MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY' -
COMMISSIQN HELD AT THE CITY HALL ON MONDAY, FEBRUARY 12TH,1962
AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Isaacs.
Minutes of the meeting of- January 22nd, 1962 were approved as
written upon motion of Mr. Johansen, seconded by Mr. Claiborne
and carried.
Bids were next received covering the extension of the sewer
lines to W. Eighth St. and Mayport Road. The bids were as
follows:
Stevens-Southern Co. $4,925 -.00
Art Reinertson Construction Co. 4,397.25
It was brought out that the bids are considerably higher than
the Engineer's estimate on this project. Mr. Johansen moved
that the bids be received for tabulation and turned over to tie
City Manager to study-and make recommendation, seconded by Mr.
Claiborne and carried.
Mayor Isaacs recognized visitors present and called for business
from the floor, not on the agenda . Mr. Don Goodling advised
that the Board of Deacons of the Community Presbyterian Church
recognizes that there is a traffic problem at the church due to
parking in front of' homes , and they have appointed a group to
work out a solution, and they would like to work with the city
on this problem. They were advised to get in touch with Nr.
Waggoner who will work with them on the matter.
A letter was read from Hon. Chas . E. Bennett, M.C . relative
to the proposed Department of Urban Affairs, asking for an opin-
ion on same, also a letter from Home Builders Association ex-
pressing opposition to the proposed Urban Affairs Department.
It was thought that the Commission should not express a collec-
tive opinion, but if they wanted to do so individually- OK.
Mr. Claiborne moved that no action be taken On this matter at
this time, seconded by Mr. Moore and carried.
A letter from Alan W. Potter re: Expansion of Water' Supply and
Treatment Facilities for the City of Atlantic Beach, Florida
under Subject: Letter of February 2, 1962:Copy Attached, was

presented and read. Mr. Moore moved that the letter be accepted
in the spirit written and that acknowledgement of same be so
incorporated in the minutes, seconded by Mr. Claiborne and
carried.
There was no further information as to the annexation which has
been requested by Mr. Al James, but the main thing is that Mr.
James would like to get Oity water as soon as possible. T1r.
Waggoner advised that it will cost $217:30 (estimate) to run the
line and furnish metet for this service. It was the consensus
of opinion that if Mr. James approves of this cost that Mr. Wag-
goner go ahead and provide him with the water service. It was
agreed that Mr. James understands that he is to pay out of city
rates until such a time as his property is annexed.
Mr. Claiborne advised that study was made of. plot presented by
Mr. Tom Ellis on the Mayport Road site, and it is recommended
that the Zoning of this -site be changed to Business "A" in line
with Mr. -Ellist request. The matter was discussed following
which Mr. Claiborne moved that the rules be waived and that an
Ordinance approving this Zoning change be considered by Title
Only on first reading, seconded by Mr. Johansen and carried.
Whereupon Mayor Isaacs presented said Ordinance in full in writing
and Mr. Lawrence moved that said Ordinance Am€;nding Zoning Ordi-
nance by changing the Zoning on said site located on Nast side
of Mayport Rd. lying between Atlantic Beach Villa and the Plaza
be passed by title only on first reading, seconded by Mr. Johan-
sen and - carried. March 12th, 1962 was set as date for Public
Hearing.
Mr. Waggoner advised that Mayor Isaacs, Director of Public Safety
had requested him to get a cost figure on lowering the siren to
the next lower cross-brace as it is believed it could possibly
be heard better if lowered. Mr. Waggoner advised that it will
cost approximately $250.00 to do this . The matter was discussed
during which Fire Chief Howell advised that he has discussed the
matter with one of the professors at Jacksonville University and
he is of the opinion that the siren is too high. However he
thinks if it costs that much to lower that it might be better to
put in an additional siren say on a 30 foot pole in another loca-
tion , and perhaps -get a better siren coverage. It was discussed
following which Mr. Claiborne moved that the City Manager and
Director of Public Safety get to-gether and look into the matter
and see what should be done, seconded by Mr. Moore and carried.
Mr. Waggoner advised that Mr. Richard Hamilton will appraise the
12 lots in Saltair lying on the Plaza west of the present play-
ground area for $150.00. Mr. Claiborne moved that we have Mr:
Hamilton make the appraisal at the fee quoted, seconded by Mr.
Lawrence and carried.

Mr. Waggoner advised that we have an invoice from the Rivers
Trailer and Equipment Co. for the large garbage containers in
the amount of x;730.00 and we would like approval to pay this
invoice. ' The users of these containers are repaying the City
for same. Mr. Johansen moved that this invoice be paid to
Rivers Trailer and Equipment Co. , seconded by Mr. Moore and
carried.
It was suggested that we put some trash containers at the buss
ness corner along the area of the drug store and grocery to see
if we can help the condition caused by children and adults throw-
ing trash on sidewalk and street. The matter was discussed, and
it was the consensus of opinion that we put some containers at
the corner' and try out, and also clean the sidewalks of the
bubble gum, etc.
Mr. Waggoner presented a request for a sign to be erected by
Mr. Pleasant Gay on Atlantic Blvd. The matter was discussed
and the fact that he has not completed work promised to be done
on previous permits was brought out. Following discussion Mr.
Johansen moved that we hold up issuing the permit for sign until
Mr. Gay shows good faith, seconded by Mr. Moore and carried.
Mr. Waggoner next presented a request from Mr. Gay for a 'permit
to build on the lot west of where the laundry is located. Mr.
Claiborne moved that the permit be held up.until until we hear
from Hr. Gay as to what he is going to do , seconded by Mr.
Johansen and carried. Mr. Lawrence said he would like to raise
the point as to whether we can legally stop a permit which meets
all our requirements on building code and zoning.
Hr. Waggoner next requested approval of a permit for 'a sign to
be erested at the Van Kleeck Garage on Atlantic Blvd. Mr. Wag-
goner advised that work has already started on the sign, but that
it had been stopped at his direction. He also advised that it
appears to be on the State Right-of-way but they advise that it
is on their lot. The matter was discussed following which Mr.
Claiborne moved that a permit be issued for a 41X8' sign to be
erected by the Van Kleecks on the property, and_ to-be sure
the permit so stipulated, seconded by Mr. Moore and carried.
A permit was next requested for approval for a sign by Newberry
TV t0 .be erected on the top of the Bennett building on Seminole
Road. After discussion Mr. Claiborne moved that the permit be
approved for the erection of this sign, seconded by Mr. Johansen
and carried.
Hr. Waggoner has received an application from Willie Carter for
an addition to his residence on Si of Lot 5 , Block 2, Donner S/D
located at 31 Lewis St. in the Business Zone. He would like the
Commission's approval for this permit which meets building code
but is located in Business Zone. The matter was discussed'fol-
lowing which Mr. Johansen moved that the permit be granted, sec-
onded by Hr. Moore and carried.

Approval was next requested by Mr. Waggoner on a request for per—
mit received from Mamie Dassie to build a block addition to the
old building located on Lots 1Z & 2Z, Block 17 Donner S/D on
east side of Mayport Rd. in Business B. It was discussed and
agreed that the plans meet specifications and will also improve
the property. Mr. Lawrence moved ' that the permit be granted,
seconded by Mr. Moore and carried.
Mr. Waggoner requested permission to prepare specifications and
call for bids on the proposed addition to the Fire Station, Fol—
lowing a discussion Mr. Johansen moved that necessary papers be
prepared and bids called for on the "Fire Station addition, sec-
onded by Mr. Claiborne, and carried.
Mr. Waggoner presented a sketch showing proposed locations for
the additional street lights. It was studied and the consensus
of opinion that action be delayed on this project until further
study could be made as to locations.
The Humane Society report for the month of January, 1962 was
read and filed.
Mr. Russell F. Smith spoke on the administration of the present
Dog Ordinance and made a verbal complaint against the Birchall
dogs . Mr. Waggoner was directed to contact the Birchalls about
their dogs. There was a lengthy discussion on dogs.
Mr. Waggoner 44.44g1WMIonthly man hour report as requested by
the Commission. It was received and filed. He also advised
that he had received 19 coiaplaints,1$ of which have been taken
care of and 1 is still not finished.
A letter from Mr. Levy requesting permission to make test as to
the verticle flow measurements on the existing 12" well was re-.
f erred to our Engineer, Mr. Parks and he advised that he is by
no means opposed to securing new information and making use of
same, but in this instance regards the possible benefits not suf—
ficient to warrant the hazards involved. Mr. Waggoner advised
that the information received would be well to have , and our
cost would be in the purchase of a 12" valve for approximately
$200.00, plus pipe and labor. It was suggested that we perhaps
could borrow a 12" valve to be used in the test, however if we
bought one it could be used in the new project. Mr. Moore ad—
vised that he believes he can borrow a 12" valve. It was the
consensus of opinion that there is no objection to the test being
made if a valve can be secured.
The Commission next went into session for a Public Hearing on
the Special Assessment Roll covering the sewer extension on
W. 2nd St and on Levy Rd. Certified Proof of Publication of
Notice of this Hearing is attached to these minutes and made a
part thereof. As no one appeared either for or'against the Roll
Mayor Isaacs declared the Public Hearing closed. Whereupon Mr.
Johansen presented Resolution #62-3 Approving and Confirming said

Special Assessment Roll, and following its reading moved its
adoption, seconded by Mr. Moore and having been duly considered
the motion was carried. Copy of Resolution I62-3 is attached to
these minutes and made a part thereof.
Mayor Isaacs next read Ordinance #12-62-2 in full, said Ordinance
provides for changing of the territorial limits of the City of
Atlantic Beach by annexation of a certain tract of land as des-
cribed in said Ordinance and on which the Selva Marina Country
Clubhouse is situated. He then declared the Commission in session
for Public Hearing on said Ordinance , notice of Public Hearing
having been posted in line with requirements of the charter. As
no one appeared dither for or against said Ordinance the Mayor
declared said Public Hearing closed. Mr. Johansen moved that
said Ordinance #12-62-2 be passed on second and final reading
seconded by Mr. Claiborne and having been duly considered the
Mayor called for the vote which was as follows:

Johansen - aye
Lawrence - aye
Moore - aye
Isaacs - pass
Whereupon the Mayor declared the motion carried and said Ordinance
passed and adopted on second and final reading. The Clerk was
directed to publish said Ordinance in line with provision con-
tained therein.
Mr. Johansen reported that there had been a meeting with Mr.
Bob Harris, County Commissioner and that plans are proceeding
and they plan another meeting with Mr. Harris.
Mr. Lawrence advised that his committee is not yet ready with a
report as to the traffic situation both in the City and its re-
lation to the Mayport Base.
Report for the month of January, 1962 was received from Fire
Chief Howell and filed.
Report for January, 1962 was received from Police Chief McClung
and filed.
There being no further business Mayor Isaacs declared the meeting
adjourned.

RESOLUTION CONFIRMING SPECIAL SEWER ASSESSMENT ROLL.
WHEREAS, pursuant to Resolution No. 61-23 of the City Com-
mission of the City of Atlantic Beach and other proceedings
duly had and taken in conformity with and pursuant to the
provisions of Chapter 184 Florida Statutes, the said City
did cause to be constructed, in said City, Sanitary Sewers
and,
WHEREAS, after the completion of said work, the Engineer
for said City did prepare a Preliminary Assessment Roll in
the manner and form as required by said Statute and filed
the same with the City Clerk and,
WHEREAS, after the filing of said Roll as aforesaid the
City Clerk did publish notice as provided for and required
by said Statute and stating that at the regular meeting of
the City Commission of said City to be held at 8 o'clock
P.M. at the City Hall of said City on February 12th, 1962,
all interested persons might appear and file written ob-
jection to the confirmation of said Roll and,
WHEREAS, at the time and place stated in said notice the
said City Commission did meet to consider said Roll and to
receive and consider any objections that might be made to
the confirmation thereof and no objections from any persons
was made or presented and,
WHEREAS, the said City Commission has found and determined
that the said Roll is in all respects proper and correct and
that no assessment shown thereon is in excess of the special
benefits to the property assessed and that all assessments
shown thereon are in proportion to the special benefits to
the property assessed and that said Roll should be confirmed,
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORIDA, That,
The said Special Assessment Roll and each assessment shown
thereon be and the same are hereby confirmed in all respects
and that the said Roll be forthwith delivered to the Treasurer
of said City and,
BE IT FURTHER RESOLVED, that, any assessment may be paid at
the office of the Treasurer of said City within 30 days after

date of this Resolution without interest. All assessments
mAy be paid in three (3) installments as follows:
(a) First Installment - for each lateral
plus 51.52% of footage assessment based on V; per foot
on March 14th, 1962.
(b) The Unpaid Balance of said Assessment in two
equal annual installments thereafter with interest at 6%
per annum.
All installments shall bear interest at the rate of 6% per
annum from and after March 14th, 1962 until paid, however,
any assessment may be paid at any time before due together
with interest accrued thereon until date of payment.
