MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, FEBRUARY 11,
1963, AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Isaacs.
Minutes of the meeting of January 28, 1963 , were approved
as written upon motion of Nr . Johansen, seconded by Mr.
Claiborne and carried.
Mr. Isaacs recognized visitors present and called for any
business from the floor not on the agenda.
Mr. D. R. Walton, who, with his wife, has petitioned for
a certificate of convenience and necessity for the Sandra
Cab Company, presented to the Commission his reasons and
qualifications for operating such a service in Atlantic
Beach, stating that with their type of vehicle they could
operate more economically and give lower rates. Mr . Isaacs
called on Mr. Lawrence for a report of his investigation of
this request for certificate. Mr. Lawrence reported that
he had talked with Mrs . Walton and to the other cab com-
panies. He feels that it is a privilege permit and believes
in order to have such a permit the company should be on
full--time operation and have more than one unit. He ad-
vised that their insurance is adequate but that due to the
facts involved, he would recommend that the permit be
denied at this time. Mr. Printon advised that he tends to
agree with lir. Lawrence on this recommendation. It was
agreed that we are not against free enterprise but feel
that we should not allow another cab certificate of conveni-
ence at this time, as with only one vehicle it would not
be possible for them to keep equipment on the streets at
all times . The matter was further discussed, following
which Mr. Claiborne moved that the recommendation as made
by Mr. Lawrence be accepted and that the request for certi-
ficate of convenience and necessity be turned down, seccn(1.e0.

by Mr. Johansen and carried. Mr. Isaacs suggested that at
a later date when the Wa].tons have more cabs and could give
more competitive service that they come back to the Commis-
sion and he felt sure that it would be reconsidered.
Bids were next opened for the two trucks and flat bed from:
Lynch-Davidson Company - Bid on Items 1, 2 & 3
Tom Nehl G.M.C . Truck Co. - Bid on Items 1, 2 & 3
Rivers Trailer & Equipment Co.-Bid on Item 3 only
The necessary bid bond checks were attached to each bid. Mr.
Claiborne moved that bids be received for tabulation and
turned over to the Finance Committee for study with power to
act, seconded by Mr. Johansen and carried.
Mr. Isaacs next read in full Ordinance 90-63-15 covering
amendment to zoning ordinance as regards a portion of Business
AA district; certified proof of publication covering hearing
on this Ordinance is attached to these minutes and made a
part thereof. The Mayor then declared the meeting in session
for said Public Hearing and called for any discussion from
the floor. As no one appeared either for or against, the
Public Hearing was declared closed, whereupon Mr. Claiborne
moved that Ordinance 90-63-15 be passed on second and final
reading, seconded by Mr. Moore and Roll Call was as follows:

Whereupon the Mayor declared said Ordinance passed on second
and final reading.
Mr. Isaacs next read Ordinance 55-63-7 in full, notice of
Public Hearing on said Ordinance having been posted in line
with Charter requirements . Mr. Isaacs declared the meeting
in session for Public Hearing on this Ordinance covering
amendment to Garbage Fee Ordinance. Mrs. Cecil Montague re-
quested information as to the every other day collection of
the garbage and advised that she felt we had the best garbage
service of any place she had ever lived at the least cost
and would prefer staying on a daily collection basis with
additional charge for the service. It was advised that the
garbage would be collected every other day, including Sundays,
and that if we found this would not work, we could always
return to the present daily collection, that this every other
day service will only be for nine months in the year, with
every day collection during June, July and August at the ad-
vanced fee. After some further discussion, the Public Hearing
was declared closed, whereupon Mr. Claiborne moved that
Ordinance 55-63-7 amending the Garbage Ordinance be passed on

second and final reading, seconded by Mr. Johansen and the
Roll Call was:
Aye - Johansen, Lawrence, Moore, Claiborne, Isaacs
Nay - None
Whereupon Mr. Isaacs declared the motion carried and Ordinance
55-63-7 adopted on second and final reading. The effective
date to be immediately upon its passage.
Resolution 63-6 covering a request for condemnation for the
property at the intersection of Seminole Road and Atlantic
Boulevard was read in full. This Resolution requests the
State Road Department to take steps in having this property
condemned, as it is a traffic hazard and parts of the station
are on the State right-of-way. Mr. Lawrence advised that
the Traffic and Highway Committee some months ago had drawn
up steps to be taken to help traffic situations in Atlantic
Beach and this is one of them. There was further discussion
on this situation, following which Mr. Lawrence moved that
Resolution 63-6 be adopted, motion was seconded by Mr .
Claiborne and carried. Copy of Resolution 63-6 is attached
to these minutes and made a part thereof.
Resolution 63-7 covering transfer of funds for the new
heating and air conditioning system in the City Hall was
next read in full. The 1962 Budget covered this work, but
it was not done until 1963. The 1963 Budget did not include
this item and it is necessary to make provisions to cover
same. The matter was discussed, following which Mr. Claiborne
moved the adoption of Resolution 63-7 , seconded by Mr.
Johansen and carried. Copy of Resolution 63-7 is attached
to these minutes and made a part thereof.
Contract with the City of Neptune Beach for radio service
was next presented and authorization requested for the Mayor
and City Clerk to sign same for the City. This contract is
for $3 , 000.00 per year for three years to be paid in monthly
installments of $250. 00 per month. Mr. Johansen moved that
the Mayor and City Clerk be authorized to sign this contract
for the City, seconded by Mr. Claiborne and carried.
Miscellaneous correspondence as outlined on the agenda was
presented and read to the Commission.
Mr. Lawrence, Chairman of the Seawall Committee, advised that
they would like permission from the City to talk to engineers
and, if necessary, engage an engineer for services they might
need. It was agreed that they have the authority to consult
with engineers and come back with recommendations on same.

Report of Fire Chief Howell for the month of January, 1963,
was received and filed.
A comprehensive report from Police Chief McClung was received
and studied by the Commissioners and filed.
Mr. Printon presented a request for building permit covering
a restaurant to be built on Robert Street, just off Mayport
Road, and advised that this location is in the proper zoning
for a restaurant and meets the Building Code. They are ask-
ing for a small dance area in connection with their restaur-
ant. The matter was discussed, following which Mr. Lawrence
moved that the permit be granted, seconded by Mr. Moore and
carried.
Mr. Lawrence requested that a representative be appointed to
serve on a temporary committee with similar members from the
other Beaches to coordinate seawall plans. It was brought
out that representatives of the other Beaches met here at
the City Hall earlier this afternoon to discuss our overall
seawall problem. Mr. Johansen suggested that Mr. Lawrence
was the proper person to serve as he is already working on
this problem. Mr. Isaacs concurred with this opinion and
appointed Mr. Lawrence, with Mr. Printon to serve as alternate.
Mr. Printon presented a request for building permits for an
A & P Store at Atlantic Boulevard and the extension of Sail-
fish Drive and a Post Office building on Penman Road, extended.
He recommended that the permits be granted subject to their
complying with the Southern Building Code and our Ordinances.
There are parts of the plans that will have to be revised
by their architect. Following discussion, Mr. Johansen moved
that these permits be granted subject to the conditions
stated by the City Manager, seconded by Mr. Claiborne and
carried.
There being no further business, Mr. Isaacs declared the
meeting adjourned.

RESOLUTION # 63-6
WHEREAS, the Colonial Oil Company station located at
Atlantic Boulevard and Seminole Road is situated in
line with the right of way of Seminole Road, extended,
to Atlantic Boulevard, and
WHEREAS, two roadways have been constructed forming a
"Y" around said station, and
WHEREAS, the volume of traffic using these two approaches
to Seminole Road from Atlantic Boulevard makes for a
hazardous traffic situation, and
WHEREAS, the proximity of a retail business center with
considerable customer traffic further aggravates the
situation, and
WHEREAS, the actual infringement of the operation of
this business is on State Road Department right of way,
and
WHEREAS, this roadway is used by the Duval County School
busses and pedestrian school traffic,
NOW THEREFORE BE IT RESOLVED BY THE CITY' OF ATLANTIC
BEACH, FLORIDA, THAT the State Road Department take the
necessary action to have the property condemned and the
building removed so that a safe right angle approach can
be constructed to Atlantic Boulevard.

RESOLUTION #63-7
WHEREAS, the City Commission of the City of
Atlantic Beach, Florida, in adopting the 1962
Budget, provided funds for the installation of
a heating and cooling system in the City Hall,
and
WHEREAS, the re-advertising for bids delayed
the project into 1963, and
WHEREAS, the 1963 Budget made no provision for
the payment of this bill,
NOW THEREFORE BE IT RESOLVED that the bill of
Arlington Heating and Sheet Metal Company in
the amount of $2, 570.00 be paid from Fund #204,
City Hall R .pairs, and that $2, 570.00 be trans-
ferred from the Emergency Expense Fund #1050
to F-:nd #204.
