MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, JUNE 13, 1966, AT
8:00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
Minutes of the meeting of May 23, 1966 were approved as written
upon motion of Mr. Holloway, seconded by Mr. Weldon and carried.
Mayor Howell recognized visitors and called for any business from
the floor not on the Agenda.
Mr. Fred Daniels, operator of Pepo Station on the West side of
Mayport Road, requested that the Zoning Ordinance be reviewed
and changed if possible to allow him to make other than emergency
repairs at his station and to permit him to store the cars worked
on until picked up by owners which in some cases is weeks since
owners are Navy personnel. The matter was discussed at length
during which Chief Vogel advised he had been directed by the
Commission to check into violations by Service Stations and he
had found that about every station is violating in some respect
but some more than others. Mr. Weldon moved that Mr. Daniels
be requested to file a written request for change in Ordinance
and that it be referred to the Planning Board for recommendations.
After further discussion the motion was seconded by Mr. Parks
and carried. It was suggested that Mr. Daniels get with the City
Manager and Chief Vogel and do a little research and determine
just what is needed before formally filing request.
Mr. Howell called for any further business from the floor not on
the Agenda.
Mr. George Olsen requested the Commission to give consideration
to relieving "Judge" Craig of his duties within 2 weeks, no
longer than 30 days. He feels that whether they have a replace-
ment or not, that no one in Community would criticize the action.

A letter was read from the Florida State Road Department advising
that a traffic study has been completed at Mayport Road and The
Plaza, and that after an analysis of the available data, the
minimum warrants for signalization are riot met at this time, but
they will make another study at a later date.
Mrs. Grage brought up, as has been done previously by Mr. Weldon,
the matter of the need for lights at the new Intercoastal Canal
bridge on Atlantic Boulevard, and requested that we try and get
some kind of lighting installed. Mr. Weldon stated he agreed
again as he and Mr. Holloway have pointed out before we are going
to have some bad accidents there. Following discussion Mr. Weldon
moved that the City Manager once again bring to the attention of
the State Road Department and urge correction, seconded by Mr.
Parks and carried.
A request was presented from Jas. F. Taylor, D/B/A Sandalwood
Cab Company, for a Certificate of Convenience and Necessity to
operate one only taxicab within the City limits of Atlantic Beach,
Florida. He carries insurance as requested by the State and has
State and County licenses and permits. His rate will be 50C
anywhere within City limits. There was discussion following which
Mr. Weldon moved that Public Hearing be held on this request on
June 27, 1966 at 8:00 P. M. , seconded by Mr. Parks and carried.
Mrs. Grage was asked to contact Mr. Taylor for amount of insurance
carried.
An application was presented from Herschel Shepard, Jr. for water
service to his new home being built on Lots 12 and 13, Block 8,
Ocean Grove Plat located on North side of Coral Street in North
Atlantic Beach, and he agreed to pay expenses in line with our
Ordinance. This will connect onto the 2 " line on Beach Avenue,
North Atlantic Beach. There was discussion during which it was
noted this will be about 12 connections on this line, but this
is within limit of reasonable service and Mr. Craig recommended
approval. After further discussion Mr. Holloway moved that the
line be extended to Mr. Shepards location on condition that the
City assume no responsibility for any dissatisfaction for any
pressure or service, seconded by Mr. Parks and carried.
The Committee reported on the bids for the tractor loader as
covered by Specifications #66-7 . Copy of the report is attached
to these minutes and made a part thereof. There was a lengthy
discussion of the various bids and types of tractor loaders. Mr.
Weldon moved the recommendation of the Committee be accepted,
seconded by Mr. Parks. There was further discussion in which
representatives of Superior Tractor Company and Quinn R. Barton
participated and it was determined that the Model 430 tractor
and Model 23 loader with one dump cylinder as quoted on by Square
Deal Machinery, Inc. at $3, 650.00 is most advantageous to the

City. The question was called and the motion carried.
Mr. Holloway reported that he has talked with Mrs. Russell and
that any time we would like for the dedication she will be
available. It was suggested that it be about 4: 30 P. M. Friday
afternoon, July 1, 1966, as the Little League will be at the
Park prior to going in to a Jacksonville Sun 's game. Definite
report will be made at next meeting.
Mr. Craig presented proposed drawing for the Axtell Payne Memorial
plaque - size to be 5" x 11". The suggested location is the
middle pillar between the two fire engines. In the discussion it
was decided to put the month of dedication in upper left hand
corner and the year 1966 in upper right hand corner . Mr. Craig
was advised to move ahead.
Approval was requested for purchase of meter parts for 25 meters
from Rockwell Manufacturing Company in amount of $227 . 26 and
charge to account #1501. The previous approval for meter repairs
from this account specified Davis Meter Company, but on these
Rockwell meters we can secure the parts and get back in service
at the same cost as was approved for the Davis Meter Company
repairs. There was discussion following which Mr. Parks moved
approval of purchase of parts from Account #1501 as requested,
seconded by Mr. Holloway and carried.
Resolution #66-8 authorizing purchase of necessary parts to re-
condition the Heil garbage truck in amount of approximately
$600.00 and the transfer of $600.00 from Account #1007 to Account
#404 was read. These parts can be loaded in the new truck which
should be ready for delivery in about a week or 10 days, and would
save us freight on same. It was brought out in discussion that
the Heil truck was a demonstrator before we bought it and is a
1963 Model. The repairs cannot be made in our Shop as truck is
too heavy. Following discussion Mr. Parks moved adoption of
Resolution #66-8, seconded by Mr. Holloway and carried. Copy of
Resolution #66-8 is attached to these minutes and made a part
thereof.
Resolution #66-9 covering Lot Cleaning for 1966 was presented
and read in full. Following discussion Mr. Parks moved adoption
of the resolution, seconded by Mr. Weldon and carried. Copy of
Resolution #66-9 is attached to these minutes and made a part
thereof.
Chief Vogel presented copies of Municipal Court dockets for May 30th,
June 6th and June 13th, 1966. He advised that the new police car
is operating fine and that we are checking at the Park regularly
and the situation there is improved.

Mr. Craig presented request for permit for two signs for the dry
cleaning establishment at 31-D Royal Palms Drive, and recommended
it be referred to a Committee to get additional information and
if found harmonious with current sign ordinance that Committee
authorize him to proceed with permit. Mr. Weldon asked if could
wait until next meeting, and Mr. Craig advised that is another
way of handling. Whereupon, Mr. Weldon moved that the City
Manager investigate and make recommendations at next meeting,
seconded by Mr. Holloway and carried.
Mr. Craig read his report dated June 13, 1966, copy of which is
attached hereto and made a part hereof. His report covered
various phases of City work and restated his request for replace-
ment as City Manager and stated that in the foreseeable future,
unless some ample action towards his replacement is taken, he
will specify a terminal date for his employment by the City.
Recreational Director John Albright was present and advised
everything is going real well at Playground.
Mr. Parks stated he is fully sympathetic with the fact that Mr.
Craig has been very patient with the Commission, is sorry that
they have imposed on him, but grateful for the help he has
rendered.
Mr. Parks stated he had a few questions to ask basically for
information:
(1) Has noticed cave-in near Post Office on Royal
Palms Drive in area of manhole we had repaired. Is
this storm sewer failure or sanitary sewer? Mr.
Craig advised sanitary sewer. He has talked to con-
tractor and he will furnish well-pointing and men if
we can furnish backhoe. They will cooperate every way
they can. The estimated cost will be $400. 00 to
$500.00. The break is about 18 inches from manhole.
(2) What has been accomplished in connection with
visit from officials of Neptune Beach in regard to
traffic hazard on Atlantic Boulevard where left turns
are made into Pic N ' Save parking area? Mr. Craig
advised the State Road Department Engineers do not
want us to erect any signs on road or road right-of-way
as that is their business - but they have no objection
to our regulating from the parking Plaza side. They
did not offer any alternative but stated it is hard
to convince people not to cross a double yellow line.
Mr. Craig has not advised Neptune Beach as thought
would get something done.

(3) Are the problems with the digester about over?
Mr. Craig advised the performance is near normal.
Have drawn sludge twice lately.
(4) In talking with officials of State Road Department
has there been any comment as to when anticipating the
starting of Atlantic Boulevard improvements on road
east of Canal? Mr. Craig advised no, but that Mr.
Murphy did say they would be over to go over plans
with us before construction plans are started.
Mr. Weldon reported briefly on the Local Government Study
Commission. At the meeting that afternoon they had a very
interesting discussion by the City Attorney of Baton Rouge
Parrish on the subject of the combined City and County functions.
An announcement of interest to the entire Beaches was made by
Chairman J. J. Daniels that there will be a public meeting in the
Beaches area during month of July at which time citizens of the
Beaches would be given opportunity to comment and express their
views to the Commission. Thinks it is important that Atlantic
Beach and other Beaches citizens have representation there.
Mr. Weldon inquired as to rusty, dirty condition of City garbage
truck and Mr. Craig advised it is being turned in on new truck.
Mr. Weldon commented that we keep City equipment in good shape
and glad to hear getting rid of this one. Mr. Craig stated had
planned additional sheds for equipment for this year, but felt
necessity for holding down budget to keep millage down therefore
did not include. He stated we badly need two additional
laborers. Mr. Weldon thinks we should look into necessity of
getting more help if equipment is being allowed to deteriorate
because of lack of help.
Mr. Weldon called attention to potholes throughout City. Work
is being done, but rainy weather has hampered and increased
number of potholes.
Mr. Howell read a letter from Mr. Norman Minchew, Tax Assessor,
advising he would have the Tax Roll ready by July 1st. He
advised that for many years the tax roll has been prepared at
direction of City Commission on basis of 80% of actual value.
He recommended this be changed before the City becomes involved
in a lawsuit. The City Charter calls for assessment of all

properties at 100% of cash value and next year the entire roll
should be revaluated and assessments made in accordance with
City Charter. Copy of Mr. Minchew's letter is attached to
these minutes.
There being no further business, Mayor Howell declared the
meeting adjourned.

The Committee appointed by the Mayor on May 23, 1966, to evaluate,
study and report on bids received for the furnishing of Industrial
Tractor Loader, in accordance with specification No. 66-7, tabulated
the bids, as follows:
Quinn R. Barton Company, for furnishing INTERNATIONAL
3414 LOADER TRACTOR, $3, 889.48 - Delivery by July 10,
1966.
Superior Tractor Company, for furnishing MASSEY FERGUSON
MF2135 TRACTOR and MF100 LOADER, $3, 500. 00 - Delivery
June 15, 1966.
Square Deal Machinery, Inc. , for furnishing CASE Model
430 TRACTOR and Model 23 LOADER, $3,650. 00 - Delivery
30 days after award.
Square Deal Machinery, Inc. , for furnishing CASE Model
530 TRACTOR-LOADER, $4, 188.00 - Delivery 30 days after
award.
EVALUATION:
(1) The bid of Quinn R. Barton Co. , as supplemented by letter dated
June 6, 1966 meets specifications with exception of "Some of Engine
and Power Train Parts are of British Origin " - price • of $3,889.48
is higher than two other bid prices.
(2) The bid of Square Deal Machinery for furnishing Model 530 TRACTOR-
LOADER at $4, 188.00, relates to a heavier and more costly item than
is required for our contemplated use.
(3) The apparent low bid of Superior Tractor Company for furnishing
MF2135 TRACTOR and MF100 LOADER as indicated in their letter of
June 4, 1966, at price of $3, 500.00, is considered defective as
follows: (a) MF100 Brochure indicates either a lift capacity (with
single acting cylinder) of 1800 lbs. , or optional lift capacity
(with double acting cylinder) 2700 lbs. ; the "optional " meets

Specification Item 6 (b) & (c) - 2000 lbs. lift capacity as to
weight, but the two lift cylinders are not shown. (b) "A double
acting dump cylinder " (only one) is shown on brochure; Specifica-
tion Item 6 (d) requires two (2) . (c) Letter of June 4th shows
MF axle specifications as "heavy duty heat treated, maximum static
loading 12, 500 lbs. , heavy duty spindles and hubs ". This is not
acceptable as proof that requirement of Specification Item 7 -
Front axle capacity not less than 7 , 000 lbs. - is met. The
Committee wishes to explain that lack of mechanical engineering
experience, and impossibility of making comparison tests, renders
it impossible to relate the impact of a 7 , 000 pound load in
motion, upon a steel beam, to a 12, 500 pound static load upon
the same or similar beam. (d) Specification Item 6 (e) "Control " -
free float position, appears to be met in Brochure for MF200 but
cannot be found in brochure relating to MF100. (e) MF2135 Tractor
"Manual Shuttle Control " as outlined in Brochure appears harmonious
with Specification Item 2; but on Demonstrator equipment of this
model, as recently made available at City Yard, the use thereof
was so complicated as to be quite confusing to our operators.
FINDINGS:
The Committee finds: "The bid of Quinn R. Barton Co. , at $3,889.48,
and that of Square Deal Machinery, Inc. at $4, 188. 00 for Case 530
Tractor-Loader should be rejected because of prices higher than
two other bids.
2. The bid of Square Deal Machinery, Inc. at $3, 650.00 for Case 430
Tractor & 23 Loader should be considered in comparison with bid of
Superior Tractor Co. at $3, 500. 00 for Massey Ferguson MF2135 Tractor
and MF100 loader. The "Case 430-23 " has one item not entirely
harmonious with specifications - only one dump cylinder. This lack
is duplicated on the "MF100 ". By reference to "evaluations' above,
it will be seen that the "MF100 " and "MF2135 " combination have three
additional and serious deviations from the Specifications.

CITY MANAGER'S REPORT
1. During recent weeks considerable time of our labor force
has been expended in improvement of drainage; and, in this
connection equipment of the East Duval County Mosquito Control
District has materially improved drainage in that part of
Section H which lies to westward of Main Street.
2 . Landfill garbage disposal area now in operation is on
the John Lowe property just north of western extremity of
Levy Road. This area has a disposal time estimated at two
years or more.
3. Beach stairway approaches at street ends have been repaired,
reinstalled as necessary, and are being painted. Walkways
from barricades to top of seawalls are scheduled for improvement
as soon as possible.
4. Recreation Director Albright and Assistant Director Mrs .
Stucki have the playground situation well in hand at Russell
Memorial Park; and Mrs . Davis , as supervisor at Donner Play-
ground, reports a great many youngsters playing there- making
full use of facilities .
5. The set-up of Life Guard (Beach Patrol) activity has been
taking shape since last Friday. Captain Frank Lee being in-
volved in certain school duties will not be full time on duty
until Thursday.
6. In view of a definite statement from County Commissioner
Bob Harris , that the County is unable to cooperate with the City
in proposed improvement of Main Street this year, we have
started distribution of limited quantities of limerock on that
street where sand pits become impossible during dry weather.
7. The digester at Sewage Disposal Plant is nearing return
to normal performance. We hope report on sample to be tested
tomorrow will show acid condition eliminated or nearly so.
Unfortunately, due to pre-occupation with water-meter problems ,
etc . our limited water-sewage crew has not been able to correct
all water infiltration faults in sewer lines . In fact we are
aware of several which will require time and effort, plus some
expense, to correct.

8. The City Manager wishes to go on record as feeling that
he has carried out his commitment "To stay on the job until
a suitable relief might be found." Such relief I have re-
peatedly suggested should be a man of good personality whose
future is ahead of him-not behind- ; who has ample experience
in the various areas of City problems , such as water, sewerage,
streets , etc . During the twenty months I have served in this
fill-in capacity, several applicants for the position have
been interviewed. Most recently, on May 9th, a young man was
interviewed who had every qualification necessary for this
position and I had a feeling of certainty that my long ordeal
was about to terminate. Later I learned that no decision was
reached by the City Commission to employ this fully qualified
individual. I wish to emphasize that the lack of decision
in this case was disappointing and frustrating to me. Accordingly
it is necessary for me to point out that in the forseeable
future, unless some ample action toward my replacement LS taken,
I shall specify a terminal date for my employment by the City.

Atlantic Beach, Florida.
Gentlemen:
I just wanted to report to you that the 1966 Tax Assessment roll
is substantially complete and will be delivered, completed, to
the City Treasurer before July 1, 1966.
There will be relatively few changes in this roll over the one
for 1965. The changes come almost entirely from new buildings
and improvements made to existing properties during last year.
In preparing the current tax roll I have re-examined and re-
inspected between 500 and 1,000 properties in the city to de-
termine whether a revision of assessments, up or down, would
be required, but concluded that no major revisions were required
at this time.
For the past many years the tax roll has been prepared, at the
direction of the City Commission, on a basis of 80% of actual
value. This should be changed now before the City becomes in-
volved in a lawsuit. The City Charter calls for assessment of
all properties at 100% of cash value and next year the entire
roll should be re-evaluated and the assessment made in accord-
ance with the City Charter.
