MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY MAY 13, 1963, AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Isaacs, who welcomed all visitors present.
Minutes of the meeting of April 26, 1963, wore approved as
written upon motion of Mr. Moore, seconded by Mr. Johansen
and carried.
The Mayor then called for any business from the floor not on
the agenda.
Mrs. James A. Holbert, Sailfish Drive, Royal Palms, presented
a petition from neighbors and a letter from her doctor, sub-
stantiating her complaint, relative to the noise caused by
the construction crews working on the trucks on the property
adjoining her back yard. These are the trucks being used to
haul the dirt on the seawall repair program at Neptune and
Jacksonville Beaches and they do their repairing at night,
which has had a very bad effect upon her health. It was ad-
vised that the matter had been discussed with Mr. Imler, but
the disturbance has not been corrected. The matter was dis-
cussed at length during which Mr. Printon advised that she
had a justifiable complaint on the noise and situation that
exists there, but the trucks are within their zoning rights
and are not breaking a law by being there. It was the con-
sensus of opinion that the Commission sympathizes and will
see if some solution can be worked out. Mayor Isaacs advised
that we would try to do something about the situation.
Reverend James Stewart, pastor of the Pentecostal Church,
advised that his church has appreciated using the City Hall
• for their services, but are now ready to build their own
buf:I3ing. They are planning to purchase property at the
corner of Levy Road and Main Street and wanted to make sure
there were no restrictions against church porperty in this
location. He was advised that we did not know of any reason
why he could not go ahead with the purchase of the land and
bring his plans in to the City Manager to check and issue a
permit.

Bids were next opened on the centrifugal water pump. A copy
of Certified Proof of Publication for Call for Bids is
attached to these minutes and made a part thereof. Bids were
received from:
Holley-Edwards Sales, Inc. $1, 300.00
Moore Utility Supply Company 880.00
Wallace Equipment Company 950.00
Mr. Johansen moved that the bids be turned over to the Finance
Committee with authority to act after conferring with the
City Manager. The motion was seconded by Mr. Claiborne and
carried.
There were no bids taken on the control panel, as we are en-
deavoring to fix the existing one to meet our requirements.
A request was presented from the Beaches Chamber of Commerce
for the City to sponsor a class in their Third Annual Horse
Show. This is a non-profit affair and the money will go to-
ward the expense of the three day show. It was the consensus
of opinion that we sponsor the class to the amount of $25.00
and that the money be taken from the Commissioners fund.
The Finance Committee reported on the engineer 's bill for
services rendered and advised that it wns their recommenda-
tion that we pay the bills. Mr. Lawrence moved that these
bills be paid, seconded by Mr . Claiborne and carried.
A letter was read from the American Legion expressing appreci-
ation for our assistance in the Welcome Day Parade and
particularly commending Tom Gately and Harry Rentz for their
help.
A letter was received from Mrs. C. E. McLane regarding her
complaint on boarding of horses in her area. Mr. Printon
advised that he had written Mrs. McLane and suggested that
she file a complaint, which apparently has not been done.
It was agreed that it would be necessary for her to file a
complaint if she is not satisfied and take action through
the courts. As far as we can ascertain, the land is being
used the same as it has been for years - as a farm.
A letter was presented from Mrs. Arlenus Dillender relative
to a water bill which her tenant left unpaid and wanting to
know if she was responsible for same. Mr. Lawrence suggested
that Mr . Printon write her to the effect that the owner is

held responsible to the City for utility bills. It was
agreed that this be done.
A request was presented from Texaco, Inc. , for permission
to erect a sign at the location of their proposed new station.
Mr. Printon advised that it was a standard business sign and
meets the code. Mr. Moore then moved that the permit be
granted, seconded by Mr. Lawrence and carried.
A request was next presented for a permit to erect a Beach
Auto Sales sign at 160 Mayport Road. Mr. Printon advised
that at present there are about 7 signs at this particular
location and that the property, in his opinion, is "over-
signed". Mr. Moore moved that the permit be denied on the
recommendation of the City Manager. The matter was discussed,
during which Mr. Johansen suggested that it be turned over
to the Planning Board for study and recommendation. Since
other signs have been allowed there, he does not see how
this permit can be turned down. Mr. Moore 's motion died
for lack of a second and the request was turned over to
the Planning Board for recommendation.
A request was received for a permit to put a sign on top of
the Lovett Building on Atlantic Boulevard. The sign was to
be of wood and put on existing base. Mr. Printon advised
that the wooden sign would not meet the code, therefore,
Mr. Lawrence moved that this particular request be denied,
seconded by Mr. Moore and carried. It was then moved by
Mr. Johansen that a permit for a sign be granted subject to
compliance with the building code, seconded by Mr. Moore and
carried.
A request was received to erect a Sea Horse Motel sign on
Atlantic Boulevard adjacent to the Kahoe Garage property.
Mr. Printon advised that the sign meets the code, recommend-
ing that the permit be granted; whereupon Mr. Claiborne
moved that the permit be granted, seconded by Mr. Johansen
and carried.
Mrs. Charles Moore requested that the Planning Board be
asked to make a study of signs in Atlantic Beach, as we are
getting more and more signs on our highways and it is becom-
ing a problem.
A request was presented from Buddy Jones of Jones Roofing
Company for a building permit to take down the old building
and erect a new building on his property on Atlantic Boulevard.

He does not have completed plans and following discussion,
it was the consensus of opinion that Mr. Jones get together
with Mr . Printon on any questions as to the new building,
then-present his final plans for approval by the Commission.
An Ordinance was presented in writing for first reading by
title only. Said Ordinance is to amend Zoning Ordinance re-
zoning the property lying just west of the DuVerre of Florida
property on the north side of Levy Road from Residence D
to Industrial. Mr. Johansen moved that said Ordinance be
adopted by title only on first reading, seconded by Mr.
Claiborne and having been duly considered, was unanimously
carried. Mr. Isaacs set June 10, 1963, as date for Public
Hearing on this- Ordinance.
Mr. Isaacs next_read Resolution 63-10 setting up sewer ser-
vice charges for the Beaches Aquatic Club at $8.25 per month.
This charge is in line with one for the Selva Marina Country
Club pool. Following discussion, Mr. Johansen moved the
adoption of Resolution -63-10, seconded by Mr. Lawrence and
carried. Copy of Resolution 63-10 is attached to these
minutes and made a part thereof.
Mr. Isaacs appointed Mr. Preben Johansen as U. N. Chairman,
following which_ Mr. Johansen presented a Proclamation setting
up Thursday, October 24, 1963, as U.N. Day and moved its
adoption, seconded by Mr. Claiborne and carried.
Mr. Lawrence, chairman of committee appointed to study the

Beach erosion and seawall problem, presented a report and
proposal from Smith and -Gillespie, Engineers, relative to
engineering services on the seawall damage. Slmith and
Gillespie's fee for preparing a preliminary engineering
report would be $750.00. This preliminary report would be-
come a part of the appropriate fee for complete engineering
services and would be credited on account of such fee at the
rate of 1% of the construction cost of the work undertaken.
There would be a fee of approximately $150.00 for prepara-
tion of a shore protection ordinance. It was also recom-
mended that they retain Dr. Per Bruun as a consultant in
connection with the work at an approximate $500.00 service
fee. The committee recommends that the proposal of Smith
and Gillespie be accepted subject to the approval of the
City Attorney. It was brought out in the discussion that
the committee consists of Messers Harcourt Bull, J. A. Reid,
Bob Price, City Manager Printon and Commissioner Lawrence
and this..recommendation comes from this committee to the

Commission. The matter was discussed at length, following
which Mr. Lawrence moved that the proposal with supplement
as presented be accepted subject to the City Attorney's
approval, seconded by Mr. Claiborne and the call vote was:

Whereupon Mayor Isaacs declared the motion carried.
Mr. Lawrence next brought up the matter of delinquent taxes
which are approximately $7, 900.00 for the years 1932 through
1962. Also there is approximately 70,000.00 in delinquent
sewer assessments. He would like for the City Manager and
City Attorney to investigate some economical way to get
payment on these taxes and assessments. Mr. Thompson advised
that the letter gotten out by the City Clerk-Treasurer and
himself some years before had resulted in very good collection
and he would suggest that the City Clerk try this same method
again. It was the consensus of opinion that this be done.
Mr. Printon, as Director of Public Safety, advised that he
and Chief Fultz had been concerned over our allottment of
lifeguards being cut down by Red Cross. The matter has been
taken up with them and we have been advised that we will be
adequately covered on Sundays. On weekdays we are going to have
a man at 15th Street, one on the Hotel Pier and a mobile unit
covering our entire beach. He also advised that the bicycle
safety program was completed by us with the cooperation of
the Atlantic-Neptune P.T.A. and the Neptune Beach Police
Department. Chief Fultz has requested the Commission to set
up a traffic study committee to bring in recommendations on
traffic problems in the City. The Fire Underwriters have made
a check of the Fire Department and made some very constructive
and basic recommendations regarding the department and personnel.
Mr. Lawrence advised that the summer recreation program for
the new park was being organized and there are approximately
224 participants in the Little League and Adult Softball
programs to date.
Mr. Lawrence advised that our radio system in Atlantic Beach
for several months has been monitored by individuals having
no official connection with the City. He doesn't feel that
monitoring is ethical and if this practice is not discontinued,
the City can do one of two things: turn the matter over to
the FCC or buy scramble units for each of the units which the
City has, but that this would cost approximately $200.00 per

unit. He advised that he would like to see the Mayor and
Director of Public Safety get with the Fire and Police Chief
and work out some solution. There was further discussion
of the matter, but no action taken.
Mr. Lawrence also advised that he was going to ask the City
Attorney to prepare an ordinance establishing Civil Service
for the City of Atlantic Beach.
Mr. Printon presented a request from Dr. Chas. B. Mabry, 1655
Ocean Front, North Atlantic Beach, for water cut-in. Mr.
Printon advised that the water line goes by Dr. Mabry 's
property and the connection could easily be made. He would
pay out-of-City rates. It was the consensus of opinion that
he be allowed to connect to the City lines for the usual
cut-in charge and out-of-City service rates.
There being no further business, Mayor Isaacs declared the
meeting adjourned.
