MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 11, 1967 AT 8800

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Parks.
Minutes of the regular meeting of August 28, 1967 were
approved as written upon motion of Mr. Goodling, seconded by
Mr. Weldon and carried.
Minutes of the special meeting of September 2, 1967 were
approved as written upon motion of Mr. Goodling, seconded by
Mr . Parks and carried.
Minutes of the special meeting of September 5, 1967 were
approved as written upon motion of Mr. Weldon, seconded by Mr.
Parks and carried.
Mr. Howell advised that our City Attorney, Mr. Thompson, is
still out of town and doesn 't know just when he will return.
He therefore suggested that Mr. Oliver Ball be appointed as
Acting City Attorney until Mr. Thompson returns. Mr . Weldon
moved the appointment of Mr. Ball as Acting City Attorney as
suggested, seconded by Mr. Parks. Mr. Goodling stated that
Mr . Ball is a life long resident of the Beaches, a graduate of
Fletcher and the University of Florida. Mayor Howell then put
the question and the motion was carried.
Mr. Howell welcomed visitors and called for any business from
the floor not on the Agenda.
Mr. Henry Isaacs announced that on September 20th beginning
at 11:00 A. M. there will be a free clinic for Glaucoma tests

at the Beaches Hospital. Thinks the people of the Beaches,
especially those over 40, should take advantage of this
opportunity which is being given Beaches residents. Also feels
the Beaches Hospital should be congratulated for providing
this service.
A letter was read from Dr. James Corwin advising in past they
had received financial contribution or contribution of allow-
ing use of our lighted field for the Beaches Pop Warner Boys
football. They are not using the field this year, therefore
he requested a financial contribution. There was a discussion
in which it was brought out that we did not turn them down on
use of field, they advised us they were not using, however,
there was problem of insert pipes that held the sprinkler
heads which might cause injury. It did tear up baseball field
by practicing football there. They are using San Pablo field.
Mr. Weldon stated as he knows of no other way we can make
contribution he therefore moved the request be denied with
regrets, that City unable to make financial contribution,
seconded by Mr. Goodling and carried. Mr. Howell stated that
the field is available for use.
Mr. Howell opened the Public Hearing on the Mayport Cab Service.
The Public Hearing was continued from last meeting. Mr. John
Helms, Attorney for the Mayport Cab Service, stated he has had
opportunity to study the new State Statute, Chapter 67-905,
and thanked the Commission for the kindness and patience shown
his clients. Mr. Ball advised we do have to police this act,
however, incidental pickups by unlicensed cab is privileged,
cannot make habit of continued business within Municipality
unless granted authority - incidental discharge certainly not
police question. Mr. Howell stated we do not know whether
Commission would or would not have awarded Certificate of
Convenience and Necessity as legal act controls fact that we
cannot issue any more certificates and we are faced with
enforcement of own law and since they do not have certificate
they cannot legally operate in City except as provides for this
incidental situation. Mr. Ball stated he thinks should
Commission issue certificate, would very quickly be prohibited
by Court from issuing.
Mayor Howell read in full Ordinance #20-67-15 amending 1967
Budget, and declared meeting in Public Hearing. Notice of
Public Hearing was posted in line with Charter requirements.
It was brought out that we had more funds available in reserve
than anticipated, therefore we can reduce amount needed from
1967 taxes in Account #101 by $8,600.00, and increase amount
in Account #123 by $8,600.00, thus decreasing amount needed

in 1967 for ad valorem taxes. As no one appeared either for
or against said Ordinance, the Mayor declared the Public Hearing
closed. Mr. Holloway moved passage of said Ordinance on
second and final reading, seconded by Mr. Goodling and carried.
Mr. Vogel presented a report from Public Works Department,
copy of which is attached hereto and made a part hereof.
Mr. Vogel advised we have the new police car in service. Our
other police car broke down this morning, but will be back in
service soon.
There was discussion of road grader with prices on second hand
machine running from $1,700.00 to $4, 000. 00, but no details of
payments and responsibilities have been worked out. Following
discussion, Mr. Parks moved that the City Manager be requested
to secure firm proposals in the form of lease-purchase agree-
ments from any and all vendors of the machines and make
recommendations to Commission, seconded by Mr. Weldon. It was
brought out that the two firms at Beach that could rent such
equipment, are not interested in renting, and if rent from
Jacksonville firm at rate of $15.00 per hour plus operator 's
wages and cost of bringing to Beach and back, it would run
high. Mr. Goodling feels we should have competitive bidding.
Following further discussion Mr. Howell put the question and
the vote was:
Aye: Holloway, Parks, Weldon, Howell
Nay: Goodling
Whereupon Mr. Howell declared the motion carried.
Mr. Howell read in full Resolution #67-9 covering transfer of
funds from Public Safety Capital Account to Public Safety
Supplies and Building Maintenance Accounts. Mr. Parks moved
passage of said resolution, seconded by Mr. Weldon. Mr.
Goodling inquired if there ware accounts that were somewhat
low and Mr. Vogel advised they were. They are within a
department but since transfer is from Capital Account to
Operating Account, decided resolution was necessary. The
Mayor put the question and the motion carried. Copy of
Resolution #67-9 is attached to these minutes and made a part
thereof.

Mrs. Grage asked for approval of the following as officials for
the October 3rd primary election:
Mrs. Charlotte Gorman, Clerk
Mrs. Zoe ' Moore, Mrs. Ivy Higginson,
Mrs. Enid Nelson and Mrs. Martha Bradshaw,
Inspectors.
Mr. Holloway moved approval, seconded by Mr. Weldon and
carried.
Mrs. Grage announced the millage for 1967 tax roll will be 6. 2,
which is same as was for 1966.
Mr. Vogel requested approval to pay the $250.00 which is our
pro-rata of cost for license tag list, from the Commissioner 's
Account #210. Following discussion, Mr. Goodling moved the
City Manager be authorized to charge the expenditure as
requested to Account #210, seconded by Mr. Parks and carried.
Municipal Court Docket for September 4, 1967 was received for
information and filing.
There was a lengthy discussion of expressing concern over
conditions of that part of Atlantic Boulevard the traffic is
now driving on and also the sign which is in violation of
Ordinance. The City Manager was requested to write letter to
resident engineer in charge of construction for State Road
Department with copies to Expressway Authority. Chief Vogel
advised we are tolerating sign temporarily as they have plans
for new sign that will meet our Ordinance. Mr. Weldon thinks
poor practice to permit variance from Ordinance.
Mr . Goodling asked if City Manager, if Commission concurs,
would get together a list of all employees who have received
monthly salary increases as Ordinance provides as increases
are given upon recommendation by the City Manager with
concurrence of the City Commission.
Mr. Parks expressed personal appreciation to Mr. Ball for
helping out during this period.
Mr. Parks also inquired as to status of drainage pipe we
ordered. Mr. Vogel advised it has not come in yet and Mr.
Parks stated as soon as it comes in would like to see that

particular project get under way to relieve the condition in
that area. Mr. Parks also inquired as to the chlorinator and
pump controls at water plant, which was recently awarded.
Mr. Vogel advised the electrical work has been completed - all
that can do until equipment comes in.
Mr. Weldon advised he has noticed in numerous trips around town
that we have a great many dwellings he considers in unsafe
condition, unsightly, and perhaps a health hazard. He requested
that the City Manager make an investigation, consult with City
Attorney, and determine what power we have to either condemn
or repair or have torn down.
There being no further business Mayor Howell declared the
meeting adjourned.

PUBLIC WORKS REPORT
Completed normal cutting and cleaning of City parks and
road shoulders.
Completed sidewalk for Mr. R. S. Jackson, corner of 6fh
and East Coast - materials at owners expense.
Completed sidewalk for Mr. Adams on 7h Street between Beach
Avenue and Ocean Blvd.
Completed paving road shoulders not paved by Houdaille-Duval-
Y fright in 1967 resurfacing project. All material supplied
by Houdaille-Duval-alright at their expense.
Edged streets and cleaned gutters in Club Manor area.
Started edging and cleaning streets north of Plaza in
Royal Palms.
Began sweeping streets east of Sherry Drive with street
sweeper.
Cleaned and repaired more garbage containers.
Spent time cleaning up City Yard and general maintenance
work.
Completed painting cross walks around school and remarking
kiddie walk on Sherry Drive.
Put out extra trash trucks to clean up trash from northeaster.
