4 MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, JANUARY 24, 1966, at 8 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by the Reverend Carroll Kendrick, Pastor
of Neptune Baptist Church.
Minutes of the meeting of January 10, 1966 were approved as
written upon motion of Mr. Holloway, seconded by Mr. Weldon and
carried.
Mr. Howell recognized visitors present and called for any business
from the floor not on the Agenda.
Mr. C. A. Stonemetz, Attorney for the local Chapter of the Fleet
Reserve Association, requested on behalf of their members approval
to have their club at 390 Mayport Road, which is located in
Business A. This is strictly a private club on the order of the
American Legion. Mr. Howell advised he believes the point is
that the Zoning Ordinance does not specifically permit this kind
of Club in Business A. There was a discussion during which the
question was referred to City Attorney Thompson who studied the
ordinance and advised that it was his opinion that it was within
the meaning of the Ordinance to permit the Club at this location
and no action by Commission is necessary. They will have to get
permit to make necessary changes to operate.
Mr. Harcourt Bull advised he had noticed from the papers that the
Commission had passed an Ordinance rezoning certain lots in
Blocks 8, 9, 10, 11 and 12. He advised he would like to record
opposition to this action - on the basis of the manner in which
it was done. He knows the requirements of legal ad were met, but
it has always been the practice of the City when rezoning any lot
to notify each lot owner, and this was not the case. These lots
have been Residence B for at least thirty years and many properties
sold and represented for duplex. Thinks City should go back to
old procedure in next rezoning of notifying everybody. Mr.
Howell advised we appreciate comments and they will be noted in
minutes.

Bids were received on Garbage Body and Garbage Truck Chassis.
Copies of Certified Proof of Publication covering "Call for Bids"
are attached to these minutes and made a part thereof. The bids
were as follows on the Garbage Body covered by Specifications

Mr. Holloway moved that the bids be referred to a Committee for
study and report back at next meeting, seconded by Mr. Weldon and
carried. Mr. Howell advised the Commission as a whole together
with the City Manager will be the Committee. Meeting of the
Committee was set for Tuesday night, January 25th, at 7: 30 P. M.
Bids were next received for Repairs to Manhole #40, covered by
Specifications #66-3, as follows:

Mr. Howell suggested that due to urgency the job be awarded to
the low bidder subject to the approval of the City Manager and
Commissioner Parks, and the Mayor and City Clerk sign for the
City. Mr. Weldon moved that this be done, seconded by Mr.
Holloway and carried. The bids were turned over to Mr. Craig
and Mr. Parks.
Mr. Howell read the minutes of the meeting of the Advisory
Planning Board. Relative to the request of Mrs. Bertha Hairston
to rezone her Lots 5 and 6, Block 1, Atlantic Beach Parkway, the
Board recommended that in view of the numerous changes, up and
down, regarding zoning that we adopt a view of status quo until
the effect of the new Apartment Complex can be observed in regard
to Community attitudes, traffic, and property values. Mr.
Holloway moved that the recommendation of the Planning Board be

accepted and that Mrs. Hairston 's request for rezoning be denied,
seconded by Mr. Weldon and carried.
Reports from the Jacksonville Humane Society for the months of
November and December 1965 were received to be filed for informa-
tion.
Mr. Thompson reported on the Search and Seizure Ordinance proposed
for study by Chief Vogel. He stated he sympathized with the
police wanting a broadening of powers, but if Ordinance does any
more than Florida statutes provides or attempts to give any
authority above the statutes then it is unconstitutional and won t
work - must have intent to arrest or have search warrant before
can search. If Ordinance goes beyond the statutes it is invalid,
and if it does not, we don 't need it, and we 'd better stay with
the Statutes. Mr. Weldon stated in view of the City Attorney's
opinion that this proposed ordinance is seriously questionable as
to constitutionality, that he moved no action be taken, seconded
by Mr. Parks and carried.
As regards the Committee report on sewer, water and garbage
charges at the Atlantic Beach Hotel-Apartment Complex which was
referred to Mr. Thompson to see if a new ordinance was needed,
Mr. Thompson advised that it seems that what the Committee
recommended in their report is within the framework of our
ordinances. He finds no conflict with existing ordinances, and
does not think me need any further ordinance.
Mr. Craigpresented a report on the meeting he and Mr. Goodling had
with Mr. Cyrus Washburn of the City of Jacksonville Electric
Department regarding transmission lines and the metered service
at the Hotel-Apartment Complex. The matter was discussed at
length following which Mr. Parks moved that the City Manager 's
report be put in writing and be attached to these minutes and
made a part thereof for possible future review and consideration,
seconded by Mr. Weldon and carried. Copy of report is attached
to these minutes and made a part thereof.
The Committee appointed to review the insurance policies reported
that policies covering workmen's compensation, false arrest,
public officials bond, public employees blanket bond coverage
on money and securities are all in order. On the mobile equipment
floater there needs to be some changes as some equipment has been
replaced - needs updating with proper names and serial numbers.
Under comprehensive liability one vehicle needs to be deleted and
two others need to be corrected. These changes would reduce
the premium about $200.00. On the schedule for institutional
coverage which provides for fire and vandalism on the improved
properties of the City the Committee thinks it needs to be

updated slightly in some areas, primarily the addition made to
the police and fire station - and this will produce some slight
additional and some reductions. Mr. Howell suggested we pay
premiums of public official bond, workman 's compensation, money
and securities and false arrest but hold other policies until we
get absolutely updated. There was a lengthy discussion as to
agent, expiration and method of placing insurance. The insurance
committee as set up by Resolution in 1958 has handled our insurance
coverage yearly. Mr. Weldon advised he had not hard of this
committee. He also stated he had made investigation of Neptune
Beach - has not checked various items but their coverage as he
understands is approximately 1/2 of the cost of the City of
Atlantic Beach; that it may' be they don't have as complete
coverage as we have, but certainly bears investigation as to why
the tremendous difference. There was further discussion as to
types of insurance following which Mr. Weldon moved that a
committee be appointed to give some further study to these poli-
cies with the view of submitting to bid exactly as we do in other
cases involving large expenditures by the City, seconded by Mr.
Holloway. After discussion as to the Committee, Mr. Howell put
the question and the motion carried. The Committee consists
of Rob Rosborough, Henry Holcomb and Mayor Howell who will study
and investigate the policies and report back at next meeting.
Mr. Craig presented the specifications and "Call for Bids " on
new police car and requested approval. It was decided to study
specifications either after tonight's meeting or at committee
meeting of the Commission Tuesday night, the 25th, in order to
get out the call for bids.
Mr . Craig reported that the Jack Russell Memorial tablet is in
place and the area surrounding has been graded and seeded with
grass.He advised that Mrs. Thelma Keith is going to talk with
Mrs. Russell to get some important events in Jack Russell 's back-
ground and determine if there is an important date which would be
appropriate time for the dedication. Mr. Parks moved to continue
to next time pending getting desired information, seconded by Mr.
Holloway and carried.
Chief Vogel presented Fire Department report for 1965 with 1964
comparisons and the police dockets for January 10, 17, 24, 1966
which were received for information and filing. There was a
discussion of devices for capturing dogs, and the Chief advised that
the Humane Society is down 3 days a week now.

Mr . Craig reported that the Fire Department alert system which
was recently put in has proven remarkably satisfactory and
justified the expense. He also reported they have been working
to correct some shoulder situations and also some drainage im-
provements.
Mr. Parks commented on pot holes caused by rains - but is satis-
fied Public Works Department will catch up as soon as weather
improves.
Mr. Holloway moved that Resolution #66-1 be passed thanking the
Expressway Authority for the new bridge over the Intracoastal
Canal, requesting that proper lighting be provided at approaches,
and that the new road improvement to Atlantic Blvd. and Mayport
Road will be accomplished in near future and not cut out of
program. Mr. Weldon seconded with suggestion that we include fact
that numerous accidents demonstrates clear need for improved
facilities. Mr. Howell put the question and the motion carried.
Copy of Resolution #66-1 is attached to these minutes and made a
part thereof. There was further discussion of the Atlantic Blvd.
and Mayport Road expressway project.
Mr. Harcourt Bull advised that he thinks a representative of the
Greater Jacksonville Open will be down to talk with the Commission
to make plans for closing some streets, traffic, parking, etc.
Mr. Weldon stated that we have discussed and thinks everybody
is in accord that we want to cooperate.
Mr. Howell presented renewal agreement on radio operation between
City of Atlantic Beach and City of Neptune Beach. Mr. Holloway
moved that the Mayor and City Clerk be authorized to sign the
agreement for Atlantic Beach, seconded by Mr . Parks and carried.
There being no further business Mayor Howell declared the meeting
adjourned.

REPORT ON ELECTRIC SERVICE WITHIN ATLANTIC BEACH
On January 14th, the City Manager and Commissioner Goodling
met with Mr. Cyrus Washburn in his office in City of Jacksonville
Department of Electric and Water Utilities for discussion of
several subjects, as follows:
1. The question of underground Electric Transmission Lines
within Atlantic Beach, as presented by Mr. Waldo Stockton's
letter dated January 6, 1966. Briefly, Mr. Washburn indicated
that they are not prepared at this time to undertake this type
of modernization in Atlantic Beach. He and his Engineering
Staff were pleased to inform us in detail regarding this type of
project, including discussion of difficulties encountered such
as breakdown of insulation in cables now available for trans-
mission at 4 KV and 25 KV levels. Further, they noted that they
do provide service to suitably constructed underground distri-
bution systems such as that being installed in the Atlantic
Beach Apartments and Hotel Complex. The "Service" in such cases
being above ground.
2. We then entered into discussion regarding possible
advantage or disadvantage to the City of Atlantic Beach through
possible installation of a single electric meter at the 100
unit Atlantic Beach Apartments in lieu of an individual meter
for each unit. Mr. Washburn discussed the background of negotia-
tions between the owners, Culverhouse and Winston, (through their
attorney, Mr. Crabtree) . Then stated that finally, despite the
well established policy of "a meter for each apartment-unit" it
was agreed that one meter could be used. This would olcourse
entail some reduction in charge per kilowatt hourfabove certain
demand levels . However, Mr. Washburn conceded that a measure
of economy would accrue to the Electric Department through
reduction in number of installations" in maintenance,, in meter-
reading and in cut-on and cut-off expenses. As to difference
in our Utilities Tax volume with one meter and scaled down
kilowatt-hour charge, as compared with 100 meters on nominal
residential rate, we were shown rate study sheets which they had
developed in their evaluation of the project. These studies indi-
cated somewhat less income to the Electric Department if all
current is supplied through one meter; however, their calculated
annual income in either case would approximate $30, 000 .00 with
all apartments continuously occupied.
It was noted that a realistic view would suggest 80% occupancy
with corresponding reduction of income. Thus the Atlantic Beach
10% Utility Tax might range between $3, 000 .00 and $2,400 .00, and
by reference to their income comparisons - one meter, or 100 meters,—
our tax accrual might be decreased "$150.00 to $250.00 per annum" .
We, Goodling and Craig, deem this to be reasonable and acceptable
in view of the Atlantic Beach Garbage, Sewerage and Water ordinances
providing special reduced unit rates for apartment buildings.
3 . We questioned Mr. Washburn regarding reports that his office
was contemplating a modernization of certain transmission and
distribution lines in Atlantic Beach. He stated they plan, for
summer of 1966, the installation of a 25 KV (25, 000 volt) transmis-
sion line, from the substation on Ahern Street, northward on Ocean
Boulevard to 15th Street, then west to Selva Marina Drive. This
will provide better distribution to the entire area north of
eleventh street and will correct the fault of radical current
fluctions in all Selva Marina Subdivisions. This new line will
also radically reduce the load on existing 4 KV (4160 Volt)
transmission lines which serve the area between Ocean front and
Sherry Drive from Atlantic Boulevard to Eleventh Street, thus
improving service in that area . Further, they plan that as soon as
possible, and not beyond two or three years in completion, all
transmission lines will be 25 KV in lieu of the present 4 KV
and the substation on Ahern Street will be abandoned. Further, in
connection with immediate modernization of transmission and
distribution north of Eleventh Street there will be replacement of
the old type of incandescent lights in that area, and along Ocean
Boulevard, with modern photocell controlled street lights.

RESOLUTION NO. 66--1
WHEREAS, recent completion of the Atlantic Boulevard
(State Road 10) bridge over the Intracoastal Waterway
constitutes a great improvement in vehicular access to
Atlantic Beach and adjacent communities, and
WHEREAS, further improvement of Atlantic Boulevard, by
four-laning and easement of curves, has become an urgent
necessity due to obsolescence of that route and increase
of traffic thereon; which improvement has been provided
for in plans of the Jacksonville Expressway Authority
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH, FLORIDA, that,
This City Commission does, on behalf of the people of
the Aity of Atlantic Beach, hereby express to the Jack-
sonville Expressway Authority our heartfelt thanks and
most earnest appreciation for the consummation of a much
needed and long awaited improvement in the highway
approach to this City, and further,
The City Commission expresses, on behalf of the people,
its great interest in the early furtherance of plans
already prepared by the Expressway Authority to modernize
additional sections of Atlantic Boulevard, and of Mayport
Road (State Road ALA) , and finally,
To express the hope of all the people in the Beach
Communities that the improvements herein mentioned and
early installation of suitable and adequate lighting on
the new bridge may continue to occupy a preeminent position
in the allocation of funds by the Jacksonville Expressway
Authority, and

BE IT FURTHER RESOLVED, that this Resolution be
sent to the Jacksonville Expressway Authority and
copies forwarded to the Florida State Road Depart-
ment and to County Commissioner Bob Harris.
