MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, OCTOBER 10, 1966
AT 8: 00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Parks.
The minutes of the meeting of September 26, 1966 were approved
as written upon motion of Mr. Parks, seconded by Mr. Holloway
and carried.
Bids were received for 1967 Police Car - Certified proof of
publication for 'Call for Bids" is attached to these minutes
and made a part thereof. There was only one bid received which
was opened and is listed as follows:
Gordon Thompson Chevrolet, Inc. $1,676.76
Mr. Holloway moved that the bid be referred to a Committee for
study and report at the next meeting, seconded by Mr. Goodling
and carried. Mr. Howell appointed Mr. Holloway, Mr. Bennett
and Chief Vogel as the Committee.
The Mayor recognized many visitors present and called for any
business from the floor not on the Agenda. Mr. Richard Riley
was present with his client, Mr. M. H. Bagedonow, and requested
recognition which was granted. He directed a question to
Commissioner Goodling as to whether or not he had contacted
Mr. James H. Winston relative to his client, Mr. M. H. Bagedonow.
Mr. Thompson ruled the question was out of order as this meeting
is to transact City business and is not a grand jury hearing.
On advice of the City Attorney, Mr. Howell ruled Mr. Riley out
of order. Mr. Riley and Mr. Bagedonow left the meeting.

The City Manager presented a written report, copy of which is
attached to these minutes and made a part thereof. He also
presented a letter from the Beaches Fraternal Order of Firemeft
advising they are the sole sponsors of the Benefit Dance and
Fair to be held for the benefit of the Sheriff 's Boys Ranch.
Mr. Parks moved that the Commission go on record as approving
and supporting this project, seconded by Mr. Holloway and carded.
Mrs. Grage advised the 1966 Insurance Coverage expires as of
January lst and 1967 coverage should be considered. Mr. Parks
moved the matter be referred to a Committee to draft, seconded
by Mr. Goodling and carried. The Mayor appointed the same
Committee that handled the 1966 bids last February. This
Committee is Messrs. Weldon, Holloway and Thompson.
Mayor Howell read Resolution #66-14 covering transfer of funds
from Account 1051 to Account 804 - said funds are needed to
purchase chemicals for the Sewer Plant. Mr. Parks moved the
adoption of Resolution #66-14, seconded by Mr. Holloway and
carried. Copy of said Resolution is attached hereto and made
a part thereof.
The report of the Police Department for the month of September,
1966, and the Municipal Court dockets for October 3rd and 10th
were received for information and filing.
There being no further business, Mr. Howell declared the meeting
adjourned.

CITY MANAGER 'S REPORT
1. I have a letter from the Beaches Fraternal Order of Firemen
which states that they are the sole sponsor of the Benefit
Dance and Fair contemplated for the Sheriff's Boys Ranch
to be held in the Jacksonville Beach Auditorium. This letter
stops the confusion in having the City of Atlantic Beach
-- responsible for any part of these doings.
- - I heartily support this movement of the Fraternal Order of
Firemen and recommend to the Commissioners their approval.
2. I now have membership resignations from all of the City
employees that are under my direction from the Club By The
` Sea and the Fleet Reserve Association. All City employees
- have the understanding that they can join any Club or
-
.Organization as longus they pay their membership dues.

. 3. The Heads of the Departments of the City of Atlantic Beach
: thoroughly understand that everyday news pertaining to their
`,. _ . Departments is to be released to be News Media at their
request, but any news that would involve the City of Atlantic
Beach must be cleared through the City Manager so that I can
.-- ask the Commissioners for their recommendations.
4. The quarterly reading on all water meters has been completed.
5. The 1966 lot cleaning has been completed.
._ - _ 6. 600pgallons of. sludge have been delivered from the City of
1 - -Jacksonville to our Digester at the Sewage Plant to improve
.__ -- the 'operations of the Digester.
7. A number of ditches have been cleaned out throughout the City,
-
and especially in the Donner section.
- 8. We have done considerable work on the streets in the Donner
section by grading and installing limerock and shells at the
-- worst spots.

9. The entrance to Sherry Drive from Sturdevant Street has been
blacktopped to stop the erosion of the street.
10. We have installed a new dam in the creek which is the outlet
to the Lagoon in the Selva Marina Golf Club. These dams can be
raised in a very few minutes allowing a large volume of water to
be released from the Lagoon so as to have more of a reservoir
if we have heavy rains.
11. At your request I have written to all property owners that
have shrubbery at the street corners, stating our Ordinance.
To date I have had some very nice response regarding this
Ordinance. I hope that for safety purposes all of the corners
in question can be taken care of in the next few weeks.
12. Our Public Works Department is now working on the main line
• water valveslocated in the City to see that it is functioning
properly.

MR. RILEY: My name is R. J. Riley. At the moment,
I'm representing Mr. Bagedonow. I have one question I
would like to ask this Commission and, incidentally, befor-
I ask it, do I see four Commissioners here?
MAYOR HOWELL: Yes, sir.
MR. RILEY: Is that a quorum?
MAYOR HOWELL: Yes, sir.
MR. RILEY: My question is addressed to Mr. Goodling.
Mr. Goodling, did you by any manner or means contact a
Mr. Jim Winston within one week prior to the Special Meet-
ing held last Thursday with reference to Mr. Bagedonow?
MR. THOMPSON: What is the purpose of this inquisition?
MR. RILEY: Regardless of the purpose, I'm asking the
question, counsellor.
MR. THOMPSON: I want to know the propriety of the

question; that's what I'm trying to get at.
MAYOR HOWELL: Can you explain the propriety of the
question?
MR. RILEY: I surely can. I think Mr. Bagedonow, in
his public spiritedness and in an endeavor to keep the
members of the Fire and Police Department here, offered
them free access to the pool without any ulterior motive
whatsoever and that was turned down by the Council and I'm
asking Mr. Goodling whether or not he contacted Mr. Bage-
donow's boss in reference thereto.
MR. THOMPSON: I suggest, Mr. Mayor, that this meetin:
is not a place to conduct a meeting over some problems tha
some individual may have with some member of this Commis-
sion. Now, this is for City business , and I suggest that
it has no City business.
MR. RILEY: Is this not a general meeting?
MR. THOMPSON: This is a meeting of the City Commis-
sion to conduct uc the City business . Now, I just know you
can go on with this sort of thing for ad infinitum and ad
nauseum. And I don' t think that any Commissioner here
should be subjected to this sort of interrogation. Now,
that question leads to another and we could stay here all
night explaining every bit of it and I don' t think --
MR. RILEY: I'm going to object to that. I think

arb counselor is anticipating whether one question will lead
to another. I asked a simple question and I would like
an answer.
MR. THOMPSON: It would lead to a question from me,
Mr. Riley, because I would have to ask other questions
pertaining to that very question, and I suggest we get
down to the City business.
MR. RILEY: I submit a Grand Jury is composed of
18 to 25 individuals and I don't see such a Grand Jury
convened here to --
MR. THOMPSON: But you're trying to turn it into
that kind of benefit --
MR. RILEY: I object to that; that is strictly an
opinion, too.
MR. THOMPSON: -- some benefit of your client, as
you say, you are representing. I simply represent the
City and let's get on with the --
MR. RILEY: I would still propound my question;
Mr. Mayor.
MAYOR HOWELL: Mr. Thompson, I will turn to you for
advice and counsel. Do you rule this is, or is not,
City business?
MR. THOMPSON: It is not City business and it is
entirely out of order.

Manager which I will read. This is the City Manager
Report dated October 10, 1966.

Fire and Police Chief's Report. We have from the
Police Department the various court dockets and rundown
for September through October 10th -- do you have one on
the Fire Department?

CITY MANAGERS REPORT
1. I have a letter from the Beaches Fraternal Order of Firemen
which states that they are the sole sponsor of the Benefit
Dance and Fair contemplated for the Sheriff's Boys Ranch
to be held in the Jacksonville Beach Auditorium. This letter
stops the confusion in having the City of Atlantic Beach
responsible for any part of these doings.
- I heartily support this movement of the Fraternal Order of
Firemen and recommend to the Commissioners their approval.
. _ 2. I now have membership resignations from all of the City
employees that are under my direction from the Club By The
Sea and the Fleet_Reserve Association. All City employees
have the understanding that they can join any Club or
- - Organization as long as they pay their membership dues.
. 3. The Heads of the Departments of the City of Atlantic Beach
thoroughly understand that everyday news pertaining to their
Departments is to be released to be News Media at their
request, but any news that would involve the City of Atlantic
Beach must be cleared through the City Manager so that I can
• ask the Commissioners for their recommendations.
4. The quarterly reading on all water meters has been completed.
5. The 1966 lot cleaning has been completed. '
• 6. 6000gallons of sludge have been delivered- from the City of
-Jacksonville .to our Digester at the Sewage Plant to improve -
the operations of the Digester. .
7. A number of ditches have been cleaned out throughout the City,
and especially in the Donner section.

. 8. We have done considerable work oh the streets in the Donner
section by grading and installing limerock and shells at the
worst spots.

9. The entrance to Sherry Drive from Sturdevant Street has been
• blacktopped to stop the erosion of the street.
10. We have installed a new dam in the creek which is the outlet
to the Lagoon in the Selva Marina Golf Club. These dams can be
raised in a very few minutes allowing a large volume of water to
be released from the Lagoon so as to have more of a reservoir
• - if we have heavy rains.
11. At your request I have written to all property owners that
have shrubbery at the street corners, stating our Ordinance.
To date I have had some very nice response regarding this
.(^N in
I hope that for safety purposes all of the corners
in question can be taken care of in the next few weeks.
_ • 12: Our Public-works Department is now working on the main line
- water .valve,located in the City to see that it is functioning
properly.
