement to
be paid by said special assessments as finally determined,
upon the completion of said improvement.

RESOLUTION NO.
WHEREAS, the Interstate Contracting Company, developers of
Royal Palms Subdivision, have completed all of the sewer
lines, water lines, storm drainage lines, curbs and gutters,
and paving in Sailfish Drive East between Plaza and Seaspray
Avenue, Sabalo Drive and Redfin Drive between Sailfish Drive
East and Royal Palms Drive, and Royal Palms Drive between
Plaza and Sabalo Drive all in Royal Palms Subdivision Unit
2 and,
WHEREAS, the facilities have been installed according to the
approved plans and specifications and have been inspected by
the City Forces and,
WHEREAS, the Interstate Contracting Company has posted a one
year maintenance bond in the amount of $3,600.00 to insure
their proper construction,
NOW THEREFORE BE IT RESOLVED BY THE CITY OF ATLANTIC BEACH,
FLORIDA, That,
The City of Atlantic Beach accept these sewer lines, water
lines, storm drainage lines, curbs and gutters, and paving
in Sailfish Drive East between Plaza and Seaspray Avenue,
Sabalo Drive and Redfin Drive between Sailfish Drive East
and Royal Palms Drive, and Royal Palms Drive between Plaza
and Sabalo Drive all in Royal Palms Subdivision Unit 2 for
maintenance and operation.
