` MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMiMISSION HELD AT THE CITY HALL ON MONDAY, APRIL 13TH, 1964

The meeting was called to order by the Mayor-Commissioner ,
Mr. Olten.
The Invocation was given by Chaplain Hubert Vinson of the May-
port Naval Base.
Previous to the Invocation there was a moment of silent prayer
in memory of Mrs . Robt. Vogel, wife of Chief Vogel. Mts. Vogel
passed away on April 10th, 1964.
Minutes of the regular meeting of March 23rd, 1964 were approved
as written upon motion of Mr. Goodling, seconded by Mr. Moore
and carried.
Minutes of the Special meeting of March 30th, 1964 were declared
approved as written following motion by Mr. Goodling, seconded
by Mr. Moore and carried.
Mr. Olsen recognized visitors present and called for any business
from the floor not on the agenda. Mr.Bill Donnell of the Atlantic
Beach Homes with building sites in the Royal Palms sub-division,
requested the Commission to consider re-zoning the lots directly
behind the proposed shopping center area to Residence B instead
of Residence A. He advised that Pic & Save have bought the land
and are getting their plans ready to present for a drug store
building and also the movie theatre chain are getting their plans
ready, and they feel that to rezone this row of lots would make
a buffer zone between the Business AA and Residence A. He will
get the plans and they will be referred to the Zoning Committee
for their recommendation at the next Commission meeting.
Mr.W.ErOwn brought up the question about building permits but
this item is on the agenda and will be considered later in the
meeting.
Mayor Olsen presented and read in full Ordinance #40-64-4 covering
4 year franchise with Southern Bell Tel., & Tel. Co. He then

declared the meeting in session for Public Hear ng on said Ordi-
1010 nance. Notice of Public Hearing posted in line with requirements
of City Charter. Mr. Lawrence moved that the Public Hearing be
continued to the next regular meeting on April 27th, 19(4, seconded
by Mr. Parks and carried. It was requested that Mr.Jack Eslick
of the telephone company meet with Mr. Lawrence, Mr. Goodling and
Mr. Printon to discuss the details of the franchise. Mr. Eslick
who was present advised that he would be glad to meet with them at
their convenience.
Mr. Olsen presented Ordinance #90-E4-18 covering re-zoning of
certain lands on Levy Rd. and Main St . to Business B and Industrial
and read Lame in full. He next declared the meeting in session
for Public Hearing on said Ordinance. Certified Proof of Publica-
tion of Notice of this Public Hearing is attached to these minutes
and made a part thereof. A letter was read from Dr. Wilen:ky re-
questing that a portion of his property at the corner of Mayport
Rd. and Levy Rd be re-zoned to Business B instead of Industrial
which it now is . A letter was also read from Dr. Chas . McKay
requesting that his land located at the corner of Edgar Street
and Mayport Rd. he left Business B a: it is too small to be used
as an Industrial site. Mr. Goodling moved that the Public Hearing
be continued to April 27th, 1964 in order that more study can Tse
. given to the details involved in this re-zoning, seconded by Mr.
Moore and carried.
An Ordinance amending Ordinances 80-59-3 and 80-E1-5 at to charges
for water taps was presented and read in full. Notice of Public
Hearing was posted in line with requirements of City Charter.
Mr. Olsen declared the meeting in session for Public Hearing on
said Ordinance, and as no one appeared either for or against the
Public Hearing was declared closed. Mr. Parks moved that the Or-
dinance not be passed due to inadequacies and that an ordinance
covering this matter be considered at a later date, seconded. by
Mr. Lawrence and carried. Whereupon Mr. Olsen declared that
Ordinance 4 60-64-7 had failed to pass on second and final reading.
A letter was read from Mr. Wm. Bostwick, Attorney, - at a law,
representing J.Y. McNeill and Sunbeam Mobile Home Sales asking
consideration in their violation of the Zoning Ordinance. Mr.
Bostwick and Mr. McNeill were both present and requested the Com-
mission to consider this as a hardship case and permit them to
continue their : ale of mobile homes on this property located at NW
corner of Mayport Rd. and Atlantic Blvd. The matter was discussed
at length and it was the consensus of opinion that re-zoning of

the property to permit this business would have to be considered
following receipt of request for change by the property owner. If
regcjue t is received from him then the matter would be taken up in
the usual procedure for re-zoning.

Mr. George C. Turcq, owner of Lot 15, Block 1, A.B.P. which is
located at 957 East Coast Dr. requested permission to enclose
his carport to conform to his house and that the restriction be
waived which does not allow off street parking in front yard
area. The matter was discussed and it was the consensus of
opinion that a variance could not be granted and that they put
up garage type doors as suggested by the City Manager or secure
the additional property (which they advise they are considering)
to provide parking area.
As to the H.T. Saffold building permit #7935, Mr. Printon advise0.
that when the permit came to his desk he noted that the valua-
tion on same was low for the house they were planning to build,
and that he took the necessary steps to correct this point. Mr.
Wallace Brown questioned our right to stop a permit which had
already been issued because the value was not sufficient. It
was brought out that we endeavor to correct all errors that we
find . The matter was discussed and Mr. Thompson advised that
at anytime construction can be stopped if anything is found
not consistant with our Ordinances or Codes.
Mr. Virgil Ison requested Commission approval for a license to
operate a barber shop, lockers , showers and a storage area in
. the rear of the property for cars. The location is 270 Mayport
Rd. and is in Business A. Outside car storage is not allowed
in this Zone. There was a discussion and it was agreed that he
could have the lockers and showers in connection with his barber
shop but not the car storage. Mr. Lawrence moved that the lock-
ers and showers be included in the barber shop license for Mr.
Ison, seconded by Mr. Moore and carried.
The recommendations of the Little League for use of our ball
field were read and discussed following which Mr. Goodling moved
that approval be given to the recommendations as presented sub-
ject to the approval of the City Attorney as to wording, seconded
by Mr. Lawrence and. carried.
The request of Mrs. B. Geraghty 511 Ocean Blvd. for granting
a hardship variance to the Zoning Ordinance by permitting her
to remodel her garage to a cottage was considered. The variance
is in the set-back requirements. Mr. Goodling moved that approval
be given for this hardship variance and a permit granted contin-
gent on the structure conforming to the Southern Standard Build-
ing Code and the plans being approved by the City Manager, sec-
onded by Mr. Parks and the call vote was :

Whereupon the motion was declared carried.

1010 In the previous discussion as to the Little League using the
ball park it was brought out that the City carries insurance on
the parks and the Little League has insurance on the individual
players.
On the 7th Street ramp, Mr. Goodling moved that all bids for
piling at 7th Street ramp be rejected, seconded by Mr. Parks ancc
carried. it was agreed that the most economical thing to get
ready for summer is to smooth off and cap over with a thin top-
ping for the least amount of traffic for the summer. It will
only be used by emergency vehicular traffic, and pedestrians.
The City Manager was instructed to notify the property owners
on either side to put in a splash apron to protect their proper-
ty.
The City has received the deed to the Lighthouse Station prop-
erty from the Colonial Oil Co. and has had same put on record.
A bill was presented covering the City's pro-rata share of 1/3
of insurance premium for the Beaches Auxiliary Police. Mr.
Moore moved that we pay as usual, seconded by Mr. Lawrence and
carried.
• A request was presented from Ernest Davis for time extension on
his building permit on Lot 9, Block 3, Lewis S/D. His finances
have not permitted him to start his building in the six months
as required on permit. Mr. Moore moved that we grant the time
extension on this permit, seconded by Mr. Goodling and carried.
A request was read from Mr. McFadden Newell for permission to
have access to the beach via the 15th Street ramp for his 145
lb. sailing craft without the aid of vehicular or any other
mechanical conveyance. It was advised that it has been arranged.
for him to use as requested.
An invitation was read from the Beaches Health Center to their
25th anniversary tea to be held at the Health Center on Friday
April 17th from 1 to 5 P.M.
A notice was read from Florida Public Utilities Commission of
a Public Hearing on application of V.F. Carter Delivery Service
for a Certificate of Convenience and Necessity.
It was advised that we have received from the Florida State Board
' of Health copies of chemical analysis on water samples collected
by the U.S. Geological Survey from the City's new well. This
report was received for filing.and information.

A letter was read from Mr. Bob Harris on the, Seminole Rd. and
Atlantic Blvd. intersection advising that he was turning the
information on same over to the County Engineer, Mr. John Crosby
for investigation and report.
There was also a letter presented from Duval County to the Expresr
way Authority asking them to incorporate this intersection at
Seminole Rd. and Atlantic Blvd. into their planning.
A letter was read from the Duval County Commission advising that
the parts have been ordered for the traffic light at Royal Palms
Dr. (Penman Rd. ) and Atlantic Blvd. and that the work should be
completed within the next 4 to 6 weeks.
A request was presented from Mr. James Bledsoe for a building per-
mit to build a concrete wall tying into present building and roof-
ing over existing slab, at 1077 Atlantic Blvd. Mr. Printon re-
commended that the permit be granted. Mr. Lawrence moved that the
permit be granted as requested, seconded by Mr. Moore and carried.
A request was presented for permit to put an awning on Patsy's
Restaurant ( Sylvia Rentz) at 461 Atlantic Blvd. Mr. Printon re-
. commended that the permit be granted. Mr. Lawrence moved that thc,
permit be granted, seconded by Mr. Goodling and carried.
Upon motion of Mr. Moore, seconded by Mr. Goodling approval was
given to payment of Davis Meter Co. bill in amount of $222.06
from Acct. 3201 in 1964 Budget.
Request was presented for permission to use the ball park on
Tuesday and Thursday nights by the Adult Soft Ball teams. It
was discussed and it was the consensus of opinion that they be
permitted to use as requested.
Mr. Lawrence requested that the City Manager be authorized to
advertise for bids on a shed with storage space and a separate
small toilet building for the park. There was considerable dis-
cussion and it was brought out that the plans and specs should be
at the Commission's approval and if there was an urgency about
the matter then perhaps a special meeting should be called. Mr,
Lawrence advised that he had plans and specs available and would
get them to Mr. Olsen.
Mr. Olsen asked that they think about the transferring of $200.00
from the Commissioners Fund to Account 301 in the 19E4 Budget for

the School Boy Patrol who have saved us on having extra police
for duty at school crossings. Would like to vote on it at next
meeting.
